"..._._~"--..,... -,I DECLARATION {ffrfl & IE 0 W J" . --~:~0Iff4---- AND COVENAN TowZ~Psg3j[~:' ----~------- -/ . -........~..,_.; THIS DECLARATION made the I(~ day of July, 1994, by PECONIC HOMES CORPORATION, a domestic corporation with offices located at (no #) Sound Ave., Mattituck, NY 11952, hereinafter referred to as the Declarant, states as follows: situate in the Town of Southold, Suffolk County, New York, more WHEREAS, Declarant is the owner of certain real property particularly bounded and described as set forth in Schedule "A" annexed hereto as provided by the Declarant; and WHEREAS, for and in consideration of the granting of a SUbdivision application entitled, "Minor Subdivision Plat for Peconic Homes, Inc." and by Resolution dated October 5, 1993, a - copy of which is attached hereto and made a part hereof, and as a condition of granting said approval, the Town of Southold Planning Suffolk County clerk's office; and Board has required that the within Declaration be recorded in the WHEREAS, Declarant has considered the foregoing and determined that same will be in the best interest of the Declarant and subsequent owners of said parcel; NOW, THEREFORE, THIS DECLARANT WITNESSETH: That Declarant, for the purpose of carrying out the intentions above expressed does hereby make known, admits, publishes, covenants and agrees that the said premises herein described shall hereafter be SUbject to the fOllowing covenants ... .. .--.---.'".-.- -- I .,. ~ - ~ which shall run with the land and shall be binding upon all purchasers and holders of said premises, their heirs, executors, legal representatives, distributees, successors and assigns, to wit: (A) Prior to the issuance of any building permit for any dwelling unit on proposed Lot Number 1, such application shall be reviewed by the Planning Board. The Planning Board shall determine whether the additional impact warrants inclusion of the action with the June 7, 1989 Positive Declaration or requires any further environmental review. (B) Prior to the issuance of any building permit for any dwelling unit on proposed Lot Number 1, such application shall be reviewed by the Planning Board. The Planning Board shall determine what road improvements are necessary due to the impact of the additional dwelling unit. (e) A park and playground fee will be required at such time that a dwelling unit is allowed on Lot #1. (D) These covenants and restrictions can be modified only at the request of the then owner of the premises with the approval of a majority plus one of the Planning Board of the Town of Southold after a public hearing. Adjoining property owners shall be entitled to notice of such public hearing, but their consent tosuch modification shall not be required. ... ---~..II - ~ . ,j .)
