MINUTES OF MEETING HELD ON THURSDAY~ JANUARY 17t 1991

THE MEETING WAS CALLED TO ORDER
PLEDGE OF ALLEGIANCE
ORGANIZATIONAL MEETING:
1991 Fees: A motion was made by HENRY SMITH and seconded by
~TOHN TUTHILL to approve the 1991 fee schedule.
Tentative meeting dates for 1991: A motion was made by
HENRY SMITH and seconded by ALBERT KRUPSKI approve the meeting
schedule for 1991 to hold meeting on the first Thursday of every
month and the field survey to be the last Thursday of the month
to start in March.
Next Trustee Board Meeting: Thursday, February 14, 1991, 7:00p.m.
Worksession 6pm
NEXT FIELD INSPECTION: Tuesday, February 5, 1991 - 8 am
APPROVE MINUTES: A motion was made by Henry Smith and seconded
by John Tuthill to approve the minutes of November 1990.
I. MONTHLY REPORT:
Trustees monthly report for December 1990: A check for
$1,663.62 was forwarded to the Supervisor's office for the
General Fund.
II. PUBLIC NOTICES:
Public notices are posted on the Town Clerk's Bulletin
Board for review.
III. AMENDMENTS/WAIVERS/CHANGES:
Board of Trustees 2 January 17, 1991
1. Z & S Contracting on behalf of FRANK BURR request waiver to
construct 18' X 30' deck at property located on Fishers Island.
A motion was made by JOHN TUTHILL and seconded by JOHN
BREDEMEYER to grant the waiver to construct the deck. ALL AYES.
2. John Bertani on behalf of ANTHONY PANZARINO request
amendment to permit ~3755 to rebuild the boat house located at
800 Strohson Road, Cutchogue.
A motion was made by ALBERT KRUPSKI and seconded by JOHN TUTHILL
to approve the amendment with the conditions that it be rebuilt
inkind/inplace and drlr~ells are to contain all runoff.
AYES: Bredemeyer,Krupski,Tuthill,Bednoski.
Abstain: Smith.
3. Alfred MaGill request amendment to permit number 1911 to
increase the width of the dock to five feet from four feet.
Property off of East Creek.
A motion was made by ALBERT KRUPSKI and seconded by JOHN
BEDNOSKI to deny the request for the amendment without prejudice
for there is limited space in that area and they feel tkat the
dock will obstruct the waterway. ALL AYES.
V. ASSESSMENTS/ENVIRONMENTAL DECLARATIONS:
1. En-Consultants on behalf of JAMES GRATHWOHL to construct
a one-family dwelling, sanitary system, retaining wall, well,
bluestone (or similar pervious) driveway, approximately 125
c.y. of fill will be added as shown. Construct 238+/- 1.f. of
timber retaining wall above line of ~ and backfill with 150
c.y. of clean fill to be trucked in. Construct a dock
consisting of a 4' X 10' fixed elevated (4' above grade) walk,
3' X 16' hinged ramp; (2) 6' X 16' floats secured by (3) 8"
diameter pilings. Located at Williamsburg Lane, Southold.
A motion was made by JOHN BREDEMEYER and seconded by ALBERT
KRUPSKI to table the assessment on this project until a revised
plan is received showing a landscape plan with a buffer zone and
placement of the retaining wall. ALL AYES.
2. Land Use Co., on behalf of PANAGIOTIS GAZOULEAS to
construct a single family dwelling, attached decking and
associated sanitary system a minimum of 75' from the landward
limits of TWL. House construction will require approximately
300 c.y. of clean fill to meet flood plain regulations and
SCDHS requirements. Please note that said fill area was
previously approved under NYSDEC issued for Harborview at
Mattituck.
A motion was by HENRY SMITH and seconded by JOHN BEDNOSKI to
grant a negative declaration on this project. ALL AYES.
A motion was made by ALBERT KRUPSKI and seconded by JOHN
BEDNOSKI to go into Public Hearings. ALL AYES.

