parcel of land situate at Laurel, Town of Southold, Suffolk County,
New York, and designated on the Suffolk County Tax Map as District 1000
Section 125, Block 2. Lot 1.24 containing approximately 2.027
acres,
being the same premises acquired by Declarant by deed dated
30th de;
and recorded in the Suffolk County Clerk's
in Liber 9856 of deeds at page 402, and
referred to herein a$ the .premises" and
WHEREAS, the Declarant intends to subdivide said premises
for purposes and desires to subject said premises to certain
conditions, covenants and restrictions in order to preserve the
maximum open space, natural scenic beauty and natural vegetation and
to prevent overcrowding and to conserve the ground water resources
of the Town of Southald, and
WHEREAS, the Declarant has applied to the Planning Board of

of the premises as a minor subdivision, to contain not more than
two (2) lots or parcels.
NOW THEREFORE, the Declarant does hereby declare that the
aforesaid premises and every portion thereof is hereby held and shall
be conveyed subject to the conditions, covenants and restrictions
hereinafter set forth, and that every purchaser of said premises,

by the acceptance of a deed th~reto,
covenants and agrees that the premises so purchased shall be held
subject to the covenants, conditions, and restrictions hereinafter
set forth.
1. No lot line shall be changed in any manner at any
future date unless authorized by the Town of Southold Planning Board.
2. Due to the minimum lot area requirement of the zoning

classification of thts property being considerably less that the area
of Parcels 1 and 2, $ach lot shall be made subject to a covenant
that will prohibit f~ture subdivision, therefore, no lot or plot as
shown and designated on the minor subdivision map approved by and
,
filed with the South~ld Town Planning Board shall be further subdivided.
3. All stormwater runoff resulting for the development and
improvement of this ~ubdivision or any of its lots shall be retained
on the site by adequate drainage structures so that it will not flow
out onto the right-of-way of Franklinville Road.
4. A buffer strip shall be created along the northerly
coundary line to protect the residential amenities of the adjoining
residential parcels.
5. That all bf the covenants, conditions and restrictions
contained herein shall be construed as real covenants running with
the land and shall co~tinue and remain in full force and effect at
all times as against ~he owner of the premises or any portion thereof
in perpetuity. Said ~ovenants, conditions and restrictions shall be
binding upon, insure to the benefit of and be enforceable by the
Declarant, their heirs, successors and assigns: any other of any
portion of the aforesaid premises, their heirs, successors and-assigns:
