It was noted that the Trustees had met on the site. The Chairman read the letter which indicated that the buildings were behind the jurisdiction of the Trustees. It was discussed that the letter was not clear with regard to the site plan and which plan was referenced in the correspondence. Mr Joseph Fishetti, owner/developer was present. He agreed that the letter was not definitive and that the line ~hould be m~rked on the site plan so that the Board knows where the wetland line and line of jurisdiction is. He stated, however, that he would have to prepare a fQundation survey after the foundation has been constructed. Pagel and Youngman of this Department were pleased to m~et with you on August 11, 1987 regarding the subject site plan. Our field inspection reveals that fill has been graded onto Route 25, paritally covering guide posts in the area. These must be removed since they constitute a danger to errant vehicles. We will require installation of curbing and sidewalk along the property's Route 25 frontage. We note that the subject driveway is causing excess water to run onto Route 25. It is not our policy to accept drainage from a private development. For us to review the matter further, we will require three copies of detailed site plans including the following information: A. Location and dimensions of existing highway pavement, curb, sidewalk, median, median openings, guide rail, utilities, traffic signs, right-of-way lines and property lines. B. Existing and proposed buildings and appurtenances. C. Design features to be incorporated in proposed construction or reconstruction: 1. Width, pavement type and thickness of driveways. 2. Radii of driveway returns and other points of curvature. 3. Driveway grades or profile view of driveway. 4. Angle of driveways relative to the roadway center line. 5. Dimensions of roadside control islands and driveway medians. 6. Dimensions and alevations of curb and sidewalk relative to the edge of pavement. 7. Existing and proposed drainage features: 1. Size, type and grade of driveway culverts. 2. Highway drainage structures. 3. Direction of surplus water flow on applicant's property. E. Distance from each existing and proposed driveway on the site to: 1. The nearest side road in each direction if within 1000 feet. 2. The nearest driveway on adjacent properties. 3. Streets, roads, or driveways opposite the site. 4. Adjacent property lines. F. North directional arrow on each applicable sheet. Maintenance and Protection of Traffic plans and/or figures cited from Part 302 of the New York State Manual of Uniform Traffic Control Devices. We will recommend any necessary lane closing restrictions. To allow for snow and ice control along the jobsite by State forces, the contractor shall schedule his work in accordance with the following: No drums, cones, barricades and other traffic control equipment shall remain in a location where they will interfere with or be disturbed by a snow plowing operation. The work must be scheduled to afford the safe removal of such devices when necessary. Drainage frames, grates and covers shall not be adjusted in a travel lane unless the final pavement course is placed prior to the onset of snow and ice weather. Steel plates, etc. shall not protrude above the adjacent pavement. If any of these protrusions exist in a non-travel lane prior to a snow and ice condition, then temporary asphalt ramps must be placed so that for every one inch of rise, there is a six foot run of ramp. He Details of internal traffic circulation, parking, traffic control devices and any proposed additional pavement lanes or widening. For major projects involving such pavement work, the plan sheets must be standard 22 inch by 36 inch size and placed in the order specified on page 21-3 of the New York State Highway Design Manual. Oversize sheets with cluttered or illegible information are not acceptable in any case. Ail submissions must be prepared by a licensed professional engineer, architect or land surveyor. These must be sent to Mr. H. R. Thyberg, our Regional Permit Engineer, at the above address. Upon review of this material and resolution of any outstanding comments, the necessary Highway Work Permits will be issued. Box 1179 Main Road Southold, New York 11971 Dear Mr. Lessard: I had a pleasant conversation with an inspector in the build- ing department this date, regarding property I own on the Main Road in Mattituck. My property lies east of Bob Celic's pro- perty which he is in the process of altering. My problem is that I wind up some five feet in the hole since Mr. Celic has raised the grade. Assuming that all commitments will be met as to sodding, planting or whatever the slope to prevent flooding on my side, nevertheless the manner in which the alteration has been completed, and the resultant change in natural ground eleva- tion has resulted in an eyesore which may or may not be hazardous, as time will tell. I would assume that adequate protective measures will be employed to prevent vehicles going down the grade, since the occupants of the adjoining house have small children, and cer- tainly any chance of an accident should be averted prior to the issuance of any certificate of occupancy on the property. I am writing this as a matter of record, since I think a situa- tion has materialized that is not in the best interest of the community, and at the very least abridges my rights as an adja- cent owner. By this application, appellant requests permission to establish access to the proposed parking area which commences at a point at the northeast corner extending in an easterly direction (as shown by site plan of October 10, 1985). 7. Article XI, Section lO0-112(D) requires that no entrance or exit for any off-street parking area be located within fifty feet of any street intersection. 