IV. PUBLIC HEARINGS:
HIS IS A PUBLIC HEARING IN THE MATTER OF THE FOLLOWING
PPLICATIONS FOR PERMITS UNDER THE WETLANDS ORDINANCE OF THE
TOWN OF SOUTHOLD. I HAVE AN AFFIDAVIT OF PUBLICATION FROM THE
SUFFOLK TIMES AND AN AFFIDA%~T OF PUBLICATION FROM THE LONG
ISLAND TRAVELER-MATTITUCK WATCHMAN. PERTINENT CORRESPONDENCE
MAY BE READ PRIOR TO ASKING FOR COMMENTS FROM THE PUBLIC.
PLEASE KEEP YOUR COMMENTS ORGANIZED AND BRIEF:
FIVE (5) MINUTES OR LESS~ IF POSSIBLE
7:20 P.M. - In the matter of the application of JOHN GABUSI to
~eplace existing storm damaged bulkhead within 18" of existing
ulkhead located on 7480 Peconic Bay Blvd., Laurel.
TRUSTEE BREDEMEYER: Is there anyone here who wishes to speak on
behalf of this application. Anyone who wishes to speak against
this application?
~.HN HOLZAPFEL: Just a little note. I am not speaking against
It is already done. The 18" puts it out that much further
~han the two adjoining ones.
TRUSTEE KRUPSKI: We realize, but the practical difficulty of the
way it was designed.
JOHN HOLZAPFEL: I understand that, as point that is not a
problem.
TRUSTEE KRUPSKI: At that point they are so far~ aut. It is not
like they are loosing their beach, because they don't have it
anyway.
JOHN HOLZAPFEL: I just want to make that point.
TRUSTEE SMITH: We realized that when we did that. But
environmentally if he replaced inkind/inplace, I think we
would have a disaster there.
TRUSTEE BREDEMEYER: Just so everyone realizes there was an
emergency authorization given because there was a question of
property lost in this case. The Board reviewed this as an
emergency application.
JOHN HOLZAPFEL: As I said, it is not a problem. I just brought
up the point.
TRUSTEE BREDEMEYER: O.K. Is there anyone who wishes to comment
additionally. There being no additional comments, make a motion
to close the hearing in this matter?
TRUSTEE KRUPSKI: So moved
TRUSTEE SMITH: Second. ALL AYES.
TRUSTEE KRUPSKI: I make a motion that we approve the application
of John Gabusi.
TRUSTEE SMITH: Second. ALL AYES.
TRUSTEE BREDEMEYER: Next hearing that was scheduled for 7:16
p.m. is in the matter of En-Consultants, Inc. on behalf of
FRANCES FRISBIE to construct a timber dock consisting of a 4'
X 30' fixed elevated (4' above grade of marsh) walk; 4' X 14'

hinged ramp; 6' X 16' float secured by (2) 8" diameter pilings
located at 8050 Nassau Point Road, Cutchogue.
Is there anyone here who wishes to speak on behalf of this
application? Is there anyone who wishes to speak against this
application?
JOHN HOLZAPFEL: Again, just col~,,~ents.
TRUSTEE BREDEMEYER: Yes, there was specific c~u,ents by the
Conservation Advisory Council requested to stipulate that the
applicant contain all runoff and take measures to stop any
erosion during construction. The Council also suggests
applicant install a stairway or form terracing (stairway is
preferred) to help eliminate erosion. Is that all your concerns
with respect to this? O.K. is there any other co~,~nts for or
against? There being no further comments, I will take a motion
to close the hearing in this matter.
TRUSTEE BRDNOSKI: So moved.
TRUSTEE TUTHILL: Second. ALL AYES.
TRUSTEE KRUPSKI: Motion to approve the application as written
with the addition of steps from the top of the elevation, the
lawn of the property, going down and attaching to the dock
itself.
TRUSTEE TUTHILL: Second. ALL AYES.
TRUSTEE BREDEMEYER: Next hearing was scheduled for 7:17 p.m. It
is now 7:24. In the matter of the application of John
Geideman on behalf of JOSEPH FIDJINSKI to construct a 4' X
30' fixed dock; 3' X 10' ramp; 6' X 20' float and fence
surrounding property located at School House C~ee.k, New Suffolk.
This application is an amended application over an initial whick
would have included dredging and lose of inter-tidel wetlands.
This was submitted as an alternative by the applicant. Is there
anyone here -who wishes to speak on behalf of the application.
JOHN GEIDEMAN: If there are any questions?
TRUSTEE BREDEMEYER: There are questions with respect to the
application and/or there might be some comments to the
negative. Is there anyone here who wishes to speak against this
application?
BRUCE WILSON: My name is Bruce Wilson. I am one of the owners of
New Suffolk Shipyard. It is on the north side of'School House
Creek. Directly across from where the purposed addition is to
be placed. Some of the concerns that we have. Based on the
plans that were submitted, if there is an extension from
existing fixed dock that is in place. The extension calls for
an addition 30' fixed pier plus ramp, plus float. Based on our
measurements across the creek, if that where added on to the
existing dock that would leave a fairway of roughly four feet
between the edge of the floating dock as purposed and the
currently existing docks at the Shipyard, not including any boat
that would be tide up at the end. Obviously that is a concern
to us in sofar as it would cut off all traffic involving
twenty of our slips as well as access to the gas dock and
maneuverability into our travel as well and prevent surfacing of
all our boats. Based on what was submitted we have that concern.

