WITNESSETH, that the party of the first pan, in consideration ofTen Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party of
the second part, the heirs or successors and assigns of the party of the second part Ibrcver,
ALL that certain plot, piece or parcel of land, situate, lying and being at Southold, Town of
Southold. County of Suffolk, and State of New York. heing more particularly bounded and
described as follows:
BEGINNING at a point on the southerly line of County Route 48 where same is intersected by
the easterly boundary of lands now or fonnerly of Gawelko and from said point of beginning
running along the 5lIid southerly line of County Route 48 along a curve to the right having a
radius of 22S9.01 fect a distance of 3S0.00 feet to the true point of beginning and from said true
point of beginning running along the southerly line of County Route 48 along a curve to the right
having a radius of2259.01 teet 216.83 feet to lands now or formerly of Carroll;
RUNNING THENCE South 46 degrees 41 minutes West. 342.32 feet to the lands now or
formerly of Margaret A. Kerbs;
RUNNING THENCE along the lands now or formerly of Margaret A. Kerbs, South 39 dcgTI."Cs
17 minutes West, 192.00 fect to lands now or formerly of John M. Kerbs and Margaret A. Kerbs
RUNNING THENCE along said lands of John M. Kerbs and Margaret A. Kerbs, North SO
degrees 43 minutes West, 3S8.37 feet to the southerly line of County Route 4S, and the true point
of beginning.
BEING AND INTENDED TO BE the same premises as set forth in Paragraph I. of a certain
Boundary Line Agreement recorded in the Suffolk County Clerk's Ofike on January 14.2002. at
Liber 12163. Page ISO. together with the Right.ol~Way set lbrth al I'amgraph 3. of said
Boundary Line Agreement.
RE~ERVING, HOWEVER. a legal life estate in 'the a~Ve-deseribed premises with the buildings /
and improvements thereon erected, in and to the party of the first part.
THE PARTY OF THE FIRST PART HEREBY RESERVES A SPECIAL POWER OF
APPOINTMENT. exercisable as often as they may choose, to change their remainderman as
follows:
TO or among anyone or more members of a class consisting of the party of the first part's
descendants. in any degree, whether presently living or born hereafter, in such proportions and
amounts. without regard to equality, outright or in trust, as the party of the first pan may din.'Ct
and appoint during her lifetime by properly written and acknowledged instnunent, and recorded
prior to death, making specific reference to this power of appointment. The party of the first part
may not appoint themselves. their e.~tate. their creditors or the creditors of their estate. under any
circumstances.
TOGETHER with all right. title and interest. if any, of the party of the first part in and to any
streets and roads abuning the above dcscribed premises to the center lines thcreof; TOGETHER
with the appurtenances and all the estate and rights of the part)' of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and as.~igns of the party of the second part forever.
AND the party of the first part covenants thai the party of the first pan has not done or sulTered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part. in compliance with Section J3 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the right
to receive such considcr..tion as a trust fund to be applied first for the purpose of paying the C\lst
of the improvement and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the same for any other purpose.
Tbe word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
