party of the second part,
WITNESSETH, that whereas letters of edmiolalrstlan were issued to the party of the rust pa~t by the Suffolk
County Surrogate's Court on March 26, 2007 under File No. 198A2007 and by virtue of the power and
authority given by Article 11 of the Estates, Powers and Trusts Law, and in distribuUon of the Estate of Rudi
Nec to his sole distributes and in consideraUon of TEN and no/100ths ($10.00) dollars, paid by the party of the
second part, does hereby grant and release unto the party of the second part, the heirs or successors and
assigns of the party of the second part forever,
ALL that certain plot, piece or pamel of land, with the buildings and improvements thereon erected, situate,
lying and being in the Hamlet of Cutchogue, Town of Southold, County of Suffolk and State of Now York being
bounded and described as follows:
BEGINNING at a point on the northerly side of the Main Road which point is 270 feet west of the
southwesterly corner of land formerly of John Doreski;
RUNNING THENCE in a westerly dkecUon along the northerly side of Main Road 200 feet to land now or
formedy of Cross;
THENCE along said land now or formerly of Cross in a northerly direction 140 feet;
THENCE along lands now or fo~neriy of George Nec in an easterly direction 200 feet;
THENCE in a southerly direction 140 feet to the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to Rudl Nec by deed made by ,Ntna M. Aisc
dated August 15, 1986 and recorded in the Suffolk County Clark's Office on September 23, 1986 in Uber
10130 at Page 284.
TOGETHER with all right, title and interest, If any, of the party of the first part, in and to any streets and roads
abuffing the above described pramlsas to the center lines thereof;, TOGETHER wi~l the appurtenances, and
also all the estate which Ihs said decedent had at the time of decedent's death in ~id pramisss, end also the
estate therein, which the party of the first part has or has power to convey or dispose of, whether individually,
or by virtue of said will or othen~visa; TO HAVE AND TO HOLD the premises herein gmntad unto the party of
the second part,'the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the fkst part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid,
AND the pa,'ty of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part w~l recatve the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of ~ cost of the Improvemanl before using any part of the total of the sema for arty other
purpose. The word 'party" shall be construed as if it reed "parties' whenever the sense of this indenture so
requires.
