the party of the second part, the heirs or successors and assigns of the party of the second part forever,

BEING AND INTENDED TO BE the same premises conveyed to the party of the lint part by deed
dated August II, 1997 recorded in the Office of the Clerk of the Counly of Suffolk on August 20,
1997 in Liber 11847 page 392.
TOGETHER with all right, title and inteR.'SI, if any, oflhe party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof.
TOGETHER with the appuncnances and all the estate and rights of the party of the first part in and to said
premises.
TO HAVE AND TO HOLD the premises herein granted unlo Ihe party of the second part, the heirs or
successors and assigns of the party of the second part forever.
AND the party ofthe first part covenants thallhe party of the first part has not done or suffered anything
whereby the said premises have been incumbered in any way whatever, except as aforesaid.
AND THE party oflhe first part, in compliance with Section 13 of the Lien Law, covenants thatlhe party
of the first part will receive the consideration for this conveyance and will hold the right to receive such
consideralion as a trust fund to be applied first for the purpose of paying the cosl of the improvement, and
will apply the same firsllo the payment of the cost oflhe improvement before using any part of the lotal of
the same for any other purpose. The word "party" shall be construed as if it read ''parties'' whenever the
sense of this indenture so requires.

DESCRlPTIO~
ALL that certain plot, piece or parcel of land, with the buildings and improvements
thereon erected. situate, lying and being at or near Peeonic, Town of Southold, Co un!)' of
Suffolk and State of New York known and designated as part of Lot "E" as laid out on a
certain map entitled "Map of Indian Neck Park, George W. Smith. owner, Scale I inch to
80 feet, Franklin J'. Overton, M.E., surveyor. 1912" and filed in the Office of the Suffolk
County Clerk on May 27,1913 as Map No. 551 which said part oflot is more particularly
bounded and described as follows:
BEGINNING at a point on the .:asterly side ofa 33 foot Private Road on said filed map
distant 1775 feet more or less from the southerly side of Indian Neck Road which said
beginning point is also where the easterly side of said 33 foot Private Road is intersected
by the southerly linc ofa Right of Way as both are shown on said filed map;
RUNNING THENCE north 54 degrees 07' cast along the southedy line of the Right of
Way 64.30 feet to the westerly line of Lot 0 according to said map;
RUNNING THENCE south 11 degrees 12' 44" east along said lot line 90.40 feet;
RUNNING THENCE south 49 degrees 31' 16" west 68.60 feet to the easterly side of the
aforementioned 33 foot Private Road;
RUNNING THENCE north 10 degrees 23' west along said 33 foot Private Road 97.11
feet to the point or place of BEGINNING.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year first
