BEING AND INTENDED TO BE the same premises conveyed to the parties of the first part by deed
dated August 11, 1997 recorded In the Office orthe Clerk ofthe County or Suffolk on AugustZO,
1997 in Liber 11847 page 391.
TOGETHER with all right, title and interest, if any, ofthe party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof,
TOGETHER with the appurtenances and all the estate and rights of the pany of the first pan in and to said
premises.
TO HAVE AND TO nOLD the premises herein granted unto the pany of the second part, the heirs or
successors and assigns of the party of the second pan lorever.
AND the party of the first pan covenants that the party of the first pan has not done or suffered an}1hing
whereby the said premises have been incumbered in any way whatever, except as aforesaid.
AND THE pany of the first part, in compliance with Section 13 of the Lien Law, covenants that the party
of the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement, and
will apply the same first 10 the payment of the cost of the improvement before using any part of the total of
the same for any other purpose, The word "pany" shall be construed as if it read "parties" whenever the
sense of this indenture so requires,

Otliee on May 27, 191J as \1ap No. 551 which said part of lot is more pal1ieularly
bounded and described as lollows:
BEGINNING at a point on Ihe easlcrly side of a 33 fOOl Private Road on said fikd map
distant 1872.11 feet more or less from the southerly side oflndian Neck Road which said
beginning point is also where the southerly line of land now or formerly of Linda R.
Gemmill intersects the easterly side oflhe 33 loot Private Road;
RUNNING THENCE north 49 degrees 31' 16" cast along the southerly line of said land
now or formerly of Linda B. Gcmmill 68.60 feet to the westerly line of Lot D according
to said map;
RUNNING -:-HENCE soulh 40 degrees 28' 44" east along said lot line 352.0 fect 10 the
present ordinary high water mark of Peeonie Bay;
RUNNING THENCE south 29 degrees 50' west along the present ordinary high water

Road or the prolongation southerly of its easterly line;