8. Although the state owns the property between'this parcel and the State Highway, which is shown to be approximately 70 feet north of the ingress/egress point, the access to the proposed parking area will be extending at a point extending southerly from the highway's blacktopped shoulder approximately 55 feet to the northeast corner of these premises. 9. It is the opinion of the board that the point of access under consideration to the parking area is the same area presently used for parking and would not be a direct change. In fact it is the intention of the applicant to eliminate "backing out" onto Marlene Lane by creating this entrance/exit access point. 10. It is also noted for the record that a conditional setback variance under the requirements of Article VII, Section lO0-71 was granted on February 14, 1985 under Appeal No. 3311. In considering this application, the board has determined: (a) the relief requested is not substntial; (b) there will be no substantial change in the character of this district; (c) the relief as granted will not cause a substantial effect or detriment to adjoining properties; (d) the circumstances of this appeal are unique; (e) the interests of justice will be served by allowing the relief as requested; (f) the relief requested is within the spirit and intent of the zoning regula- tions. With reference to your letter dated February 6, 1985 which recommends the narrowing of the proposed addition as well as connecting the two parking areas, I believe that the new sketch plan and the attached Southold Boa~dof Appeals approval dated February 27, 1985 will help remedy any concerns the board may have with these issues. The major problem I have with the recommended sketch plan as outlined by your board is the total elimination of our present parking spaces. Upon examination of the board's sketch a proposed buffer area projecting into Marlene Lane is recommended. As you know, the town owns this road and I can not legally improve or otherwise alter land that I do not own. In order to more clearly understand what I propose and to arrive at a satisfactory s~te plan which you and the board require, the following observations and comments may help compromise this situation: 1) I have checked with the Southold Town Police regarding past traffic accidents at this site - they have not had a single accident report in over 25 years. 2) Marlene Lane is an established area and any appreciable traffic flow increase appears remote. Traveling motorists are aware of this building and the cars which "project" out into Marlene Lane from the hair dresser (southern) portion of my building. High speed travel is uncommon due to site's nearness to Route 25. 3) Numerous clients of the hair dresser tenant are elderly and disabled with no capacity for walking long distances. They are therefore either "dropped" off as close to her entrance or park as near as possible. To restrict "adequate" accessibility to these clients would be financially harmful to my hair dresser tenant as it would be to my own "future" landlord leasing status. (con't.) Page 2 (con't.) Total elimination of the present parking spaces would limit my ability to rent the present real estate office area which the hair dresser has already expressed serious interest in. The retention of convenient and safe parking in front of the real estate office would facilitate my future rentability problems. 4) With the new sketch plan parking space area allocation is far greater than required by the current town code. As you can see from the "colored" site plan, I have eliminated the "problem" parking area in front of the hair dresser. I would install curbing as you requested all along Marlene Lane where indicated as well as posting "NO PARKING AT ANY TIME" signs at proper~distances on the boundaries. I appeal to you and the board to please accept the continuance of the present, most-important parking area in front of our real estate office as part of the site plan approval. It should be noted that the present area can accommodate 10 vehicles whiIm the new sketch plan voluntarily reduces capacity 50% to only 5 vehicles. Finally, I would like to comment that my expansion plan (in it's completed form) would be an asset to Southold Town and would create no traffic control problem for the Mattituck community. In fact, it would substantially improve the overall character of the immediate business area. I love this town as much as each and every board member and with five children and a lovely wife behind me I assure you that proper planning for my site is as much of a heartfelt concern for me as it is for you~ My future is my family's future. Vitale, the following explanations will hopefully answer her comments: 1) As you know, the new additionunder law must conform to all Suffolk County Board of Health standards regarding well water and septic system controls. Mrs. Vitale is therefore automatically protected. 2) This parcel was cleared of all tree growth in 1983 due to the constant "root blockage" problems we had experienced in our sewer lines. It should be noted that the tree clearing was done at considerable cost to me and fortunately has since eliminated all blockage problems. 3) The property is zoned B-1 (co,~mrcial) in it's entirety and has been maintained as such for well over 25 years. 4) The buildingwas completely painted (rear included) to "spruce up" it's previous appearance. Although tb~ rear portion of the building does not face the highway, it was painted primarily to express neatness and care to all surrounding neighbors. 