(631)765-1809•Fax (631)765-9064 JUL 2 6 2007 FINDINGS, DELIBERATIONS AND DETERMINATION outhold o n Clerk MEETING OF JULY 12, 2007 ZB File No. 6045 —Amy Gross Property Location: 740 Northview Drive, Orient CTM 13-1-4 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. PROPERTY FACTS/DESCRIPTION: The applicant's parcel has a total lot size of 54,134 square feet with 150 feet along North View Drive, 333.95 feet along the easterly side lot line, and 174.27 feet along the northerly lot line adjacent to the Long Island Sound. The property is improved with an existing single-family dwelling and single-story accessory garage shown on the March 21, 2007 survey prepared by Joseph A. Ingegno, L. S. The upland area of the property landward of the Coastal Erosion Hazard Line, is 22,549 square feet, measured between the top of the bluff and the street and confirmed by William Ryall, Architect. BASIS OF APPLICATION: The applicant is requesting relief under Sections 280-15F and 280- 116A, based on the Building Inspector's April 16, 2007 Notice of Disapproval. The applicant has applied for a building permit concerning a proposed addition to a single-family dwelling, pergola structure and accessory swimming pool, and the reasons stated in the Notice of Disapproval issued by the Building Inspector are: (1) the addition to the existing dwelling will be less than 100 feet from the top of the bluff or bank adjacent to the Long Island Sound; (2) the proposed addition places the existing accessory garage partly in a side yard; and (3) the proposed swimming pool construction and pergola will be less than the code-required 50 feet from the front lot line when located in a front yard. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application has been referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated June 11, 2007 stating that the applicant's requests are considered a matter for local determination, as there appears to be no significant county-wide or inter-community impact. Page 2—July 12,2007 V ZB File No. 6045—Amy Gross CTM No. 13-1-4 TOWN CODE CHAPTER 268 LWRP DETERMINATION This application has been referred to the Town LWRP Coordinator as required under Town Code Chapter 268, and a reply was submitted on June 25, 2007 to the Zoning Board of Appeals with a recommendation of inconsistency under LWRP Policy 6 Standards for the reasons that the applicant's request for a proposed addition on the north side of the dwelling is only 18 feet to the top of the bluff and the proposed pergola is only 57 feet to the top of the bluff, citing the 100 ft. minimum setback requirement under Section 280-116A of the Town Code. Compliance was also requested concerning Trustees' regulations and recommendations under Policy 6.3. The Board of Appeals held a public hearing on June 28, 2007, and the applicant submitted information to show that a drywell system for any necessary backwash from the proposed gunite pool, as well as drywells to meet codes for all roof water runoff. A row of hay bales around the perimeter of the construction areas will serve as a form of sediment and erosion control. Information was also submitted to show that since there is no building construction that can reasonably satisfy the code-required 100 ft. setback from the top of the bluff. The code-required 50 feet minimum setback from the front line adjacent to the street is another difficulty to satisfy. All new construction mitigates these requirements in a location at the southeast corner of the existing nonconforming dwelling. No activities are proposed to replace the existing garage, and with the proposed location of the addition on the south/southeast side of the dwelling, a portion of the existing garage would be in a side yard, rather than a permitted front (street side). The proposed pergola and swimming pool are proposed closer to the street than the distance to the top of the bluff. The lot coverage is shown to meet a new code requirement of 20% or less of the 22,549 square feet of land area (between the Coastal Zone Hazard Line and the street lot line). The new construction will also be required to conform to Trustees' permit and conditions concerning erosion and sediment controls during construction activities to protect the bluff, and for gutters, downspouts and sub-surface drywells to code, to control storm water runoff from impervious surfaces, and compliance with other codes and other agency permits. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on June 28, 2007, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicant wishes to construct addition to a single- family dwelling, accessory pergola structure, and accessory gunite swimming pool, as shown on site plan prepared by Ryall Porter Architects revised June 4, 2007. In addition, the proposed addition to the dwelling will place the existing garage in a side yard location, rather than the code-required rear yard or code-required front yard. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: Page 3—July 12,2007 C 0 ZB File No.6045—Amy Gross CTM No. 13-1-4 1. Grant of the variance with respect to the accessory pergola and the addition to the principal structure (dwelling)will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The upland area upon which a single-family dwelling exists contains only 22,589 square feet and 120 feet on the easterly lot line between the street and the top o the bluff, or 134 feet from the Coastal Erosion Hazard Line and the street lot line. The dwelling as exists is nonconforming at 17 feet from the top of the bluff at its closest point, and 40.5 feet at the opposite corner to the top of the bluff, making additions on the north and sides of the dwelling difficult to build. The applicant is relocating the driveway to the southwest corner section of the property. The pool equipment will be located on the south side of the dwelling (in the front yard) and screened from view. The land in the rear yard slopes down significantly from the crest of the bluff to the Long Island Sound and encompasses a major portion of the applicant's deeded property. The top of the bluff is oriented northwest to southeast on the eastern half of the property and returns to an east-to-west orientation west of the property. The bluff face is well vegetated with herbaceous and woody vegetation and small to medium locust trees. There are also several large locust trees at the top of the bluff. The applicant has planned additional, new drywells to capture all roof runoff and pool backwash and ensure that water is directed on site and away from the bluff and neighboring areas. Although landscaping is planned to screen the pool and pool equipment from view, the request to locate the pool 18 feet from the street lot line is not compelling to justify approval, as presented, and finds the grant of altemative setback relief at 24 feet from the street line, will allow the 16' by 30' gunite swimming pool to be more conforming to the code's 50 ft. front setback requirement. