Dear Mr. Mohr:
The following resolution was adopted at a meeting of the Southold Town Planning
Board on Monday, February 9, 2004:
The final public hearing was closed.
WHEREAS, the proposed site plan, to be known as Chris Mohr Landscaping, is for two
new one-story buildings of 3,192 sq. ft. total on a 0.907 acre parcel in the LI Zoning
District; and
WHEREAS, Christopher Mohr is the owner of the property known and designated as
22155 County Road 48, located on the north side of CR 48, 700' west of Cox's Lane, in
Cutchogue, SCTM#1000-96-1-20.1; and
WHEREAS, on May 31,2002, a formal application for approval of this site plan was
submitted; and
WHEREAS, on November 12, 2002, a common driveway declaration was executed for
access to County Road 48 over an adjacent parcel to the west, known as SCTM#1000-
96-1-19.1; and
WHEREAS, on January 14, 2003, the Southold Town Planning BOard, acting under the
State Environmental Quality Review Act (6 NYCRR), Part 617.5, made a determination
that the proposed action is a Type II and not subject to review; and
WHEREAS, on May 22, 2003, the Cutchogue Fire District indicated no fire well is
needed and the Planning Board has accepted this recommendation; and

WHEREAS, on June 3, 2003, the Town Board voted on Resolution Number 354 known
as Local Law 11,2003, a Local Law in relation to a Four Month Temporary Moratorium;
and
WHEREAS, on July 10, 2003, the Suffolk County Department of Public Works approved
a permit ~48-171 for highway improvements; and
WHEREAS, on July 18, 2003, the Suffolk County Department of Health Services
approved a permit #C10-03-005; and
WHEREAS, on August 8, 2003, the Southold Town Engineer reviewed and approved
the proposed drainage and the Planning Board has accepted his recommendation for
approval; and
WHEREAS, on January 29, 2004, the Architectural Review Committee reviewed and
approved the site plan and the Planning Board has accepted their recommendation; and
WHEREAS, on January 30, 2004, the Southold Town Building Inspector reviewed and
certified the site plan; and
WHEREAS, the Southold Town Planning Board, pursuant to Chapt¢t: 58, Notice of
Public Hearing, has received affidavits that the applicant has complied with the
notification provisions; and
WHEREAS, all the requirements of the Site Plan Regulations of the Town of Southold
have been met; be it therefore
RESOLVED that the Southold Town Planning Board grant final approval on the site plan
prepared and certified by Garret A. Strang, Architect, dated March 22, 2002 and last
revised July 17, 2003, and authorize the Chairperson to endorse the final site plans with
the following condition and subject to a one year review from the date of the building
permit:
1) All outdoor lighting shall be shielded so that the light source is not visible from
adjacent properties and roadways. Lighting fixtures shall focus and direct the light in
such a manner as to contain the light and glare within property boundaries. The lighting
must meet the Town Code requirements.
Enclosed please find two copies of the approved site plan; one for your records, and
one to be submitted to the Building Department when you apply for your Building
Permit. Please contact this office if you have any questions regarding the above.

Site Plan Applications
Public Hearings
Under the current site Plan application procedure, the process for
reviewing a site plan application is: a public hearing is not scheduled and
held by the Planning Board until after, among other things, the site plan
has received a stamped Health Department approval.
The applicant shall now have the following options:
1. To follow the established procedure, or
To have the Planning Board schedule and hold a public hearing on
the site plan application and have the Planning Board vote on the
proposed conditional site plan prior to the applicant receiving
Health Departm, ent approval subject to the following conditions:

differs in any way from the proposed conditional site
plan on which the Planning Board held a public hearing and
voted on, then the Planning Board has the right and option, if

It was noted that the applicant will use groundlighting for the sign and will recess

CUTCHOGUE HARBOR MARINA (3350 West Creek Avenue - Cutchogue) In
a PRE-SUBMISSION discussion, Mr~Semon described an as-built application for
the marina. The Committee requested that photographs be obtained for each
elevation of the several buildings and that the usual reviews be made for buildings
without certificates of occupancy and for new construction and alterations.

