Norman Keil presented a sketch plan and photo of his request for placement of an additional

LPC made no decision regarding his request at this time to allow for review of recorded State

Landowners have requested a 20 foot right-of-way along the southeasterly boundary line. The R-O-W
would be included within the development rights easement area but acreage of R-O-W is not to be
included in determining the purchase price. The R-O-W would allow for future residential access to
other parcels owned by landowner. LPC favorable to allowing this request.

Update re: meeting with S. Ficner and family and pending offer [executive session].
Melissa Spiro and Timothy Caufield met with landowner and family members and presented a formal
offer letter. Melissa met again with landowner and her daughter to further discuss offer letter. They
are not happy with clause that states one acre of the 7± easement offered would not be subject to
payment as it would be technically considered part of subdivision open space and are willing to sign
offer acceptance if LPC strikes said paragraph from offer. Melissa Spiro directed to meet again with
Town Attorney Patricia Finnegan for further clarification. Melissa requested that John Sepenoski join
her in attending said meeting.

Reviewed potential preservation application.
Tim Caufield made presentation to LPC. Peconic Land Trust has been working on preservation
potential for this property since about 2001. Landowner is now deceased and PLT is working with
bank executor that is dissolving estate. Peconic Land Trust will consider making an offer to purchase
fee title contingent upon County/Town buying development rights. County may have issue purchasing
development rights on farmland that is not actively farmed. County options to be explored. If bank
accepts PLT’s offer, Tim will have them submit an application to sell development rights to Town.
MOTION
made by John Sepenoski, seconded by Chris Baiz, to direct Melissa Spiro to commission
an appraisal on this property subject to an LPC application being submitted that is either part of a
conservation subdivision or preserving an area greater than that required by a conservation
subdivision. Appraiser is to be directed to value development rights with restrictions to protect the
scenic viewshed from CR 48.

Tim Caufield gave update on status of Peconic Land Trust’s purchase of property pending to close by
December 20, 2007. Steering and Fund-Raising Committees have been established. PLT is exploring
potential Town involvement, possibly with purchase of an easement.

Tim Caufield gave update status of project. Landowners’ attorney asked Town to proceed without
County if County can’t purchase within timeframe. Melissa and LPC have an appointment to appear
at the 11/20/07 Town Board Work Session to give update on project status. Melissa to investigate
possibility of Town buying rights to part of the property with new bond funding, then selling
development rights to County at a later date.

11/20/07 to update Town Board regarding status of this project.

The Nature Conservancy is moving closer to acquiring fee title to property, then subdividing house
from property, and then selling remaining open space to Town/County 50/50 partnership. Randy
Parsons on TNC is coming to Town Board Work Session scheduled for 11/20/07 to update Town
Board regarding status of this project. The existing residential home would be subdivided from parcel.
Originally, house was to be purchase by North Fork Housing Alliance; however, they are no longer
interested in purchasing. TNC will have to sell fee title to to-be-created house parcel on the open
market unless the Town wants to purchase house lot area (before its creation) and eliminate
residential structure. LPC discussed potential for eliminating LB zoning use associated with property if
house lot is sold on open market.

Waterfront property on West Lake having code issues with Trustees. Trustee recommended that
Conservation Easement be gifted to the Town eliminating residential development. This is a small lot
and need for public benefit must be established. Melissa Spiro to consult further with Assistant Town
Attorney Lori Hulse regarding status of code violations. Pat Moore, attorney for landowners, willing to
draft necessary paperwork for easement to be transferred to be conveyed to Town before 2007 ends.
LPC to attend Town Board Work Session scheduled for 12 noon on Tuesday, November 20, 2007 to
discuss proposal.
