Down's Farm Preserve
A meeting of the Southold Town Conservation Advisory Council was held Wed.,
November 7, 2007 at Down's Farm Preserve.
Present Were:

CALL TO ORDER
Chairman Don Wilder called the meeting to order at 5:30 PM.
CHAIRMAN'S ANNOUNCEMENTS
Chairman Don Wilder welcomed Glen McNab to the council.
REPORTS
Member Peter Young stated that meeting at 5:30 PM was a problem for him and
requested an earlier or later time. The members agreed to begin the meetings at 4:30 PM
until further notice.

APPROVAL OF MINUTES
Moved by Don Wilder, seconded by Peter Young, to Approve the Minutes of October 10,
2007.
DISCUSSION AND RECOMMENDATION OF WETLAND PERMIT & COASTAL
EROSION PERMIT APPLICATIONS
Moved by Don Wilder, seconded by Jack McGreevy, it was
RESOLVED to SUPPORT the Wetland Permit application of JERRY CALLIS to demolish
the existing single-family dwelling and construct a new, smaller single-family dwelling with
attendant sanitary system.
Located: 2350 Paradise Point Rd., Southold. SCTM#81-3-19.3

The CAC Supports the application with the Condition a line of staked hay bales is in place
during the demolition and construction activities, drywells and gutters are installed to
contain the roof run-off, and the installation of a 30' non-turf buffer.
Vote of Council: Ayes: All
Motion Carried
MARY PANKIEWICZ to demolish the existing single-family dwelling, abandon the existing
sanitary system and well, demolish the existing garage, remove portions of existing
driveway and to construct a new single-family dwelling with gutters leading to drywells,
sanitary system, and new water service.
Located: Peninsula Rd., Fishers Island. SCTM#10-11-8.1
The CAC did not make an inspection, therefore no recommendation was made.
FRANEKER INVESTMENTS, INC. to construct a 15.58'X 16' addition onto an existing
garden shed, to construct approx. 30' of retaining walls and a stone (pervious) parking
area.
Located: Private Rd., Fishers Island. SCTM#3-1-3.3
The CAC did not make an inspection, therefore no recommendation was made.
Moved by Don Wilder, seconded by Peter Young, it was
RESOLVED to SUPPORT the Wetland Permit application of PATRICK W. LOHN to
demolish and rebuild inkind/inplace, the existing wood frame deck (including footings),
and to construct a 12'X 15' wood frame deck extension to the northwest side of said
existing deck in order to square off the structure.

Moved by Jack McGreevy, seconded by Chris Kempner, it was
RESOLVED to SUPPORT the Wetland Permit application of DARYL MALTER to remove
and replace 110' of existing CCA bulkhead, construct 4'X 80' stairs to beach, and install
100' cy. clean sand fill.

The CAC Supports the application with the following conditions:
vinyl sheathing is used on the bulkhead;
provisions are made to stabilize the bluff;
a 20' non-turf buffer behind the bulkhead;
- open-grate decking on the landings of the stairs and support bracings
along the bottom of the stairs; and
- the elimination of lawn chemicals.

Moved by Don Wilder, seconded by Doug Hardy, it was
RESOLVED to SUPPORT the Wetland Permit application of NOANK AQUACULTURE
COOPERATIVE to install aquaculture gear; deploy four (4) additional FLUPSY's on the
aquaculture dock for nursery cultivation of shellfish seed, and floating bags and cages off
of the aquaculture dock, for the growout of shellfish seed; place cages and racks with
trays in the renovated shellfish barn to cultivate shellfish seed and to hold market shellfish
for winter harvest; and add two additional land-based upweller tanks 4'X 12' in the
shellfish barn.

Moved by Don Wilder, seconded by Doug Hardy, it was

RESOLVED to SUPPORT the Wetland Permit & Coastal Erosion Permit applications of
YAN RIEGER to construct a low-profile bulkhead using vinyl sheathing, a 12' X 32'
platform and 4'X 18' catwalk.
Located: 370 Harbor Rd., Orient. SCTM#27-4-6

The CAC Supports the application with the Condition of a 10' non-turf buffer, the catwalk
is constructed using Thru-Flow and 4X4 posts, the deck is limited to 2'X 4', and the
bulkhead is low-profile and kept in line with the neighboring bulkhead.
Vote of Council: Ayes: All

DISCUSSION AND RECOMMENDATIONS OF APPLICATIONS TO AMEND PERMITS
Moved by Jack McGreevy, seconded by Don Wilder, to
TABLE the Amendment application of ANNETTE CAMPBELL to Amend Permit #3961 to
include a 5'X 20' floating dock.
Located: 1185 Fleetwood Rd., Cutchogue. SCTM#137-4-27

The CAC Tables the application for the following reasons:
- the proposal is unclear and requires a detailed plan;
- the CAC questions how far out the proposed floating dock is going to
be in the water;
where will the seasonal dock be stored and how will it be transported;
and
what size pilings will be used, if any.
The CAC recommends that the present catwalk be replaced with open-grate decking
because of the observation of dead grass beneath the catwalk.
Vote of Council: Ayes: All
Motion Carried
The members furthered their discussion with the observation of a possible violation on the
neighboring property indicated as 1065 Fleetwood Rd. It appeared that the property owner
filled in approx. 100' of wetlands with sand. The members expressed their concern and
agreed to send a letter to James King and the Board of Trustees informing them of the
situation.
Moved by Don Wilder, seconded by Chris Kempner, it was

RESOLVED to NOT SUPPORT the Amendment application of FRANK & ANTOINETTE
NOTARO to Amend Permit #6391 to increase the size of the proposed pool from 16'X 31'
with a 56' setback from the top of the bluff to a 20'X 40' in-ground swimming pool with a
52' setback from the top of the bluff.
Located: 625 Calves Neck Rd., Southold. SCTM#63-7-30.1

The CAC does Not Support the application because there should be no further
encroachment to the bluff, no removal of trees larger than 8" DBH, and a 10' non-turf
buffer should be installed landward of the bluff.

NEW BUSINESS
Member Jack McGreevy drafted a letter to the LWRP Coordinating Council concerning the
shoaling of Down's Creek. The members of the council made a few changes and agreed
to have Jack present the letter to the LWRP Council at their next meeting.
In anticipation of meeting to discuss a strategic plan for the CAC, Peter Young prepared
an outline that the CAC may wish to consider as viable options, adding value to the
process of governance, such as historic cemeteries, lighthouses, review of the role of all
other town agencies, review position of student member to the CAC, educational
programs, trees, and environmental impacts of traffic congestion. As a result, the
members agreed to investigate these areas as follows: Don Wilder-Tree Committee and
Student Internship, Chris Kempner & Doug Hardy - Public Trust Doctrine and Andros
Patent, Peter Young-Lighthouses and Cemeteries.
Member Peter Young offered to invite the President of East End Lighthouses to the next
regular meeting of the CAC.
The next meeting of the Conservation Advisory Council has been set for Wed., December
5, 2007 at 4:30 PM at Down's Farm Preserve.
There being no further business to come before the Council, the meeting was adjourned
at 7:15 PM.