NATURAL LANDSCAPE ACCENTS (North Road - Peconic)
The Committee noted that the roof pitch had been raised to 6 in 1 2 and that the
applicant preferred to remain with a hip roof on the perch. It was then

APPLICATION with the CONDITIONS that the width of the hip roof on the porch
be reduced to a point halfway between the windows and each corner of the

County, New York, on the 2na day of December 2003 a Local Law entitled "A Local Law in
relation to Permitted Uses in the Light Industrial District ' now, therefore, and

Local Law at which time all interested persons were given an opportunity to be heard, now
therefor be it
RESOLVED that the Town Board of the Town of Southold hereby enacts the following Local
Law:
LOCAL LAW NO. 4 2004
A Local Law entitled "A Local Law in relation to Permitted Uses in the Light Industrial District"
BE IT ENACTED by the Town Board of the Town of Southold, as follows:
I. purpose The stated purpose of the Light Industrial (LI) District is to provide an opportunity
for business and industrial uses on smaller lots than would be appropriate for the LIO Light
Industrial Park/Planned Office Park District. This amendment allows con~xactors that are not
otherwise prohibited, to locate a business or yard in the LI district. This amendment is consistent
with the purpose of the Light Industrial (LI) District.
II. Chapter 100 of the Code of the Town of Southold is hereby amended as follows:
§ 100-141. Use regulations.
In the LI District, no building or premises shall be used and no building or part of a building
shall be erected or altered which is arranged, intended or designed to be used, in whole or in part,
for any purpose except the following:
A. Permitted uses. The following uses are permitted uses and, except for those uses
permitted under Subsection A(1) and Subsection A(2) hereof, are subject to site plan approval by
the Planning Board:
(4) Contractors' businesses or yards, including but not limited to B-building, electrical,

III. Severability.
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid, the judgment shall not effect the validity of this law
as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.
IV. Effective date
This Local Law shall take effect immediately upon filing with the Secretary of State as provided
by law.

For reference we sent the original plan to the Building Department on May 1, 2003 and
the new revised site plan with landscape/SCHD stamp on October 28, 2003. We also
require that the sign be approved by the ARC.
As I explained the Planning Boards policy is the Building Department certification must
be complete before we set the Public Hearing Date.

COUNCILMAN WlCKHAM: NOTICE IS I-IEREBY GIVEN that the Town Board of the Town of
Southold hereby sets 5:20 p.m., July 29, 2003 at Southold Town Hall, 53095 Main Road, Southold,
New York, for a public heating on the application requesting a waiver from the provisions of the Local
Law entitled "A Local Law in Relation to a Temporary moratorium on the Issuance of Approvals
and/or P~mdts for the Parcels of Property in the Light Industrial Park/Planned Office Park (LIO)
Zoning District and the Light Industrial (LI) Zoning District in 'The Church Lane Neighborhood
and Immediate Area Surrounding the Town Landfill/Transfer Station' ", for the property of
Christopher R. Mohr and Robert T. Mohr, located at 22155 County Road 48, Cutchogue, and identified
by SCTM # 1000-96-01-20.1.
The Planning Board has responded to the application and it begins in reference to the site plan-the
Planning Board is referring to the site plan application that Mr. Mohr has made for this property. In
reference to the site plan application and the request for recommendation and findings. "This is to
inform you that the Planning Board has reviewed this application at its work session on July 7. After
review of the file, the following itemizes what has occurred with this application so far." And there are
a listing of about ½ a dozen items. "The site was cleared in violation of Town Code-section ..... ; it
received three copies of a preliminary site plan for a pre-submission; the application received a
completed site plan application and payment of $452 in fees; it received a common driveway
agreement; it received one revised site plan for the work session. The Planning Board resolved and
determined that this project is a Type 1I action and not subject to the SEQRA review. Earlier this year,

