JACOBS, whose address is 1614 Dawes Road NE, Palm Bay, Florida 32905, as Executor of the last will and testament of DOROTHY M, JACOBS, who died on the 29th day of October, Two Thousand Six, party of the first part, and VERNON E. JACOBS, residing at 1614 Dawes Road NE, Palm Bay, Florida 32905, and DOROTHY E. STEVENS. residing at 216 North Street, Grecnport, New York 11944, party of the second part, WITNESSETi-I, that the party of the lirst pan, to whom letters testamentary were issued by thc Surrogate's Court, Suffolk County, New York (File No. 1240P2007) on September 13, 2007, and by virtue of the power and authority given in and by said last will and testament and/or by Article I I of the Estates, Powers and Trusts Law, and in consideration ofTEN (SlO.O0) DOLLARS, paid by the party of the second part, does hereby grant and release unto the party of thc second part, the distributees or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land with the buildings and improvements thereon erected, situate, lying and being at Greenport, Town of Southold, Suffolk County, New York, and known and designated on a certain map entitled "Map of Lots of Abraham C. Sully. at Grecnport, N.Y., November 8, 1890, Albertson Case, Survey, Southold, New York", and filed in thc office of the Clerk of Suffolk County, as and by nos. six (6) and seven (7); said Lot six (6) being bounded with reference to said map as follows: Northerly by Lot No. g, seventy (70) feet; easterly by Main Street, fifty-six and eight-tenths (56.8) feet; southerly by Lot No. 4, eighty-four and four-tenths (84.4) feet; and westerly by Lot No. 7, filly-one and six-tenths (51.6) feet, and said Lot No. 7 being bounded with reference to said map as follows: Northerly by said Lot No. 8, seventy (70) feet; easterly by said Lot No. 6, fifty-one and six-tenths (51.6) feet; southerly by said Lot No. 5, ci ,ghty-four and four-tenths (84.4) feet, and westerly by First Street, fitly (50) feet; BEING AND INTENDED TO BE thc same premises conveyed to Dorothy M. Jacobs by deed dated August 28, 1974, and recorded September 9, 1974, in the Office of the Suffolk County Clerk in Liber 7709, Page 593. TOGETHER with all right, title and interest, if any, of thc party of thc first part in and to any streets and roads abutting the above described premises to the center line thereof, TOGETHER with the appunanances, and also the estate which the said decedent had at thc time of decedent's death in said premises, and ',dso the estate therein, which the party of ibc first part has or has the power to convey or dispose of, whether individually, or by virtue o£ said will or otherwise, TO HAVE AND TO HOLD the premises herein granled unto lhe party of the second part, the distributecs or successors and assigns of thc patty of the second part forever. AND the party of the ih'st part covenants that thc party of the first part has not done or suffered anylhing whereby the said premises have been incumbered in any way whatever, except as aforesaid. AND tho party of the first part, in compliance with Section 13 o£the Lien Law, covenants that thc party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying thc cost of improvement and will apply same first to thc payment of thc cost of improvement before using any part of the total of the sam~ for any other purpose. The word "party" shall be construed as il' it reads "parties" whenever the sense of this indenture so requires.
