THIS IS TO CERTIFY THAT THE FOLLOWING RESOLUTION NO. 2006-447 WAS
ADOPTED AT THE REGULAR MEETING OF THE SOUTHOLD TOWN BOARD ON
MAY 9,2006:
WHEREAS, a bill has been introduced in the State Legislature as S.7787 and A. 10845 and
WHEREAS, the bill seeks to amend chapter 114 of the laws of 1998 amending the town law and
other laws relating to authorizing certain towns in the Peconic Bay region to establish
community preservation funds, in relation to extending the effective date thereoffrom December
31, 2020 to December 31, 2030; now, therefore, be it
RESOLVED, that pursuant to Article IX of the Constitution, the Town Board of the Town of
Southold herebv requests the enactment of Senate Bill No. S.7787 and Assemblv Bill No.
A.1-845 entitled "AN ACT to amend chapter 114 ofthe laws of 1998 amending the town law
and other laws relating to authorizing certain towns in the Peconic Bay region to establish
community preservation funds, in relation to extending the effective date thereof'.

AN ACT to amend chapter 114 of the laws of 1998 amending the town law
and other laws relating to authorizing certain towns in the peconic
Bay region to establish community preservation funds, in relation to
extending the effective date thereof
The People of the State of New York, represented in Senate and Assem~
Q].~9_~na~t as follows:
1 Section 1. Section 5 of chapter 114 of the laws of 1998 amending the
2 town law and other laws relating to authorizing certain towns in the
3 peconic Bay region to establish community preservation funds, as amended
4 by chapter 250 of the laws of 2002, is amended to read as follows:
5 ~ 5. This act shall take effect immediately; provided that article
6 31-D of the tax law, as added by section three of this act shall remain
7 in full force and effect until December 31, [~l 203Q when upon such
8 date the provisions of such section three of this act shall expire and
9 be deemed repealed, provided however, that the tax authorized by section
10 three of this act shall not take effect before July 1, 1998.
11 ~ 2. This act shall take effect immediately.

TITLE OF BILL: An act to amend the chapter 114 of the laws of 1998
amending the town law and other laws relating to authorizing certain
towns in the peconic Bay region to establish community preservation
funds, in relation to extending the effective date thereof
PURPOSE: To extend the sunset date for the real estate transfer tax
authorized pursuant to the peconic Bay Community Preservation Fund law
from December 31, 2020 to December 31, 2030.

Extends the sunset date for the real estate transfer tax authorized
pursuant to the peconic Bay Community Preservation Fund law from Decem-
ber 31, 2020 to December 31, 2030.
JUST~FICATI9.!'! :
The Towns within the peconic Bay region have successfully implemented
the provisions of Chapter 114 of the Laws of 1998 authorizing the
creation of peconic Bay Region Community Preservation Funds. Thousands
of acres have been preserved. In addition, the State of New York has
assisted the towns by making the Drinking Water Revolving Loan Fund
available to work in conjunction with the town CPFs. In short, the towns
are utilizing the loan interest loan capabilities of the EFC Revolving
Loan Fund to maximize the preservation of land now, before it is lost to
development. The proceeds of the CPFs are being utilized to service the
debt from the Revolving Loan Fund. TO maximize this effort and increase
the amount of open space that can be preserved, the towns need to
increase the revenue stream available from the CPFs. By doing so, the
towns can complete their open space plans more quickly before land is
lost to development. By extending the real estate transfer tax for 10
additional years, ,the towns will possess the revenue stream necessary to
use the EFC Revolving Loan Fund now and buy more land.
