WITNESSETH, that the party of the first part, in consideration of TEN dollars and other good and valuable
consideration paid by the party of the second part, does hereby grant and release unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever,
ALl.: that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying end being

Being and intended to be the same premises es conveyed to the party of the first part by deed, dated
6129/1959. recorded 6129/1959 In Liber 4649 page 145 in the Suffolk County Clerll's Office.
TOGETHER with all right, tide and Interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appUr1llnances and all
the estate and rights of the party of the first part In and III said premises; TO HAVE AND TO HOLD the
premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of
the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby tha said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyence and will hold the right to receive such consideration
es a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose. The word "party" shall be construed as if ~ read "parties" when ever the sense of this indenture so
requires.

All that certain plot, piece or parcel ofland, situate, lying and being on Lupton's Point in
Mattituck, Town of Southold, County of Suffolk and State of New York, and bounded and
described as follows:
Beginning at a monument set on the northerly line of a twenty (20) foot right of way hereinafter
described at a point one hundred (100.00) feet westerly along the northerly line of said right of
way from the southwesterly comer of land of William F. Eske and about eight hundred twenty
(820.00) feet easterly along said line of right of way from the easterly line of Marratooka Road;
from said point of beginning running in a northerly direction along the easterly line of lands of
Blanche L'Hommedieu Weese, the following two courses and distances:
(I) North 10" 14' SO. west, 100 feet to a monument;
(2) North 28" 44' 00" east 107 feet, more or less and through a monument to the ordinary
high water line of Deep Hole Creek; running thence in a southeasterly direction along the
southerly line of Deep Hole Creek as the same winds turn, forty (40) feet, more or less, to the
westerly line oflands of William F. Eske; running thence in a southerly direction along the
westerly line of said lands of Eske, South 10" 14' SO. cast, 20 feet, more or less, to a stake in said
line; continuing thence on the same course of south 10" 14' SO" cast, 140 feet to the northerly line
of said twenty (20) foot right of way; running thence in a westerly direction along the northerly
lien of said twenty (20) foot right of way south 790 45' 10. west, 100 feet to the easterly line of
said lands of the party of the first part and the point or place of beginning.
Together with a right of way over the twenty (20) foot wide private road to and from the
premises hereby conveyed to Marratooka Lane, and to and from Deep Hole Creek at the end of
said twenty (20) foot private road where it adjoins Deep Hole Creek on the easterly end of
Lupton's Point.
Together with riparian rights in and to Deep Hole Creek, and all ofthe right, title and interest of
the party of the first part in and to the lands under the waters of Deep Hole Creek abutting said
premises.
