second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being in East Marion, in the Town of Southold, County of Suffolk and
State of New York, known and desiginated as Lot No. 7 on a ceflain Map entitled, "Map of East
Marion Woods", and filed in the Office of the Clerk of the County of'Suffolk on Jane 7, 1989, as
Map No. 8759.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part
by deed dated 8/9/02, recorded 8/21/02 in Libar 12204, Page 695.
TOGETHER with all fight, title and interest, if any, ofthe party of the firsl ~ in and to any
streets and roads abutting the above described premises to the center lines thereof,
TOGETHER with the appurtenances and all the estate and rights of the pan'y ofthe first part
in and to said premises,
TO .HA V~ AND TO HOLD thc premises herein aranted unto the pafly of the second part, the
heirs or successors and assigns of the party of the second part forever.
A/VD the party of thc first part, covenants that the party ofthc first part Juts not done or
suffered anything whereby the said premises have been encumbered in any way whatever, except
as nforasaid.
· ,lArD the party of'the first part, in compliance with Section 13 ofthe Lien Law, covenants
that the party orr the first pan will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose of'paying thc
cost of'the improvement and will apply the same first to the'payment of the cost of the
improvement before using any part oftbe total of the same for any other purpose.
The word "party" shall he consmd as ifit read "paflies" whenever thc sense of this indenture so
