(631) 765-1809•Fax(631) 765-9064 Ia T FINDINGS, DELIBERATIONS AND DETERMINATION MEETING OF SEPTEMBER 27, 2007 ZB File No. 6072—Scott and Sarah Hassildine Property Location: 2775 West Creek Avenue, Cutchogue CTM 110-5-4 SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further reviews under SEQRA. PROPERTY FACTS/DESCRIPTION: The applicant's 9,959 square foot (non-conforming) parcel is located in an R-40 Low-Density Residential Zone District with 40 feet along West Creek Avenue, 200 feet in depth, and 60 feet wide along the north/westerly rear lot line. The premises is currently improved with a single-story single family dwelling. BASIS OF APPLICATION: Request for Variances under Section 280-124, based on the Building Inspector's July 19, 2007 Notice of Disapproval, which states that the proposed construction with additions and alterations (and after substantial demolition of portions of the existing building), will not meet the code requirements of 10 feet on a single side yard and 25 feet total side yards. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application has been referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning reply dated August 21, 2007 states that the application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on September 13, 2007, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicants propose to re-construct substantial portions of the existing nonconforming, single-family dwelling (after demolishing the existing Page 2-September 27, 2007 ZB File No.6072-Scott and Sarassildine CTM No. 110-5-4 building area). The new construction is proposed with setbacks at 5.8 feet from the proposed retaining wall, and 4.6 feet from the step areas leading to the proposed covered porch and wood deck over garage, shown at 7.8 feet to the closest (side) property line. The opposite side of the dwelling remains at 5.6 feet to the side property line, and the total side yard areas will be 13.4 feet total (7.8 feet plus 5.6 feet for two sides), as shown on the July 25, 2007 survey prepared by Peconic Surveyors, P.C. and as shown on Building and Elevation Plans prepared by Stephen Rossetti, Architect (page dated 12/18/06, and pages updated 1/30/07 and 1/31/07). REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The lot is long and narrow, and the relief requested is near the rear of the property which is the greatest width of the lot (60 feet). The applicants wish to demolish a major portion of their existing home and replace it with a new two-story modular home, adding it to the remaining new addition, and placed sideways on the widest portion of the lot and by increasing the setback from the existing side yard nonconformity (4.5 feet at its closest point). The existing one-story home is being replaced with a two-story home, which will create less coverage and footprint. 2. The benefit sought by the applicants cannot be achieved by some method, feasible for the applicants to pursue, other than an area variance. 3. The variance granted herein is substantial. 4. The relief requested is not self-created. This parcel and other lots are irregular, and a majority of the lots in the area are nonconforming as to lot area and lot width. 5. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of the property for use as a single-family dwelling, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Goehringer, Page 3—September 27, 2007 ) D ZB File No.6072—Scott and Sarah Hassildine CTM No. 110-5-4 seconded by Member Weisman, and duly carried, to GRANT the variance as applied for, as shown on the July 25, 2007 survey prepared by Peconic Surveyors, P.C. and as shown on Building and Elevation Plans prepared by Stephen Rossetti, Architect (page dated 12/18/06, and pages updated 1/30/07 and 1/31/07). Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. 1 The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Name of Owner: Scott & Sarah assildine ZBA File# (90) REASONS FOR APPEAL (additional sheets may be used with preparer's signature) AREA VARIANCE REASONS: (I) An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment to nearby properties if granted, because: The house will remain set back off of the road and tucked into a wooded section as it currently is. With the exception of branches on our property,no trees that would affect the character of the neighborhood will need to be taken down. The 5.6' side yard setback on the south side was approved in 1972 by appeal#1538. The proposed 7.5 foot side yard setback on the north side. although for a longer distance, is almost double the existing 4.5 foot setback. It will consist of a one story covered unenclosed porch for its entire length. The actual 2 story house will be set back 13.5 feet from the side-yard. In the cases of both lots on either side of the property, the houses on those lots are located much further forward than our existing and proposed residence, so the closeness to the sideline will not directly impact either of those residences. The lot to the South has a garage in the area of our proposed house,and the lot on the North has an empty yard and is separated by a tree line and stockade fence. The houses to the rear are at a much higher elevation and quite a distance away. (2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue,other than variance,because: The lot is too small to allow an average size home to be constructed allowing enough livable space. Meeting code would require our garage and 100' driveway to be completely relocated and the cost would not be affordable. We are currently living with our one child in a one-bedroom house. We are planning on building a modular home, which has a standard 26' width, and we need the porch to access the entryway. The only alternative is a long. narrow house which would have to be multi-level because of the slope and would be much closer to the existing houses. (3) The amount of relief requested in not substantial because: The new construction is a modest size house containing the minimum amount of space necessary for our family. The new livable area construction will not exceed the original footprint of the existing home. The existing first floor is 896 square feet. and the proposed first floor livable area is 936 square feet. (4) The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: The existing house was originally built in 1934 and was one of the original homes in the Fleet's Neck area. Because it is set back so far from the road,the size of the new home will not be noticeable. The lots in the area have staggered setbacks, which minimizes the size impact. (5) Has the alleged difficulty been self-created? ( )Yes(X)NO. This is the MINIMUM that is necessary and adequate,and at the same time preserve and protect the character of the neighborhood and the health,safety,and welfare of the community.