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. 3. The variance sought for the pergola is not substantial. The proposed pergola will be set back 33 feet from the front yard boundary, compared with 50 foot front yard setback requirement. The variance sought with respect to the yard location of a portion of the existing garage is not substantial. The portion of the garage that will be in a side yard is minimal. The garage itself is 69.8 feet from the front lot line. The setback variance sought with respect to the swimming pool is substantial at the requested 18 ft. setback from the front lot line. It would amount to nearly two- thirds reduction of the code-required 50 feet. 4. The difficulties were self-created. The difficulty with respect to the setbacks from the bluff was created by the applicant but is the result of the original location of the house when constructed many years ago. 5. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the reasonable use of their property, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing Page 4-July 12,2007 L .l ' ZB He No.6045-Amy Gross CTM No. 13-1-4 test under New York Town Law 267-B, motion was offered by Member Simon, seconded by Member Goehringer, and duly carried, to GRANT the relief, as applied for, as shown on the revised May 25, 2007 survey prepared by Joseph A. Ingegno, L. S. and the June 4, 2007 revised site plan, and May 10, 2007 elevation drawings prepared by Ryall Porter Architects, with respect to the addition to the house, accessory pergola and the existing garage; and to DENY the relief concerning the proposed gunite swimming pool as applied for, and in the ALTERATIVE, to GRANT relief for a 16' by 30' swimming pool at 24 feet from the front lot line. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. The following conditions were observed at the property. There is an existing dwelling on the property, which at the closest point is approximately 18 feet from the top of a bluff off Long Island Sound. The land between the dwelling and the bluff top is well vegetated with turf grasses and gently slopes toward the bluff and toward the northeast. Roof gutters and downspouts were not present on the dwelling. The top of the bluff is oriented northwest to southeast on the eastern half of the property and returning to a east to west orientation east of the property. This formed a natural draw or ravine east and north of the dwelling on the upper bluff face. The bluff face is well vegetated with herbaceous and woody vegetation and small to medium locust trees. There are also several large locust trees at the top of the bluff. The proposed additions to the dwelling and property could significantly increase stormwater surface runoff that would surface flow into the ravine and down the bluff face,potentially causing soil erosion and jeopardizing the stability of the bluff. Although drywells are proposed for infiltrating roof runoff water, drainage is not proposed for the other impervious surfaces. The existing gravel driveway is being replaced with an impervious driveway,which increases runoff, and no drainage is proposed for the pergola or terrace. In addition, although a small drywell is proposed for infiltrating pool backwash water, it would be inadequate for end of season draining of the pool. 423 GRIFFING AVENUE . SUITE 110 . Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the denoted following Policy Standards and therefore is INCONSISTENT with the LWRP. Policy 6: Protect and restore the quality and function of the Town of Southold ecosystem. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. The distance from the proposed addition to the top of bluff line is 18 feet; the distance from the proposed pool to the top of bluff is 58 feet; the distance from the proposed pergola to the top of bluff is 57 feet; a minimum separation distance of 100 feet is required pursuant to Chapter § 275-3. In addition, a minimum setback distance of 100 feet is required pursuant to Chapter§ 280-116 A (1) All buildings or structures located on lots adjacent to sounds and upon which there exists a bluff or bank landward of the shore or beach shall be set back not fewer than 100 feet from the top of such bluff or bank. No. 6045) 740 North View Drive, Brown's Hills, Orient,NY 11957 Dear Chairman Dinizio, I am writing in response to letters written by Mr. Thomas McMahon of the Suffolk County Soil and Water Conservation District, dated June 20, 2007, and by Mr. Mark Terry of the Southold Local Waterfront Revitalization Program, dated June 25, 2007. Both letters address our proposal for a house addition and pool at the property of our client, Ms. Amy Gross, and how these new structures related to the bluff that exists on the site. I would first like to clarify some of the issues raised in Mr. McMahon's letter. Our proposal for Ms. Gross's property involves the expansion of her existing permeable gravel driveway. Please note that the expanded area of the driveway will also be gravel, and not an impermeable surface as stated by Mr. McMahon. Also, I would like to point out that the site survey submitted by our office (dated 5/25/07) illustrates a row of staked hay bales around the perimeter of the site to serve as a form of sediment and erosion control during construction. Regarding Mr. McMahon's comments about the inadequate size of the drywell designated for pool backwash, please note that the pool will be constructed of gunite. The pool will therefore be kept full year-round, thus negating the need to drain it at the end of each season. In Mr. Terry's letter, he points out that the proposed pool, pergola and bedroom addition do not meet setback requirements from the 1 r.uu j tlya l l Porter effort to comply with the Southold Town Code to the greatest extent possible. Please note that given the location of the crest of the bluff on this property, no new structure can reasonably satisfy the required 100'0" setback from the bluff and also comply with the 50'-0"front yard setback. We have therefore designed the pool, pergola and addition to mediate between these two setback requirements. In its proposed location, the bedroom addition is no closer the bluff than the existing house, and creates a logical connection to the existing living space that requires a minimal amount of demolition. Please note we have located the pool and pergola in the front yard in order to distance these structures farther from the bluff. I assure you that we have developed our design for Ms. Gross's property with the utmost concern for preserving and protecting the bluff.