it received 8 copies of a revised final site plan for review and scheduled an ARC review (that is the
Architectural Review Committee), in April it received a signed detail for review; in May sent a request
to the Cutchogne Fire Department for approval; requested building inspector for certification; sent a
site plan and request to the Town Engineer for approval; in May received the Fire Department's
approval and that no well is required; in June notified the applicant that in effect the application is on
hold due to the moratorium and later in May received one set of construction plans for the
Architectural Review Committee's final review. The concern of the Planning Board is the site plan
does not satisfy the landscaping required per Town Code. The applicant's representative was informed
that the site plan will need to be fine-tuned and additional screening will be required. At this time, we
still need the following for a final approval of the site plan: 1) revised site plans with landscaping; 2)
Building Depathnent certification; 3) Town Engineering approval; 4) Suffolk County Health
Depadment approval; 5) Department of Public Works approval for use of existing driveway with
agreement and 6) the moratorium must expire or a waiver must be gotten. It is not known if the
proposed use of structures meet with the code. It is strongly recommended that the Building
Department be consulted as to whether there are other outstanding issues. We hope that this
information helps in the review of the waiver request." Those are the only written responses that we
have to the Mohr's request for a waiver on the moratorium in the Church Lane area.
SUPERVISOR HORTON: We open the floor to the public on this public hearing. Yes, Mrs. Egan.
JOAN EGAN: I may be wrong but I thought that either at the last meeting of the one before that you
were going to have a new survey done in that area. Are you going to spend another $10,000 or
$12,000 as far as the Church Lane thing? Is that so? Has that survey been completed?
SUPERVISOR HORTON: That is actually in progress as we speak.
MS. EGAN: What do you mean by that?
SUPERVISOR HORTON: That it is actively being worked on.
MS. EGAN: So how can you vote on something if the survey has not been completed?
SUPERVISOR HORTON: This is a public hearing for a request for a waiver from that moratorium
that effects that parcel.
MS. EGAN: So what does that mean? I don't quite understand.
SUPERVISOR HORTON: This is a legal ....
MS. EGAN: You are having a survey done, so why did you even bother doing this until the survey was
completed?
SUPERVISOR HORTON: We have a legal obligation under the moratorium law to have a public
heating if a grant request does come forward.

MS. EGAN: So if you granted, then what happens if the survey says that it shouldn't be done? I
mean, aren't you going to be contradicting yourself and getting yourself into worse trouble than you
are already in?
SUPERVISOR HORTON: If in fact that was the case.
COUNCILMAN ROMANELLI: Actually, all we are .....
MS. EGAN: Uh, uh, uh, uh, uh, uh.
SUPERVISOR HORTON: Feel free.
MS. EGAN: You can tell Mr. Horton.
SUPERVISOR HORTON: No, Mrs. Egan, I will allow him to answer the question.
MS. EGAN: Alright.
COUNCILMAN ROMANELLI: Actually, all we are doing here is, if it is passed, that we are granting
a waiver for this parcel to get out of the moratorium and move forward in the process. We are not
granting permission for this structure to be built, we are just saying that if we waive it, they can
continue through the process. In the end, it still may not get final approval from the Planning Board,
Building Department, Health Department and all agencies that Tom listed. Ail we are saying is, we
will grant the relief, if we pass it, to be free from the moratorium structure and continue on through the
process.
MS. EGAN: So what you are saying is that they can go ahead and do things? Is that what it is?
COUNCILMAN ROMANELLI: They still have ways to go. We are not granting final approval on
their plan. We are granting them the continuation of going through the process of site plan.
MS. EGAN: I think that after all of the meetings that we have had up here, the press, the Newsday and
all of that, that you are going ahead with this, I think that this is one, as far as I have been coming to
meetings the last couple .... I think that this is absolutely disgraceful. I think that you have one beck of
a nerve to go against these people like this...
SUPERVISOR HORTON: Mrs. Egan.
MS. EGAN: Now, let me tell you, god will get you for it. I will be back.
SUPERVISOR HORTON: Are there other comments from the floor? Yes, Ms. Toll.
KATHY TOLL: I am still Kathy Toll and I am still from Greenport. I would urge the Board not to
grant waivers at this time, if it is granted for this parcel there is no reason that every other parcel and
every other application wouldn't go forward. There is a limited number of parcels over there. There is
a limit of time that things have to wait and I would be rather surprised if that short period of wait
would have a profound effect on the Molar's business. I would urge you to vote no.

drainage calculations and design provided on the site plan meets the minimum requirements of the

The landscaped area immediately adjacent to Route 48 should be graded in a manner that
that will contain ail runoff on-site. This will prevent any negative impacts to adjacent properties from
surface water that will be generated on site and prevent the need for additional drainage in this area.

