(631) 765-1809• Fax(631) 765-9064 Southold Town Cerk FINDINGS, DELIBERATIONS, AND DETERMINATION MEETING HELD SEPTEMBER 27, 2007 ZBA File No. 6073 — Constance Beebe and Sidney Beebe Jr. Property Location: 24925 Main Road, Cutchogue CTM 109-1-20.3 Public Hearing: September 13, 2007 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. PROPERTY FACTS/DESCRIPTION: The October 28, 2003 survey, updated May 26, 2006, confirms the property size to be 35,530 square foot parcel with 142.18 feet along the Main Road, 75.59 feet along the northerly lot line, 323.84 feet along the western lot line, and 333.96 feet along the eastern lot line. The property is currently improved with a single- story frame dwelling and one-story frame shop in the rear yard. BASIS OF APPLICATION: Zoning Code Section 280-15, based on the Building Inspector's July 20, 2007 Notice of Disapproval concerning proposed construction of an addition to the accessory garage/shop resulting in an area exceeding the code limitation of 750 square feet in size and proposed at less than 10 feet from the eastern lot line, as shown on the survey revised May 23, 2007 by Nathan Taft Corwin III, Land Surveyor, in the original application submission. CHAPTER 280 (formerly Chanter 100) - ZONING CODE PROVISIONS: Zoning Code Section 280-15(B) states that an accessory building shall be a minimum of 10 feet from the property line; Section 280-15 (C) states that an accessory building shall not exceed 750 square feet. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application has been referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning reply dated August 21, 2007 states that the application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. Page 2—September 27, 2007 ZBA File No. 6073—Constance Beebe and Sidney Beebe Jr. CTM 109-1-20.3 FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on September 13, 2007, at which time written and oral evidence was presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED and AMENDED VARIANCE RELIEF: The relief requested bythe applicant is to increase the size of the accessorybuildingfrom 1300 square 4 PP 4 feet to 2800 square feet. The applicant's request for variance relief concerning a 4.6 ft. side yard setback was withdrawn. ADDITIONAL INFORMATION: The southern part of the property is located in an R-40 Low-Density Residential Zone District, and the northern part is in an RO Residential-Office Zone District including the existing accessory garage/workshop building. The proposed addition will continue the same workshop use and be entirely in the RO Residential-Office Zone District. [A custom workshop such as presently exists is a permitted use by special exception, Zoning Code Section 280-38-B(5).] REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the area variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The addition will be primarily along the rear of the existing workshop accessory building and will be minimally visible from the road. 2. The benefit of an expanded workshop cannot be achieved without a variance. A custom workshop built to the size limited by code is not adequate for the business uses for which has been constructed. 3. The variance sought is substantial. 4. The difficulty has not been self-created. It is a consequence of the preexisting use of a structure for the business purposes for which it was designed. 5. Grant of the requested variance is necessary to enable the applicants to use their property as a house and garage/workshop with addition, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. The entire shop is to the rear of residence and will not be visible from the road. Schwartz, Architect. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Name of Owner: ZBA File# REASONS FOR APPEAL(additional sheets may be used with preparer's signature): AREA VARIANCE REASONS: Ili (1) An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment to nearby properties if granted, because: The property has been the home and shop for the Beebe family since 1960's. The late Sidney Beebe,and his son,Sidney Beebe Jr.,are builders and they have operated their business from this home since the 60's. The building shop and storage building was constructed in 1976 and continues to be the shop and storage for Sid Beebe Builders. However, the principal use of the property continues to be Constance Beebe 's home. The existing shop is extremely small and unsafe for the carpentry equipment used for the fine custom carpentry which Sid Beebe is known for and specializes in. The proposed addition will provide the needed space for their custom carpentry work and is designed to appear no different from the street then the existing residence with garage work shop. The addition is directly behind the existing two bay garage shop. The property slopes down behind the existing building which will also enable use of the basement level for storage. This property continues to be the family compound for the Beebe family. Mrs. Beebe's son, Thomas Beebe and