SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under
consideration in this application and determines that this review falls under the Type II category of
the State's List of Actions, without an adverse effect on the environment if the project is implemented
as planned.
PROPERTY FACTS/DESCRIPTION: The applicant's 2,229 sq. ft. parcel is 75.86 ft. wide by 30 feet
deep, situated along the west side of Bay Avenue (a private road) in East Marion. The property is
improved with a single-family, one-story dwelling having 30.04 ft. frontage along Orient Harbor, and
improved with wood bulkheads, as surveyed October 22, 2002, and shown on the amended survey
map dated January 20, 2004, prepared by J.ohn C. Ehlers. The applicant has an open building
permit for renovations to the existing dwelling at this time.
BASIS OF APPLICATION; Building Department's April 28, 2004 Notice of Disapproval, citing
Sections 100-239.4B, 100-242A, and 100-244B, in its denial of a building permit for a deck addition.
The reasons for the denial are that although the applicant proposes to construct a wood deck in
place of where one already existed, the deck was removed without a permit and is no longer on the
property. Therefore, the existing single-family dwelling has a front yard setback of 1.5 feet, a rear
yard setback of 5.3 feet and total lot coverage at 36 percent (original deck size was 1090 sq. ft.).
Also, following the proposed construction of the addition, the dwelling will have a front yard setback
of zero (0) feet, a rear yard setback of 1.5 feet, total lot coverage at 76 percent, and setback of 10
feet from the bulkhead. The denial cites the code required minimum front yard of 35 feet, minimum
rear yard of 35 feet, minimum bulkhead setback of 75 feet, and code limitation of 20 percent for
coverage of the lot by building area.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on August 19, 2004 at which
time written and oral evidence were presented. Based upon all testimony, documentation, personal
inspection of the property, and other evidence, the Zoning Board finds the following facts to be true
and relevant:
AREA VARIANCE RELIEF REQUESTED: The applicants wish to reconstruct the former 1090+- sq.
ft. deck, shown on a diagram prepared by B. Laing Associates, Inc. with NYS DEC Permit #4738-
00849, and shown on survey maps dated 1-13-03 and 3-3-2003, prepared by John C. Ehlers. The
deck was removed, as indicated on the 1-20-2004 updated survey prepared by John C. Ehlers.

ADDITIONAL INFORMATION: During the June 22, 2004 public hearing, the applicant's attorney
testified that the deck was necessary for the integrity of the building and gabions, and was requested
to obtain an engineer's certification certifying how and why this was necessary, and why no
alternative was possible. In addition, the applicant's attorney was requested to furnish surveyor
calculations of lot coverage percentages, with square footages of the existing and proposed
construction areas, and an alternative diagram which would show a reduced size of the deck area,
resulting in less coverage of the lot by building area. On July 15, 2004, the applicant submitted a
revised survey, amended 7/13/04 by John C. Ehlers, proposing a total 88% lot coverage (41%, or
941 sq. ft. for the house, and 47%, or 1090 sq. ft. lot coverage.) The applicant's attorney also
furnished letters from their marine contractor with recommendations concerning the protection of fill
at a level near the top of the bulkhead and related information. On August 25, 2004, the applicant
submitted a letter from their engineer indicating the purposes of the new deck, relative to the
preservation of the exterior of the structure and protecting the bulkhead gabions, and on August 26,
2004, the applicant's attorney was notified that the letter was not acceptable, and requested a
certified engineer's report explaining how this requested deck was absolutely necessary to the
integrity of the building, and why an alternative size or alternative design is not possible.
ADDITIONAL INFORMATION/AMENDED RELIEF: On September 2, 2004, the applicant submitted
a further amendment with an alternative diagram, eliminating 325 sq. ft. from his request for 905 sq.
ft. of deck, resulting in 580 sq. ft. of deck (or 25.23% of the lot size), plus 6' x 6' step/land area and 6'
wide steps for access purposes. This alternative diagram did not allow for any increase from the
original plan for setback allowances.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and
personal inspections, the Board makes the following findings:
1. Grant of alternative relief will not produce an undesirable change in the character of the
neighborhood or a detriment to nearby properties. The alternative size water-side deck, reduced
from 15' to 10', plus deck at the west side of the dwelling, front 6'x6' step with landing, and 6'x5'
deck step area, provides for reconstruction of a substantial portion of the deck and step areas that
were removed. The finished floor of the new structure is at 9 ft. elevation, which is almost 4 ft.
higher than the existing grade. There are doors on both the east and west sides of the home, for
access to the deck areas. The alternative size deck will not create an undesirable change in the
neighborhood since it is compatible with similar deck designs in the area. The alternative relief will
also provide a minimum 3 ft. setback from each side and a minimum 5 ft. setback to the bulkhead,
as opposed to applicant's original request for almost no setback allowance.
2. The benefit sought by the applicant cannot be achieved by some method, feasible for the
applicant to pursue, other than an area variance. This is the smallest lot in the immediate area.
Without variances, an open 580 sq. ft. deck addition would not be possible.