The attached plan, when duly signed by a representative of the department, in conjunction with these
conditions, constitutes a permit to construct a water supply and/or a sewage disposal or collection
system for thc property as depicted. The applicant should take note of any conditions of approval, which
may be indicated on thc plan or enclosed herein. Construction must conform with applicable standards
including "Standards for Approval of Plans and Construction for Sewage Disposal Systems for
Other than Single Family Residences." Omissions, inconsistencies or lack of detail on thc plan do not
release the applicant fi.om the responsibility of having the construction done in conformance with
applicable standards. Issuance of this permit shall in no way relieve the design professional of
responsibility for the adequacy of the complete design.
The permit (plan) expires three (3) years after the approval date. Any modification which may affect the
proposed sewage disposal or water supply systems requires submission of a revised plan and additional
fees (if applicable) for reapproval prior to construction. No inspections will be performed by the
department on expired permits.
Permits may be renewed, extended, transferred, or revised in accordance with the procedures described
in Instructions to Renew, Extend, or Transfer an' Existing Permit for Other than Single Family
Residences (Form WWM-018).
It is the applicant's responsibility to call the department in advance to arrange inspections of the sewage
disposal and/or water supply facilities prior to backfilling. These include inspections of the sewage
collection and disposal systems, water supply system components and piping, and final grading as
shown on the approved plans. In certain cases, inspections of the soil excavation may be required to
determine the acceptability of the soils for sewage disposal systems. The depattlnent must be notified at
least 48 hours in advance to schedule an inspection by calling 852-2097; and excavation inspections
must also be confirmed by calling 852-2100prior to 9:30am, the morning of the inspection.
Final approval issued by the Department is necessary prior to the occupancy of new buildings,
additions to existing buildings, or for the use of sewage disposal or water supply systems.

In reference to the site plan application and your request for recommendations
and findings on the project listed above, this is to inform you that the Planning
Board (PB) reviewed its application at the work session on July 7, 2003.
After review of the file the following itemizes what has occurred with this
application.
02/22/02 The site was cleared in violation to Town Code section 100-259 (Land
Clearing)
03/22/02 Received 3 copies of a preliminary site plan for a pre submission.
05/31/02 Received a completed site plan application and payment of $452.85
11/12/02 Received the common driveway agreement.
01/03/03 Received one revised site plan for the work session.
01/13/03 PB resolved and determined this project to be a Type II action and not
subject to review per 6 NYCRR part 617.5.
04/28/03 Received 8 copies of revised final site plan for review and scheduled
ARC review. This site plan was distributed to agencies and departments for
approvals.
04/28/03 Received a sign detail for review.
05/01/03 Sent a request to Cutchogue Fire Department for approval.
05/01/03 Sent a site plan and request to Building Inspector for certification.
05/01/03 Sent a site plan and request to Town Engineer for approval.
05/27/03 Received the Fire Department approval, no well is needed.
06/11/03 Notified applicant that LL11/2003 is in affect and application is on hold.
06/19/03 Received one set of construction plans for Architect Review Committee
final review.
The concern of the PB is the site plan does not satisfy the landscaping required
per Town Code. The applicant's representative was informed that the site plan
will need to be fine-tuned and additional screening will be required. At this time
we still need the following for final approval of the site plan:
1. Revised site plans with landscape screening.
2. Building Department Certification
3. Town Engineer Approval
4. Suffolk County Health Department Approval
5. Department of Public Works approval for use of existing driveway with
agreement.
6. Moratorium LL11/2003 to expire or a waiver from Moratorium law.
It is not know if the proposed use and structures meet with the Town Code. It is
strongly recommended that the Building Department be consulted as to whether
there are other outstanding issues.

