WHEREAS, the applicant, Christopher Mohr, proposes a new 2,080 sq. ft. storage building on a .907 acre parcel in the LI Zone; and WHEREAS, Christopher Mohr is the owner of the property known as SCTM#1000-96-1- 20.1 and located on the n/s/o CR 48, 700' w/o Cox's Lane in Cutchogue; and WHEREAS, on February 10, 2004, a site plan application was approved by the Southold Town Planning Board; and WHEREAS, on August 13, 2004, an amended site plan application was submitted; and WHEREAS, on September 14, 2004, the Suffolk County Department of Public Works indicated that the permit number 48-171 was issued on July 10, 2003 for the site plan and the Planning Board has accepted the approval; and WHEREAS, on October 7, 2004, the Architectural Review Committee reviewed the architectural drawings and associated site plan materials and approved them with conditions; and the Planning Board has accepted the conditions; and WHEREAS, on October 25, 2004, the Cutchogue Fire District recommended no fire well is needed and the Planning Board has accepted this recommendation; and Chris Mohr Lawnt~are and Landscaping (8/04) - Pa.q - 12/14/0~. As you are aware, the Planning Board has reviewed various as-built site plans and discussed various staff reports at numerous work sessions in an effort to issue final site plan satisfaction. Most recently, the Planning Board is in receipt of the enclosed letter from Joseph Fischetti, P.E. dated October 26, 2007 which the Planning Board reviewed at the work session on Monday, October 29, 2007. This is to inform you that the site plan requirements have been satisfied and include the following items: · The Planning Board accepts the October 26, 2007 letter from Joseph Fischetti, P.E. certifying the installation of all necessary drainage for the existing 40.2' x 52.1' 1-story metal frame building located at the rear of the property. · The Planning Board does not acknowledge or approve any encroachment, permanent or temporary, onto neighboring properties or the Suffolk County right of way. · Dumpsters shall not block any approved parking spaces, building entrances, etc. · All existing ponds and waterfalls must meet Town Code and NYS Building Code and shall be subject to approval of the Southold Town Building Inspector. If necessary, the applicant agrees to meet all requirements of the Building Department and obtain all necessary approvals/permits. · The existing 10' gazebo must meet Town Code and NYS Building Code and shall be subject to approval of the Southold Town Building Inspector. All signs shall meet Southold Town Zoning Codes and shall be subject to approval of the Southold Town Building Inspector. · No change in landscaping is permitted as part of this satisfaction letter. REVIEW: The site is a level parcel slightly higher in elevation than CR 48, and has been clear-cut in anticipation of use as material storage and site preparation for the contractor's equipment. (See Photos from Code Enforcement Officer). Most of the mature trees and underbrush have been cut down, and work has stopped on the site pending site plan review. A preliminary site plan has been submitted, however a much more detailed landscape plan and planting schedule must be submitted to address the restoration issues. An agreement with Mr. Sunge regarding the common access driveway needs to be put into writing and presented to the Planning Board. PROPERTY FACTS/DESCRIPTION: The applicant's 39,524 sq. ft. parcel has 150 ft. along the north/west side of C.R. 48 in Cutchogue. The property is improved with buildings; (under construction), as shown on the 8-12-04 amended site plan prepared by Garrett A. Strang, R/./A. BASIS OF APPLICATION: Building Department's August 6, 2004 Notice of Disapproval, amended August 30, 2004, citing Section 100-142 (Bulk Schedule) in its denial of a building permit to construct an accessory building on a parcel containing a landscape contractor's yard. The reason for disapproval is that the code requires 70 ft. minimum rear yard and minimum 20 ft. side yard setbacks for new buildings in the Light Industrial Zone District. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on Octooer 21, 2004 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicants wish to construct a 40' by 52' accessory building at the western corner of the lot, adjacent to the boundary of the town landfill. The accessory building is proposed in the rear yard close to the properly line adjacent to the landfill. The benefit sought by the applicants cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The property is zoned Light industrial, and the only provision in the code that pertains to setbacks is under the principal building bulk schedule, requiring a minimum of 70 feet from the rear line and 20 feet minimum for a side line. There is no alternative rear yard location to place an accessory building and meeting the 70 ft. setback from the rear line. To move the building would obstruct other ingress/egress and parking areas, and may affect the on-site sanitary system location (which may not be covered by building area). 3. The variance granted herein is substantial. 4. The difficulty was not self-created. The Light Indv~trial setback provision of the zoning code does not list a separate schedule of setback requirem~ehts for accessory buildings although there are scheduled setbacks for other zone districts. 5. No evidence has been submitted to suggest that a variance in this industrial community will have an adverse impact on the physical or environmental conditions in the neighborhood. The property is adjacent to the landfill and to other industrially zoned properties. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicants to enjoy the benefit of an addition, while preserving and protecting the character of the neighborhood and the health, safety ana welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Tortora, seconded by Chairwoman Oliva, and duly carried, to DENY the variance as applied for, and to GRANT a variance with the following alternative setbacks: a) minimum 10 rt. setback trom the nor[n/west property line, b) minimum 10 ft. setback from the south/west property line. Two PE', members chose not to comment and will follow the decision from the ZBA. Two PB members stated they have no problem with the location of the proposed building. - The PB would like to point out that location of the proposed building would be within a fall zone of the cellular tower on the property to the west. The following uses are permitted as a special exception by the Board of Appeals as hereinafter provided and subject to site plan approval by the Planning Board: (1) Research, design or development laboratories, provided that any manufacturing shall be limited to prototypes and products for testing. (2) Laundry or dry-cleaning plants, subject to the following conditions: (a) All processes and storage shall be carded on within an enclosed building. (b) All fluids used in processing shall be recycled, and the overall facility shall be designed, located and operated to protect surface waters and the groundwater from pollution. (3) Light industrial uses, subject to the following conditions: (a) No such process or operation shall involve the handling, storage or discharge of explosives or permit upon the premises any vires or other type of infectious organisms identified with diseases of animals or hmans. No offensive noises, gases, fumes, smoke, odors, dust, effluent or vibrations shall emanate from such use and no waste products shall be discharged therefrom of a character to create a nuisance or to be injurious to health or to negatively impact groundwater. (c) Such processes shall involve the use of only oil, gas or electxicity for fuel. (4) Conference facilities, subject to the following conditions: (a) Where rooms are provided for conference attendees, said rooms are permitted as set forth and regulated by § 100-61B(4) of the Resort Residential (RR) District. (5) Public utility structures and uses. (6) Track or bus terminals (garages, parking facilities, loading docks, etc.) (7) Food processing and packaging plants, not including fish processing plants. No building or premises shall be used and no building or part thereof shall be erected or altered in the LI Light Industrial District unless the same conforms to the Bulk Schedule and Parking and Loading Schedules incorporated into this chapter by reference, with the same force and effect as if such regulations were set forth herein in full. There shall be an exception to Subsection A if the adjacent parcels are developed, in which ease the minimum fi.om yard setback shall be the average of the setbacks of the adjacent parcels. A project shall be divided into separate structures so that no single structure shall have more than sixty (60) linear feet of frontage on one (I) street.