TRUSTEE BREDEMEYER: Mr. Geideman, who prepared the plan, is it
possible that there is a miss understanding that maybe a staking
in the field might alleviate it and a review of your line
drawing with the gentlemen?
JOHN GEIDEMEN: I, unfortunately, left my plans to be printed
and when I went there to pick them up this evening, they were
not ready. If you are looking at the plan that starts at a
monument back quite a ways from the edge of the bank. I don't
think the interpretation that is being made of the completion in
front of you people as it will exist when the dock is in place.
The bank of the creek there drops off very quickly. If you look
at the section. It drops off very quickly. The dock is six
feet in width and only goes into the creek about six feet. It is
no further out then the adjacent docks.
TRUSTEE TUTHILL: Mr. Geideman, can you come up here please?
TRUSTEE BREDEMEYER: While Mr. Geideman is approaching the
dais, I have a question for Mr. Wilson. Are you familiar with
that other dock which would be to the seaward of the proposed?
MR. WILSON: The existing one or the adjoining one.
TRUSTEE BREDEMEYER: The existing one on the adjoining property
of Mr. Tuthill.
MR. WILSON: Yes.
TRUSTEE BRRnEMEYER: Since this shows no further out then that
dock, is that dock a problem?
~R. WILSON: No that dock is no problem.
TRUSTEE BREDEMEYER: So in other words, the concern maybe with
the verbal description as it conflicts with the line drawing and
it may not be a problem other then to clear up. the schematics.
MR. WILSON: Yes. That is probably the case. If it is based on a
certain distance from the post, from that monument on the site,
I am sure that is just an interpretation of the wording.
TRUSTEE SMITH: Do you have any problem putting the float
parallel to the shore? Like that.
MR. GEIDEMAN: Well, I don't see a problem.
MR. SMITH: You can keep your catwalk, ramp and float, but have
the float go parallel to the shoreline.
MR. GEIDEMAN: Yes, we could. Let me tell you why we have it
this way. When you diagonal this thing the corner goes over
here and comes down very close to this corner. He wanted to get
some room in here.
~iR. WILSON: That would certainly alleviate one of the concerns.
It is actually this particular spot there. But again I think
that if the intention is to be the same distance from this
monument, then it will probably clean up the problem. If this
float can be turned parallel to the shore, that is preferential
to us. More so then the perpendicular nature of it, was the
extension to add 30' Make it 30' out.
TRUSTEE SMITH: No matter what happens, if this goes in and it
blocks off your gas dock and your boat slips, it has to come out.
MR. WILSON: Right, I understand.
TRUSTEE SMITH: That won't happen.
MR. WILSON: If it could be parallel to the shore and relative
proximity as close to the shore as it is now, I don't think that
would cause a problem.

MR. GEIDEMAN: Well if I say to do that. Put it in this
fashion here, would it be agreeable to you people? We were out
here no further then this road. That was the reason. We wanted
to get a row boat in here. If it has to go like this.
BRUCE WILSON: Two things to be aware of; the opposing shore is
not parallel to this shore. The opposing shore is more like
that. So the distance here is going to be less. Regardless.
That would probably work out fine. Again, the important thing
is the distance of the add-on to the fixed dock from the
existing. Where you are going to put this.
TRUSTEE SMITH: This is your shore line...
JOHN GEIDEMAN: We want to get as close to this...
BRUCE WILSON: If it is going to be maintained close to the shore
line, I don't think we will have a problem. It is just when we
read an extension to add on a 30' fixed pier.
TRUSTEE SMITH: I understand.
JOHN GEIDEMAN: Why don't I submit a...
TRUSTEE BREDEMEYER: I was just going to say, Mr. Geideman if
you could meet with Mr. Wilson and if you can come up with
revision that is acceptable and just have him sign off on it or
call the Trustee office, we could even move it subject to that
tonight. I think navigation is the primary issue at this
point~ Since the applicant was very nice in modifying the
project to date, I am sure the Board will try and move it along
for him if you can work it out with Mr. Wilson.
BRUCE WILSON: I am sure that is not a problem.
JOHN GEIDEMAN: O.K.
TRUSTEE BREDEMEYER: At this point, is there anyone else who
wishes to comment with respect to this application? I take a
motion to close the hearing in this matter?
TRUSTEE KRUPSKI: So moved.
TRUSTEE TUTHILL: Second. ALL AYES.
TRUSTEE SMITH: I would like to make a motion that we approve
this application with the stipulation that Mr. Geideman give a
revised plan and it be signed off by Mr. Wilson if he will be
agreeable to the whereabouts of the float.
TRUSTEE KRUPSKI: Second. ALL AYES.
7:35 P~M. In the matter of the application of Larry Tuthill to
construct a 80' bulkhead in School House Creek.
TRUSTEE BREDEMEYER: Is there anyone here who wishes to speak on
behalf of this application?
LAP~Y TUTHILL: I am Larry Tuthill. I hope to get approval in
this matter and I am here if you have any questions on it.
TRUSTEE BREDEMEYER: Thank you Mr. Tuthill. Anyone else who
wishes to speak on behalf of this application?
JOHN SCOTT: I am John Scott and I rent the space on this
bulkhead. One reason that he is putting it in is to enable me
to unload my boats. To keep so we can maneuver in the area.
TRUSTEE SMITH: Larry can you come here a minute? Where exactly
is the new bulkhead going in? From where to where?
Mr. Tuthill pointed out on the map and Trustee Smith marked the
map accordingly.