his wife live on the west side of the subject property (lot 20.2). The addition is intended to retain the existing character of the area, Mrs.Beebe wishes to save a mature tree and lawn area between the subject property and the adjacent house. Keeping the addition directly behind the structure will preserve the existing landscaping and residential appearance of the property. (2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue,other than an area variance,because: The family has operated Sid Beebe Builders from this site since the business began by Mr.Beebe,the"home grown" business and family needs room to operate safely and comfortably. The existing shop has three generations of wall to wall materials and fine carpentry equipment which needs space to function. Building a separate storage structure would change the character of the properties and eliminate the green space the family wishes to retain. The addition to the existing building will be unnoticeable and use the back of the property which is underutilized because of the sloping grade of the property. (3) The amount of relief requested is not substantial because: The request is substantial due to the revision to the code limiting the size of accessory structures but the building and property are unique. The existing garage work shop was constructed in 1976. In 2005 three lots (Lot 18, 19 and 20.1 ) were combined and then split into two lots. The re-division of the property provided a greater side yard on the west and more land behind the existing structure. However, the existing structure pre-exists the change to the code and therefore is nonconforming,and the lot becomes 3 narrower towards the back of the property. The narrowing of the lot and existing location of the building makes the side yard setback variance unavoidable. The addition comes closer to the easterly property line in order to maintain the existing angle of the building. (4) The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: The proposed addition will have the smallest impact to Mrs.Beebe's house. Her son runs the business but mom continues to live in their family home. She wishes to continue to enjoy the lawn area between the subject property and Thomas Beebe's home. She wishes to retain the mature trees on the property and the addition will not be obvious from the residences. Several adjoining homes have similar"oversized"garages and workshops. This addition is intended to maintain the usefulness of the garage while maintaining the residential use of the property. (5) Has the alleged difficulty been self-created? ( X )Yes, or ( )No. The proposed addition to the accessory building minimizes the impact of the shop and storage building. A separate,more conforming building,would affect the property more. The addition will also enable Sid Beebe to reallocate the space inside the existing building. Are there Covenants and Restrictions concerning this land: E No. ❑Yes(please furnish copy). This is the MINIMUM that is necessary and adequate, and at the same time preserve and protect the character of the neighborhood and the health,safety,and welfare of the community. PROPERTY FACTS/DESCRIPTION: The applicant's property is identified on the County Tax Map as Parcels 109-1-20.1, 18 and 19. The property is improved with two dwellings and accessory buildings/structures, as shown on the October 28, 2003 survey prepared by Joseph A. Ingegno, L.S., revised May 28, 2004. CTM 20.1 consists of 33,908 sq. ft., CTM 18 consists of 22,491 sq. ft., and CTM 19 consists of 19,492 sq.ft. BASIS OF APPLICATION: Building Department's September 8, 2004 Notice of Disapproval, citing Section 100-32 in its denial of an application to the Building Department and Planning Board in her request to change lot lines, re-creating the property into two parcels: Parcel 1 of 40,361 sq. ft. and Parcel 2 of 35,530 sq.ft. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on January 20, 2005 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicant is requesting variances for the sizes of 40,361 sq. ft. and 117 feet in width (proposed Parcel 1), and of 35,530 sq. ft. with 144 feet in width (proposed Parcel 2). REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections,the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. No increase in density will be created, and the lot line change will produce rectangular dimensions. 3. The variance granted herein is not substantial. 4. The alleged difficulty has not been self-created. All three of the parcels were legally created before the existence of Southold Town Zoning, and the difficulty, nonconforming lot size, was created by various changes in the town codes, over which an individual property owner has very little control. 5. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a lot line change, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Chairwoman Oliva, seconded by Member Dinizio, and duly carried,to GRANT the variances as applied for, as shown on'the October 28, 2003 map prepared by Joseph A.