5) The garbage which exists to the East of subject property is not my doing. It belongs to a tenant of the adjoining ow~mr. I don't like the litter any more than Mrs. Vitale and I have even called the owner to see if he could have this problem resolved. Our lawn is littered as much as, if not more than Mrs. Vitale's. 6) Upon my pozchase of this property I gave Mrs. Vita]e permission to plant a pine tree "shielding" line on the Southerly most portion of my property. This buffer has since been planted and taken root. 7) I have absolutely no objection to Mrs. Vitale placing a fence along the Southern boundary of my parcel· I did not zone this property nor any of the surrounding properties (the Town did) and should therefore not he penalized for it by being required to install a fence at my own cost. (con't.) 8) (2) Since this building was "uplifted" our office has had hundreds of favorable conmmnts as to it's neatness and eye appeal by chamber members, civic groups, office clients, and nunerous Marlene Lane Associationmembers. In all cases where this chapter requires approval of site development plans by the Planning Board, no building permit shall be issued by the Building Inspector except upon authoriza- tion of and in conformity with the plans approved by the Planning Board. § 100-131 ZONING § 100-132 § 100-131. Objectives. In considering and acting upon site development plans, the l'lanning Board shall take into consideration the public health, safety and welfare, the comfort and convenience of the public in general and the residents of the immediate neighborhood in particular, and may prescribe appropriate conditions and safeguards as may be required in order that the result of its action lnay, to the maximum extent possible, further the expressed intent of this chapter and the accomplishment of the following objectives in particular: A. Traffic access. That all proposed traffic accessways are adequate but not excessive in number; adequate in width, grade, alignment and visibility; not located too near street corners or other places of public assembly; and other similar safety considerations. B. Circulation and parking. That adequate off-street parking and loading spaces are provided to prevent the parking in public streets of vehicles of any persons connected with or visiting the use, and that the interior circulation system is adequate to provide, safe accessibility to all required off- street parking lots. C. Landscaping and screening. That all playground, parking and service areas are reasonably screened at all seasons of the year from the view of adjacent residential lots and streets, and that the general landscaping of the site is in character with that generally prevailing in the neigh- borhood. Existing trees over eight 18~ inches in diameter measured three (3) feet above the base of the trunk shall be retained to the maximum extent possible. § 100-132. Effect of approval. A. No certificate of occupancy will be issued for any structure or use of land covered by this Article unless the structure is completed or the land is developed or used in accordance with an approved site development plan or approved amendment of any such plan. C. Should any site plan approval involve any matter requiring referral to the Suffolk County Planning Commission, then the matter shall be referred, prior to final action by the Planning Board, to the Suffolk County Planning Com- mission in accordance with the applicable provisions of law. § 100-133. Procedure. A. Presubmission conference. Prior to the submission of a site development plan, the applicant or his agent shall meet with the Planning Board. The purpose of such conference (Cont'd on page 10059) shall be to discuss proposed uses or development in order to determine which of the site development plan elements shall be submitted to the Planning Board in order for said Board to determine conformity with the provisions and intent of this chapter. B. Within six (6) months following the presubmission con- ference, the site development plan and any related in- formation shall be submitted to the Building Inspector, in triplicate, at least fifteen (15) days prior to the Planning Board meeting at which approval is requested. If not submitted within this six (6) months' period, another presubmission conference may be required. C. The Building Inspector shall certify on each site development plan or amendment whether or not the plan meets the requirements of all Zoning Ordinance provisions other than those of this Article regarding site develop- ment plan approval. D. The Building Inspector shall retain one (1) copy and transmit two (2) copies of the certified site development plan to the Secretary of the Planning Board at least seven (7) days prior to the Planning Board meeting at which approval is requested. E. The Planning Board shall act to approve or disapprove any such site development plan within ninety (90) days after the meeting at which approval is requested. Failure to act within ninety (90) days shall be deemed approval. Planning Board disapproval shall include written findings upon any site development plan element found contrary to the provisions or intent of this chapter. In reviewing the ap- plication, the Planning Board may secure the advice or assistance of one ( 1 ) or more expert consultants qualified to advise as to whether a proposed use will conform to the requirements of this chapter. The assistance of a con- sultant, if sought, must be obtained within ten (10) days of the receipt of the application. Such consultant shall report within thirty (30) days after receipt of such request as to whether or not the use applied for will be in conformance with the performance standards and, if not, what 10058.2 ? -2s- ?~ 10059 § 100-133 SOUTHOLD CODE § 100-134 modification in desig~ or operation would be necessary for conformance.