WHEREAS, there was been presented to the Town Board of the Town of Southold, Suffolk
County, New York, on the 3rd day of June 2003 a Local Law entitled entitled "A Local Law in
relation to a Temporary moratorium on the issuance of approvals and/or permits for the
parcels of property in the Light Industrial Park/Planned Office Park (LIt) zoning district
and the Light Industrial {LI) zoning district in "The Church Lane Neighborhood and
immediate area surrounding the Town Landfill/Transfer Station"; and
WHEREAS a public hearing on the aforesaid Local Law was held on the 3rd day of June 2003
at which time all interested persons were given the opportunity to be heard thereon, now,
therefore be it
RESOLVED that the Town Board of the Town of Southold hereby ENACTS the following
Local Law:
LOCAL LAW NO. 11 2003
A Local Law entitled, "A Local Law in relation to a Temporary moratorium on the issuance
of approvals and/or permits for the parcels of proper .~ in the Light Industrial
Park/Planned Office Park (LIt) zoning district and the Light Industrial (L1) zoning
district in "The Church Lane Neighborhood and immediate area surrounding the Town
Landfill/Transfer Station"
BE IT ENACTED by the Town Board of the Town of Southold, as follows:
Section 1. Purpose
The Town Board recognizes that within the area bounded by Depot Lane, Oregon Road,
Cox Lane and Route 48 the presence of the Town Landfill (now the Town Transfer Station)
dominated (properly) the thought process behind the comprehensive planning of that area for
decades. One result was that all parcels of property within the described areas are currently
zoned either LIO or LI according to the Town Zoning Code.
The Town Board also recognizes that the foundational cornerstones governing the
comprehensive planning of that area in general may have been fundamentally altered with the
capping of the Town Landfill and the introduction of public water.
A small, long-standing residential neighborhood adjacent to the landfill/transfer station
has been threatened with drastic changes based on the current LI zoning district designation.
Based on the changed circumstances regarding the landfill/transfer station, as noted
above, the Town Board wishes to consider various alternatives to the LIO and LI zoning district
designation in the described area, enhancement projects in the Church Lane neighborhood and
the recommendations made in the draft report of the planning and environmental finn of
Nelson, Pope and Voorhis dated August 26, 2002. Given the reasons and facts set forth above
and until the planning process is completed the Town Board finds it necessary to impose a
moratorium as set forth below. An integrated and comprehensive study that takes into account
the capping of the Landfill, the presence of public water, and the long-standing residential
neighborhood in conjunction with the Town's overall comprehensive goals is needed. This
action is necessary in order to protect the character, public health, safety and welfare of the
residents of the Church Lane Neighborhood and Immediate Area Surrounding the Town
Landfill/Transfer Station
Section 2. ENACTMENT OF A TEMPORARY MORATORIUM
Until four (4) months from the effective date of this Local Law, after which this Local
Law shall lapse and be without further force and effect and subject to any other Local Law
adopted by the Town Board during the four (4) month period, no agency, board, board officer or
employee of the Town of Southold including but not limited to, the Town Board, the Zoning
Board of Appeals, the Trustees, the Planning Board, or the Building Inspector(s) issuing any
building permit pursuant to any provision of the Southold Town Code, shall issue, cause to be
issued or allow to be issued any approval, special exception, variance, site plan, building permit,
subdivision, or permit for any of the property uses listed within the following sections of the
following zoning districts of the Southold Town Code which are located in the Church Lane
Neighborhood and Immediate Area Surrounding the Town Landfill/Transfer: Sections 100-131
(A) (1) and 100-131 (A) (3-16) and 100-131 (B) and 100-131(C), all of which apply to the Light
Industrial Park/Planned Office Park (LIO) District of the Southold Town Code; and Sections
100-141(A) (1) and 100-141(A) (3-15) and 100-141(B); and 100-141(C), all of which apply to
the Light Industrial (LI) District of the Southold Town Code
Section 3. DEFINITION OF "THE CHURCH LANE NEIGHBORHOOD & IMMEDIATE
AREA SURROUNDING THE TOWN LANDFILL/TRANSFER STATION"
The Church Lane Neighborhood and Immediate Area Surrounding the Town
Landfill/Transfer Station is hereby defined as the area bounded by the following public roads:
County Route 48 on the South, Depot Lane on the West, Oregon Road on the North and Cox
Lane on the East.
Section 4. EXCLUSIONS
This Local Law shall not apply:
1) to any person or entity who/which has, prior to the effective date of this Local
Law, obtained all permits required for construction of a building on any
property located in the CHURCH LANE NEIGHBORHOOD including later
applications to repair or alter, but not enlarge, any such building otherwise
prohibited during the period of this temporary moratorium.
2) To any permit or application regarding a single family dwelling unit to be used
solely for residential purposes.
Section 5. AUTHORITY TO SUPERCEDE
To the extent and degree any provisions of this Local Law are construed as inconsistent
with the provisions of Town Law sections 264, 265,265-a, 267, 267-a, 267-b, 274-a, 274-b, and
276, this Local Law is intended pursuant to Municipal Home Rule Law sections 10(1)(ii)(d)(3)
and section 22 to supercede any said inconsistent authority.
Section 6. VARIANCE TO THIS MORATORIUM
Any person or entity suffering unnecessary hardship as that term is used and constzued in
Town Law section 267-b(2)(b), by reason of the enactment and continuance of this moratorium
may apply to the Zoning Board of Appeals (OR THE TOWN BOARD) for a variance excepting
the person's or entity's premises or a portion thereof from the temporary moratorium and
allowing issuance of a permit all in accordance with the provisions of this Southold Town Code
applicable to such use or construction.
Section 7. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by
any court of competent jurisdiction to be invalid, the judgment shall not impair or invalidate the
remainder of this Local Law.
Section 8. EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State.