3. The alternative relief granted is substantial. The code requires a 10ft. minimum side yard and
total 25 feet for both side yards, and the new 10+- ft. x 24+- ft. construction results in a 7 ft. single
side yard reduction, 19+- ft. total side yard reduction, bulkhead setback reduction for the new
construction, all with lot coverage in excess of the existing 41% (dwelling).
4. The difficulty was self-created, and is related to removal of the former deck, the small size of the
property, required flood elevation of the dwelling, for entrances into the building, and a deck for the
family's use which does not conform to code requirements.
5. No evidence has been submitted to suggest that a variance in this residential community will
have an adverse impact on the physical or environmental conditions in the neighborhood. The
applicant is required to provide drywells and gutters to contain roof run off, as conditioned by a
wetlands permit was obtained from the Town Trustees dated February 26, 2003, and wetlands
permit, with conditions, issued March 15, 2004 from the NYS Department of Environmental
Conservation.
6. Grant of altemative relief is the minimum action necessary and adequate to enable the applicant
to enjoy the benefit of a new deck addition, while preserving and protecting the character of the
neighborhood and the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing
test under New York Town Law 267-B, motion was offered by Member Goehringer, seconded by
Member Dinizio, and duly carried, to
DENY the variances as applied for, and to
GRANT altemative relief as noted below:
1. The southerly deck shall be reduced to 10' x 24' to provide for set backs at least three (3)
feet from the front (easterly) lot line, at least five feet from the southerly (side) bulkhead;
2. The proposed 22 lin ft. deck on the west side of the dwelling shall be reduced to provide
at least 3 feet from the westerly property line (a small step area may be allowed for
access to the dwelling).
3. The 6' x 6' stairs with landing as a front entrance shall be permitted, as proposed and
noted by applicant on the alternative diagram with a September 2, 2004 ZBA date stamp,

Re: Alterations to the Viii anti Residence
The purpose of this letter is to affirm that the changes to the structure
supporting the house: adding 16 concrete filled sonotubes to the six
helical screws previously installed, and substituting 9 x 12 wood beams
for the steel beams shown in drawings, provide a platform with more than
adequate support.
We are enclosing the letters of completion and certification from Costello
Marina Contracting Corporation, for the structure above indicated.
I also verified that the installation of windows strapping and tie-downs in
the existing roof structure are complying with the requirements fo the NYS
Building Codes.

d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Suoh a permit
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Ocoupancy.
f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the
property have been enaoted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Thereafter, a new permit shall be required.

Dear Mr. ViIlanti:
As you are aware, we have completed the installation of the 6 Helical Screw Piling and 16
additional concrete filled sonotubes at your bay side cottage in order to properly suppon the
bearing walls.
The 6 helical screws were installed starting in the southeast comer and continuing in a
clockwise direction as follows:

#2 was installed to a torque of 1,760 Nibs. - 8.80 tons of capacity
#3 was installed to a torque of 1,900 Mbs. - 9.50 tons of capacity
#4 was installed to a torque of 2,100 NIbs. .- 10.50 tons of capacity
#5 was installed to a torque of2,700 ftIIbs. - 13.50 tons of capacity
#6 was installed to a torque of 1,850 Mbs. - 9.25 tons of capacity
To determine the bearing capacity, you must multiply the Mbs. by 10. The total capacity of
the helical screws installed is 61 tons (122,000 lbs.).
The sixteen additional sonotubes were installed to reduce any possible deflection of the
wooden timbers and add additional capacity. The 8-inch sonotubes were dug in a minimum
of 4' below the existing grade, placed on a concrete footing and filled with concrete. All
sonotubes were placed at a depth that was greater than the previously existing locust posts
The new foundation is a complete replacement of the locust post foundation that had
previously existed.