TRUSTEE BREDEMEYER: Is there anyone here to speak against this
application or comment otherwise?
There has been some concern that we are loosing some inter-tidal
marsh here. The compelling evidence and the DEC hearing was
that this is to protect the commerce of the State and include
the very viable shellfish grow out operation. If that is a
correct characterization of your operation, I was wondering if
we could encourage you to make use of the grass maybe in another
location in the Town where they might need some erosion control
or where re-vegetation has been called for? I think we can give
you a list of at least two or three projects the Trustees have
recently required re-vegetation on, so that you can go directly
from this site to another site make use of it. Would that be
agreeable? I think that would be a nice thing to do? I figure
we would open up for discussion.
LARRY TUTHILL: I don't think it is worth anything, truthfully.
TRUSTEE BREDEMEYER: I just...there is definitely, what is the
gentlemen's name in Gull Pond? Also we have the one in,
Brennen in West Lake. O.K. enough said. Is there any further
comment? Being no further co~uL,ent I take a motion to close the
hearing in this matter?
TRUSTEE KRUPSKI: So moved.
TRUSTEE TUTHILL: Second.
TRUSTEE BREDEMEYER: All in Favor?

TRUSTEE BREDEMEYER: A motion on this application?
TRUSTEE SMITH: I make a motion that we approve this application
for Larry Tuthill to construct 80' of bulkhead~in School House
Creek with the stipulation that we contact a couple of these
people and have them, if they are interested, to remove this
marsh there at their expense and have it planted at their site.
TRUSTEE TUTHILL: Second.
ALL AYES.
VI. RESOLUTIONS:
7:35 A motion was made by ALBERT KRUPSKI and seconded by JOHN
TUTHILL to go back onto the regular meeting. ALL AYES.
1. Board to set public hearings for the February 14, 1991
regular meeting.
A motion was made by ALBERT KRUPSKI and seconded by JOHN
BEDNOSKI to set public hearings for February. ALL AYES.
2. Board to review the dock application of CHARLES BLIEFELD.
After a discussion with John Costello, agent to applicant
and some of the neighbors of Mr. Bliefeld, it was decided to
reduce the length of the ramp and then stake the area of the
outside edge of Dock. Then the Trustees will inspect to see if
this will be a solution.
3. Board to review the Bruce Anderson reports on CAMPBELL
dated January 8, 1991 and PETROCELLI dated December 13, 1990.

A motion was made by ALBERT KRUPSKI and seconded by JOHN
BREDEMEYER to rescind the positive declaration on the Campbell
project and approve the report of Bruce Anderson dated January
8, 1991 and waive the 1' contours. ALL AYES.
A motion was made by ALBERT KRUPSKI and seconded by JOHN
BREDEMEYER to approve the report of Bruce Anderson dated
December 13, 1990 for PETROCELLI. ALL AYES.
4. Board to set February 8,11,15 & 26, 1991 at 7 P.M. for
special meetings in regard to Brick Cove Marina.
A motion was made by HENRY SMITH and seconded by ALBERT KRUPSKI
to approve the meeting dates.
5. East Road, Cutchogue. Letter from Fleet's Neck Property
Owners Association, Inc. A motion was made by JOHN BREDEMEYER
and seconded by ALBERT KRUPSKI to have Trustee Bednoski to
continue working on this Trustee project.
6. JOHN MILAZZO A decision was made to have applicant submit
new application being the same as the one to Zoning Board of
Appeals.
VII. MOORINGS:
1. Francis S. Wippert III request mooring in Gull Pond for a
20' Sail boat with 100lb mushroom.
A motion was made by JOHN TUTHILL and seconded by JOHN BEDNOSKI
to table this application until Gull Pond can~be reorganized.
ALL AYES.
2. Mark Weinrod request stake in Narrow River for a 16'
Hobie Cat. Would like to have mooring while waiting for a
stake.
A motion was made by JOHN BREDEMEYER and seconded by ALBERT
KRUPSKI to approve mooring and put on waiting list for a stake.
ALL AYES.
3. John Morris request stake in Narrow River for a 20'
outboard. Would like to have mooring while waiting for a stake.
A motion was made by JOHN BREDEMEYER and seconded by ALBERT
KRUPSKI to approve mooring and put on waiting list for a
stake. ALL AYES.
At 8:25 a motion was made by HENRY SMITH and seconded by ALBERT