REQUEST:
Applicants Chris Mohr/J.Schoenstein have proposed a landscape contractors yard in an
LI zone on a 39,524 sq. Ft. parcel adjacent to the Town landfill site in Cutchogue. The
proposed structure is 3,057 sq. ft,,in a Morton type building,Parking for 6 cars is
proposed. Water supply is via a private well. The structure will be set back 70 fi fi.om CR
48,and will have access from the rear for contractors equipment. A 20tt sideyard setback
on the easterly property line is provided. A landscaped area of 27% is proposed. Access
to the structure and contractor yard is provided thru a common driveway via an existing
curb cut on Rt. 48 across the property of the adjacant property owner, Mr. Junge. (Same
site as the proposed Nextel monopole).
REVIEW:
The site is situated on a flat, slightly elevated parcel between two active light industrial
uses,and is adjacant to the Town landfill. Within the last two month, the site was clear
cut of most vegitation and trees, apparently in anticipation of using the site for landscape
Materials and storage.

COMMON DRIVEWAY DECLARATION
THIS INDENTURE made this ~! day of ~OO~ ,2002, by Chris Mohr,

New York, hereinafter referred to collectively as the "Declarants".
WITNESSETH:
WHEREAS, Declarants are the owners of lands in the Town of Southold situate along the
northerly side of Route 48, Cutchogue said lands being bounded and described in Schedule A, and
B, said schedules being annexed hereto and made a part hereof.
WHEREAS, Declarants have agreed to create a common driveway for the purpose of
ingress and egress to the above-described parcels of the land and for the installation of utilities
and all other lawful purposes in favor of these parcels, so that where will be a common access to
serve both parcels; and
WHEREAS, Declarants desire to provide for such shared driveway access to and from
Colony Drive;
NOW, THEREFORE, be it declared as follows:
1. The lots described above shall have a common driveway access to and from Route 48
over that portion of land described in Schedule C, said schedule being annexed hereto and made a
pan hereof. Such driveway shall replace any existing driveways, now existing on the Mohr
property described in Schedule A annexed hereto. The new driveway shall be located upon the
Junge property along the property line contiguous to the Mohr property.
2. The usc of the premises described in Schedule C shall be subject to the following
restrictions:
a. The lot owners shall have the joint, equal, and mutual right to use the private roadway
described in Schedule C for the purpose of ingress and egress and placement of utilities.
b. The terms "lot owner" or "lot owners" as used in this Declaration, shall be deemed to
include any heirs, distributees, successors, or assigns of the particular lot owner or lot owners.
c. Each lot owner affected by this Declaration, does hereby authorize and accept, for the

