certified by Kontokoste Associates and filed in the Office of the Clerk of Suftblk County on the
28'" day of July, 1987 as map number 166 defined in the Declaration of Condominium entitled.
"Cleaves Point Commons Condominium" made by Gardiners Bay Development, Inc., under
Article 9-B ofthe New York Real Property I.aw dated July 8, 1987, and recorded in The Off]ce
of the Clerk of Suffolk County on the 28~' day of July, 1987, in L. 10375 of conveyances at cp 01,

Being and hereby intending to convey the same premises as conveyed to the parties of the
first part by Deed dated October l, 1987, and recorded in thc Suffolk County Clerks Office on
November 6, 1987. in Liber 10464, page 270;
TOGETHER with the nppuneanncas and all the estate and rights of the party of the first
part in and to said premises;
TOGETHER with, and subject to, thc rights, obligations, easements, restrictions and
other provisions set forth in the Declaration, Floor Plans, the By-Laws and the Rules and
Regulations of'Cleaves Point Commons Condominium. all as the same may be amended from
time to time (hereinafter collectively referred to as thc "Condominium Documents"), all of which
shall constitute covenants running with the Land and shall bind any person having at any time any
interest or estate in the Unit, as though recited and stipulated at length herein;

consents and other matters of record as pertain to the Unit. IO the Land and/or to the Buildings
(which Land and Buildings are hereinafter collectively referred to as the "Property").

AND thc party of the first part, covenants that the party or the first part has not done or
suffered anything whereby the said premises have been encumbered in any way whatever, except
as aforesaid.
,4ND the party of the first part, in compliance with Section 13 of the Lien Law, covena'ats
that the party of the first pan will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to he applied firs~ for the purpose of paying the
cost of the improvement and will apply the same first to the payment of the cost of the
improvement be lore using any part of the total of the same for any other purpose.
The party of the second part accepts and ratifies the provisions or the Condominium
documents and agrees to comply with all the terms and provisions thereof.
The word "party" shall be construed as if it read "p. anies" whenever the sense oflhis
indenture so requires.
