REASON FOR APPEAL

is requested for the reason that the lot area is of insufficient size pursuant
to Article III, Section 303 of the Southold Town Zoning Ordinance,
and that if such variance is duly granted, that the building inspector
issue a certificate of occupancy for the building erected on said
premises.

REASON FOR APPEAL

1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-
sary HARDSHIP because the character of the adjoining land areas is such
that the lot area of the subject premises could not be readily in-
creased. In this connection, the width of the subject premises on
Orchard Street was fixed at 87.80 feet prior to' zoning in the light
of the fact that properties to the eastand the west were then, and
are now, owned by different property owners. As concerns lands to
the north of the subject premises, said lands are owned by the New
Suffolk Shipyard, Inc. It was this corporation which conveyed the
land in question to the applicant in January 1962. Since the date
of such conveyance, the corporation changed ownership, and the lands
to the north are now owned by the new owners of the corporation.
The character of the lands to the north is such that little would be
achieved by acquiring any of such property"so as to increase the depths
of the subj ect premises. In this :ie'g'ard, said lands to the north are
of a low elevation, and would require substantial fill to bring same
to the grade of the subject premises. Further, the addition of any
such depth would in no way enhance or benefit the rear yard area of
the subject premises. Finally, and as equally important, it is

2. The hardship created is UNIQUE and is not shared oy all properties alike in the immediate
vicinity of this property and in this use district because

1. (Cont'd) highly unlikely that any such additional land could be
so acquired from the new owners of the corporation. Moreover, even
if such were possible and feasible, the applicant, who is now a
surviving widow, does not have the funds to make such an acquisi-
tion. As concerns the residential dwelling situate on the premise~
it should be indicated that such dwelling was placed thereon prior
to zoning, and was completed as to its interior'by the applicant,
after the closing of title.
l. The hardship created is UNIQUE and is not shared by all prop.
erties alike in the immediate vicinity of this property andin this
use district because other properties in the immediate vicinity of
the subject premises, while of similar lot size, were all completed
as to residential construction, prior to the advent of the Southo1d
Town Zoning Ordinance. In such circumstances, the subject premises
are unique, due to the fact that the sale of the lot and the comple
tion of the interior of the building, took place after the Southo1d
Ordinance went into effect. Thus, the hardship and the present
situation is unique, and not shared by all of the properties alike
in the immediate vicinity.
3. The Variance would observe ~he spirit of the Ordinance and
WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because the entire
area surrounding the subject premises is substantially completed
as to improved properties. The subject property has existed in its
present state since 1962, and the surrounding properties are a
similar lot size containing similar types of residential construc-
tion. The granting of the Variance would not change the character
of the district.
