Box 1925 Southold, NY 11971 RE: 590 NORTH VIEW DR., ORIENT SCTM#13-1-5.1 Dear Mr. Hurtado: The Southold Town Board of Trustees reviewed the survey prepared by Michael James Hillebrand last revised September 29, 2005 and determined the proposed in-ground swimming pool to be out of the Wetland jurisdiction under Chapter 97 of the Town Wetland Code and Chapter 37 of the Town Code. Therefore, in accordance with the current Tidal Wetlands Code (Chapter 97) and the Coastal Erosion Hazard Area (Chapter 37) no permit is required. Please be advised, however, that no construction, sedimentation, or disturbance of any kind may take place seaward of the tidal wetlands jurisdictional boundary or seaward of the coastal erosion hazard area as indicated above, or within 25' landward from the top of the bluff, without further authorization from the Southold Town Board of Trustees pursuant to Chapter 97 and/or Chapter 37 of the Town Code. It is your responsibility to ensure that all necessary precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction and Coastal Erosion Hazard Area, which may result from your project. Such precautions may include maintaining adequate work area between the tidal wetland jurisdictional boundary and the coastal erosion hazard area and your project or erecting a temporary fence, barrier, or hay bale berm. However, any activity within 100' of a Wetland line or seaward of the Coastal Erosion Hazard Area would require permits from this office. • 2 • This determination is not a determination from any other agency. We found that there were several areas within the Coastal Erosion Hazard Area where clearing and cutting has occurred. We told Mr. Hurtado that there was a violation but that he would not need to do replanting. Also,we told him that if he wants to do any more cutting or maintaining of the trimmed areas he would need a Coastal Erosion Permit from the Trustees to do that and to come into the Trustee Office to fill out an application. We explained that he is not to cut on the seaward size of the Coastal Erosion line,which runs seaward of the hay bale line. Enclosed are photographs taken at the site. Our incorporation papers of November 5, 1961 and subsequent bylaws state our reason as a community for incorporating as to acquire, maintain and improve the roads, beach rights, parking and other facilities, parks, common lands (including the common beach) and other easements in Brown's Hills Estates, Orient. The general funds shall be use only to enhance the beauty, utility and value of the real and marine property of the corporation and to make it safe. The Association keeps easements for community walking use and access for the benefit of our residents, which we insure and pay taxes on. As well, an important asset to all residents is our community beach stairs, which we built, maintain and insure, and which are located near your property,just across your neighbors about 150 ft to the west. Dear Members of the Board of Town Trustees: We residents of Brown's Hills are disappointed,angered,and frankly shocked that the Trustees of the Town of Southold at its Hearing on June 24,who are entrusted with the protection of the physical environment in coastal and wetland areas,very nearly approved the construction of an additional stair to the Brown's Hills beach,on the above\-mention property The vacant lot which was owned by Edna Doll is being developed by a speculative house builder named John Hurtado. We are especially annoyed that,according to the four residents and members of the Brown's Hills Association who attended the Hearing,it was abundantly clear that this application(# 18 on the Agenda)would also have received a rubber stamp approval,as had several cases already presented by a totally unprepared and ill-informed"expeditor"from Land Use Ecological Services. Almost no facts were presented regarding the Doll Property itself,nor about the Brown's Hills neighborhood(a private subdivision which owns and maintains its own roads and communal beach stair,access to all residents),nor even was it mentioned that the Brown's Hills stair already exists 200 feet to the west of this new proposed stair. Since the Trustees had not visited the site,and no plans were presented at the meeting,The Trustees had no idea that proposed stair would run down one of the tallest and steepest bluffs on the North Fork,already prone to erosion A previous Brown's Hills stair was abandoned and relocated just 15 years ago due to bluff erosion The only information provided the Trustees were comments made by one Trustee,Artie Foster. The four Brown's Hills residents heard Mr.Foster recommend that the platform be reduced slightly in size,that Mr.Foster had "dug the test hole",and that the stairs were"OK" and should be approved. As far as the four Brown's Hills residents could tell,this was the only information provided to the Town Trustees. We residents of Brown's Hills vehemently oppose the construction of this stair for the following critical reasons: 1)UNNECESSARY AND REDUNDANT: Brown's Hills already has a stair available to the future owner/ resident of this house,whoever that might be. Another stair is totally unnecessary for beach access,particularly for this property located scarcely 200 feet from the existing community-owned Brown's Hills stair. None of the eight Brown's Hills properties bordering Long Island Sound has private stairs. All Brown's Hills owners have been satisfied to use the communal stairs. 2)ENVIRONMENTAL DAMAGE The proposed stair would be constructed on one of the tallest and steepest bluff faces on the North Fork,in this case a change in elevation from 90 feet above sea level to 8 feet,a vertical change of 80 feet vertically over a horizontal dimension of 125-135 feet The Sound bluff regularly shows signs of erosion,which would inevitably increase with any sort of disturbance on its face to the soil or plant material. 3.NO HOMEOWNER Since there is no house or purchaser yet,it is impossible to know if the ultimate homeowner would want to own and maintain private beach stairs. The sole purpose of this stair is to increase the sales price and developer's profit,at the expense of the bluff's natural beauty,while potentially causing environmental damage. 