THIS INDENTURE, made the IJ 'll!day of October, two thousand seven, BETWEEN

of the first part, and

WITNESSETH, that the party of the first part, without consideration, does hereby grant and release unto the party
of the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, wilh the buildings and improvements thereon ereeled, situate, lying
and being at Fishers Island, Town of Southold, County of Suffolk and State of New YOrik, being more particularly
bounded and described as follows:
BEGINNING at a monument set on the southeasterly line of Equestrian Avenue at its intersection with the
northeasterly line of Beach Avenue, said monument being located 655.55 feet North of a point which is 3840.61
feet West of another monument mariklng the United States Coast and Geodetic Survey Triangulation Sta~on
"PROS"; and
RUNNING THENCE along said Beach Avenue line South 47 degrees 07 minutes 40 seconds East, 146.37 feet;
THENCE North 27 degrees 29 minutes 11 seconds East, 136.33 feet 10 a monument;
THENCE North 62 degrees 05 minutes 00 seconds West, 134.00 feet to a monument at said Avenue line, this
line abutting northeasterly on other land now or fonnerty of the party of the first part;
THENCE along said Avenue line South 16 degrees 03 minutes 40 seconds West, 40.08 feet;
THENCE along said Avenue line South 41 degrees 46 minutes 00 seconds West. 61.10 feet to the monument
set at lhe point of BEGINNING.

herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second
part forever.
AND lhe party of the first part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been encumbered b1 any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants thalthe party of the first
part will receive the consid~on for this conveyance and will hold the right to receive such consideration as a
trust fund 10 be applied filst for the purpose of paying the cost of the improvement and will apply the same first
to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose. The word 'party' shall be construed as If It read 'parties' whenever the sense of this indenture so
requires.
