QUITCLAIM DEED
This Indenture, made the 2nd day of August, Two Thousand
and Seven,
BE'.l'tIBEN
YVOIIHE R. GALLAGHER, residing at 160 Salt Marsh Lane,
peconic, New York 11958; party of the first part, and
THE YVOHHE R. QIlu '-GHBR IRREVOCABLE TRUST, under agreement
dated August 2, 2007, Leigh Gomez, residing at 206-04 Lori
Drive, Bayside, New York 11360; and Michelle Murphy,
residing at 38-07 214 Place, Bayside, New York 11361; as
Trustees; and THE MICHAEL P. aau.aOHD IRREVOCABLE TRUST,
under agreement dated August 2, 2007, Leigh Gomez,
residing at 206-04 Lori Drive, Bayside, New York 11360;
and Michelle Murphy, residing at 38-07 214 Place, Bayside,
New York 11361; as Trustees; to each a one-half interest
in the premises; party of the second part,
WITNESSETH, that the party of the first part, in
consideration of Ten Dollars and other valuable
consideration paid by the party of the second part, does
hereby grant and release quitclaim unto the party of the
second part, the heirs or successors and assigns of the
party of the second part forever, all of the party of the
first part's interest in
ALL that certain plot, piece or parcel of land, with
buildings and improvements thereon erected, situate, lying
and being at peconic, Town of southold, County of Suffolk
and State of New York, bounded and described as follows:
BEGINNING at a point on the northwesterly side of
Lake View Avenue (a private road) distant 127.08 feet
southerly from the corner formed by the intersection of
the northwesterly side of Lake View Road and the southerly
side of Huntington Boulevard (a private road) which said
point of beginning is at the southerly corner of land of
Lipman;
RUNNING THENCE along the northwesterly side of Lake
View Avenue South 38 degrees 39 minutes 00 seconds West
115 feet to other land of Matthew;
RUNNING THENCE along said other land of Matthew the
following three courses and distances:
1. North 54 degrees 21 minutes 00 seconds West 150
feet;
2. North 38 degrees 39 minutes East 15 feet and
3. North 55 degrees 23 minutes 10 seconds West
275.93 feet to ordinary highwater mark of Long
Island Sound;
RUNNING THENCE along the ordinary high water mark of
L.I. Sound (on a tie line) North 56 degrees 18 minutes 40
seconds East 100 feet to the southerly side of land of
Lipman and;
RUNNING THENCE along the southerly side of land of
Lipman South 55 degrees 59 minutes 00 seconds East passing
through a monument 396 feet to the northwesterly side of
Lake View Avenue to the point or place of BEGINNING.
TOGETHER with a right of way in common with others
over and along the private roads leading from the above
described premise to second Avenue and also a right of way
across said Second Avenue to Mill Road.
BEING AND IHTEHDED TO BE the same premises conveyed to the
Grantor by Deed dated March 11, 1999 and recorded in the
Suffolk County Clerk' s Office on September 7, 1999 in
Liber 11987 page 627, the Grantor being the same person
described as the Grantee in said Deed.
Together with all right, title and interest, if any, of
the party of the first part in and to any streets and
roads abutting the above-described premises to the center
lines thereof;
Together with the appurtenances and all the estate and
rights of the party of the first part in and to said
premises;
To have and to hold the premises herein granted unto the
party of the second part, the heirs or successors and
assigns of the party of the second part forever.
And the party of the first part covenants that the party
of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way
whatever, except as aforesaid.
And the party of the first part, in compliance with
Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this
conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the
purpose of paying the cost of improvement and will apply
the same first to the payment of the cost of the
improvement before using any part of the total of the same
for any other purpose. The word "party' shall be
construed as if it read "parties" whenever the sense of
this indenture so requires.

executed this Deed the day and year fi t above written.

undersigned, personally appeared YVOHHE R. GALLAGHER, personally
known to me or proved to me on the basis of satisfactory evidence to

that by his signature on the instrument, the individual, or the
person upon behalf of which the indiv' ted, exec the
instrument.