lot owner and Ns/her heirs, distributees, successors, and assigns, all of the conditions, obligations,
restrictions, and provisions of this Declaration.
d. The word "maintenance", as used in this Declaration, shall be deemed to mean all costs
and expenses in connection with said private roadway, including the costs of sweeping,
resurfacing, regravelling, filling in of holes, and all those items necessary to make it convenient
and safe for the owners of the aforesaid lots to use the private roadway described in Schedule C.
e. After the initial installation of the driveway at the sole cost of Junge, or his successor
shall determine what maintenance or improvements shall be done on the road and the amount of
money to be expended therefor. The owners of the lots shall be responsible for equal portions of
maintenance.
f. All lot owners agree that the roadway shall always be maintained so as to be passable by
vehicles: both automobiles and tracks and this shall include prompt repair if any "potholes" or
similar defects in the road which cause the roadway to become substandard.
g. In the event either lot owner fail to pay their proportionate share of maintenance
expense within seven (7) days of notification of charges, such unpaid monies may be collected
from the other lot owner. In this event, the lot owner having duly paid both their proportionate
shares of expenses and those of the defaulting lot owner shall be deemed the contractor as defined
in the New York Lien Law. The lot owner who has not paid his/her proportionate share shall
subject his/her real property to the lines of the lot owner who has paid his/her share of
maintenance expense. The lot owner who has paid their proportionate share of expenses may also
commence an action against the defaulting lot owner, in a court of appropriate jurisdiction, in
order to recover the unpaid monies. In any action commenced against a defaulting lot owner,
there shall be a presumption that the maintenance work for which monies are owing was validly
authorized by the other lot owner and was competently performed by the contractor who did the
work. A defaulting lot owner shall be liable for all costs and expenses, including but not limited to
attorney's fees which are incurred by the other lot owner in recovering the defaulting lot owner's
unpaid share of expenses.
h. Notwithstanding anything to the contrary herein, each and every lot owner shall repair
at his/her sole cost and expense any damage done to the roadway by constraction traffic,
machinery, or other implements used in the construction of improvements on the particular lot
owner's land. Any failure to make or pay for such repair may be treated by the other lot owner as
a default in the payment of maintenance expense, in accordance with subparagraph (g) above.
3. It is further agreed that
a. the driveway shall be installed at the sole cost and expense of Junge or his successor in
the interest in the property;

b. the width of the driveway shall remain 12 feet and shall not be widened without the
written consent of Junge or his successor.
c. the driveway shall be in conformance with all requirements ofthe TownofSouthold
but not be paved or otherwise improved with any type of impervious surface;
d. the location of the driveway shall not be changed without the consent of both parties
or their respective successors.
4. This declaration is binding upon all grantees, heirs, distributees, successors, or assigns of
any portion of lands described in Schedule A and B above.
5. This Common Driveway Declaration may not be revoked, rescinded, extinguished,
modified or amended without the express written permission ora majority plus one of the
Southold Town Planning Board or its legal successor, except that the provisions hereof which
relate solely to the making or, repair or improvement decisions or the allocation of expenses
among lot owners may be revoked or modified without such Board's approval.
6. Mohr makes no claim to have, at any time, any right, title, or interest in any part of the
lands of Junge as set forth in Schedule A other than to the driveway created by this agreement in
the area defined in Schedule C.

REQUEST:
Applicants Chris Mohr/J.Schoenstein have proposed a landscape contractors yard in an
LI zone on a 39,524 sq. Ft. parcel adjacent to the Town landfill site in Cutchogue. The
proposed structure is 3,057 sq. tt, in a Morton type building. Parking for 6 cars is
proposed. Water supply is via a private well. The structure will be set back 70 tl fi.om CR
48,and will have access from the rear for contractor's equipment. A 20t~ side yard
setback on the easterly property line is provided. A landscaped area of 27% is proposed.
Access to the structure and contractor yard is provided thru a common driveway via an
existing curb cut/on Rt. 48 across the property of the adjacent property owner, Mr. Junge.
(Same site as tM proposed Nextel monopole).
REVIEW:
The site is a level parcel slightly higher in elevation than CR 48, and has been clear-cut in
anticipation of use as material storage and site preparation for the contractor's equipment.
(See Photos from Code Enforcement Officer). Most of the mature trees and underbrush
have been cut down, and work has stopped on the site pending site plan review. A
preliminary site plan has been submitted, however a much more detailed landscape plan
and planting schedule must be submitted to address the restoration issues.
An agreement with Mr. Junge regarding the common access driveway needs to be put
into writing and presented to the Planning Board.
RECOMMENDATION:
The Board must indicate the extent of landscaping and planting required to adequately
restore the dense growth removed fi.om the site. Access and lighting need further
clarification.