4. CONSTRUCTION WITHOUT PERMISSION Since the Hearing on June 24,materials for the stair construction have been delivered to the Site. At the Hearing,the four Brown's Hills residents heard the Town Trustees approve,"ex post facto',several applications for stairs, bulkheads,and docks. Will this new stair be built WITHOUT APPROVAL,and approved after the fact? Our letter opposes an application for an additional stair on the Brown's Hills bluff, which a developer wants to build to increase the sales price of a spec. house he is building. The letter is pretty self-explanatory. We were actually shocked to see the way in which the Town Trustees were rubber stamping applications on June 24. The Trustees were about to do the same to Brown's Hills, without even looking at a map, making a site visit, or knowing that there is already a community stair owned and maintained by all residents of Brown's Hills---this on one of the tallest and steepest bluffs in the Town of Southold. We had thought that the Trustees' job was to protect Southold's natural assets. In this case, The Trustees could only have been protecting the maximum developer's profit. We felt that you should be contacted about this, and that some of us may stop by your open office hours at 6pm on July 21, before the next Town Trustees meeting when this application will be on the agenda. We obtained a title policy which discloses the covenants and restrictions attached, none of which restricts the construction of the proposed stairs to the beach or requires any association approval of such construction. Brown's Hills Estates, Inc. is listed on the tax records as the owner of the roads in the Brown's Hills subdivision, and appears to be a voluntary association with no requirement of membership or dues recorded against the title to our client's property. There is no public address filed with the New York Secretary of State. During exhaustive hearings before the Zoning Board of Appeals earlier this year, at which many of the neighbors appeared, no one purporting to represent a homeowners' association appeared. With respect to the suggestion that our client use the existing steps to the beach ostensibly owned by the association,this proposed solution is inappropriate for the following reasons: 1. It ignores the private property rights of our client. So long as your concerns as to bluff stability and safety are addressed, our client should be permitted to use its own property for access. • • Board of Town Trustees -2- July 21, 2004 2. It ignores the riparian rights of our client, which provides access to the water and rights to use the water. Without the beach steps, our client cannot access the water over its own property. 3. The continued viability of the beach steps of a loosely organized association of property owners is highly questionable and unreliable. There is no guarantee that the steps will be maintained or even that they will continue in existence, as the membership and finances of the association change, or on what conditions lot owners will be permitted to use the steps, as there is no formal recorded agreement which is binding upon the lot owners. 4. Issues of negligence abound. 5. A private property owner has a vested interest in protecting his property and bluff, and is more likely to maintain the steps and the bluff effectively. Moreover, the safeguards imposed by your Board and other regulatory agencies will govern construction and use of these steps. 6. The existence of community steps does not, in any event,pre-empt private steps. Permits to install beach stairs are generally approved under similar circumstances and we ask that you allow my client to "enjoy"his property by granting the permit. Dear Members of the Board of Town Trustees: We residents of Brown's Hills are disappointed,angered,and frankly shocked that the Trustees of the Town of Southold at its Hearing on June 24,who are entrusted with the protection of the physical environment in coastal and wetland areas,very nearly approved the construction of an additional stair to the Brown's Hills beach,on the above\-mention property The vacant lot which was owned by Edna Doll is being developed by a speculative house builder named John Hurtado. We are especially annoyed that,according to the four residents and members of the Brown's Hills Association who attended the Hearing,it was abundantly clear that this application(#18 on the Agenda)would also have received a rubber stamp approval,as had several cases already presented by a totally unprepared and ill-informed"expeditor" from Land Use Ecological Services. Almost no facts were presented regarding the Doll Property itself,nor about the Brown's Hills neighborhood(a private subdivision which owns and maintains its own roads and communal beach stair,access to all residents),nor even was it mentioned that the Brown's Hills stair already exists 200 feet to the west of this new proposed stair. Since the Trustees had not visited the site,and no plans were presented at the meeting,The Trustees had no idea that proposed stair would run down one of the tallest and steepest bluffs on the North Fork,already prone to erosion. A previous Brown's Hills stair was abandoned and relocated just 15 years ago due to bluff erosion. The only information provided the Trustees were comments made by one Trustee,Artie Foster. The four Brown's Hills residents heard Mr.Foster recommend that the platform be reduced slightly in size,that Mr. Foster had "dug the test hole",and that the stairs were"OK" and should be approved. As far as tl*four Brown's Hills residents could tell,this was the only information provided to the Town Trustees. We residents of Brown's Hills vehemently oppose the construction of this stair for the following critical reasons: 1)UNNECESSARY AND REDUNDANT: Brown's Hills already has a stair available to the future owner/ resident of this house,whoever that might be. Another stair is totally unnecessary for beach access,particularly for this property located scarcely 200 feet from the existing community-owned Brown's Hills stair. None of the eight Brown's Hills properties bordering Long Island Sound has private stairs. All Brown's Hills owners have been satisfied to use the communal stairs. 2) ENVIRONMENTAL DAMAGE The proposed stair would be constructed on one of the tallest and steepest bluff faces on the North Fork,in this case a change in elevation from 90 feet above sea level to 8 feet,a vertical change of 80 feet vertically over a horizontal dimension of 125-135 feet. The Sound bluff regularly shows signs of erosion,which would inevitably increase with any sort of disturbance on its face to the soil or plant material. 3.NO HOMEOWNER Since there is no house or purchaser yet,it is impossible to know if the ultimate homeowner would want to own and maintain private beach stairs. The sole purpose of this stair is to increase the sales price and developer's profit,at the expense of the bluff s natural beauty,while potentially causing environmental damage. 4. CONSTRUCTION WITHOUT PERMISSION Since the Hearing on June 24,materials for the stair construction have been delivered to the Site. At the Hearing,the four Brown's Hills residents heard the • Town Trustees approve,"ex post facto",several applications for stairs, bulkheads,and docks. Dale, is aiding me and has enlisted the services of the 21 st Century Realty Co. of Greenport. As yet, my buyer has not received the Environmental Permission Certificate. It grieves me to ask your help in expediting this matter, but it is indeed a hardship case. It wounds my sense of dignity and self-identification when I feel impelled to ask your indulgence, but truly, I am in dire need.
