No. 5901 — LEONARDO PAROLI Property Location: 525 Orchard Street, Orient CTM 25-2-20.11 PROPERTY FACTS/DESCRIPTION: The applicant's property contains 24,067 square feet with 69.50 feet along the north side of Orchard Street in Orient. The property is improved with a single-family dwelling, new accessory swimming pool, accessory garage, and a new "unheated accessory storage structure" under construction as per Building Permit No. 30770-Z dated 11/15/2004 with an expiration date noted as May 15, 2006. BASIS OF APPLICATION: Building Inspector's March 27, 2006 Notice of Disapproval concerning an as-built accessory building (pool house accessory use), and citing Section 100-31A(1). The reason stated for disapproval is that the as-built construction constitutes a second dwelling use. The original building permit was issued November 15, 2004 for an unheated accessory storage structure (BP #30770), and the applicant requests an amendment for an as-built elaborate dwelling arrangement with kitchen area, bathroom heat and other living space amenities. VARIANCE RELIEF REQUESTED: The applicant is requesting approval of a luxury pool-house with living space and facilities similar to those used in a single-family dwelling, and bathroom (toilet, sink, shower), heat, rather than designed as an accessory building for storage and non-habitable purposes. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on June 22, 2006, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: RELIEF REQUESTED: The applicant recently constructed an 18 ft. by 40 ft., one and one-half story building. The applicant is requesting variances to permit a heated luxury building, designed and as-built as an elaborate dwelling, with complete plumbing and heating facilities similar to those found in a primary single-family dwelling. Grant of the relief requested will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The Zoning code limits a parcel to not more than one dwelling on a parcel. This as-built construction contains dwelling utilities, heating system, living space, bathroom, full shower, sauna, and amenities other than that permitted in the zoning code for an accessory building, such as a storage shed, garage or similar permitted non-habitable use. Inclusion of a kitchen area, full bath, and construction of heating and air-conditioning systems would render it a second principal dwelling on a single lot. 2. The benefit sought by the applicant can be achieved by some method, feasible for the applicants to pursue, other than an area variance. A plan may be designed to add living areas attached to the dwelling as the primary or principal use on the property as an alternative. 3. The relief requested is substantial. The new construction is not designed as a seasonal building. 4. The difficulty has been self-created. The living area with utilities were added after issuance of the building permit obtained for an unheated accessory shed building. 5. Impacts will be created on physical and environmental conditions in the neighborhood. The property is substandard with only 24,067 sq. ft. of land area, and the code limits properties to only one dwelling per 80,000 sq. ft. lot in this Zone District. Such use will fall outside the limits of what is necessary for preserving and protecting the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Simon, seconded by Member Dinizio, and duly carried, to DENY the variance, as applied for, and the building shall be brought into compliance with the codes as required by the Building Inspector.
