JAMES KELLER & ELISSA SANTISI request a Wetland Permit to construct approx. 54
linear ft. of vinyl bulkhead in place of existing, storm-damaged timber bulkhead; backfill with
approx. 25 cy. clean sand to be trucked in from an upland source and planted with Cape

review pursuant to Chapter 268-3; Items A and B of the Town of South old Town Code.
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the

submitted to this department, as well as the records available to me, it is my recommendation
that the proposed action is exempt from review pursuant to Chapter 268-3, Exempt Minor
Actions, item B which states:
"Replacement, rehabilitation or reconstruction of a structure or facility, in kind, on the same
site, including upgrading buildings to meet building or fire codes, except for structures in areas
designated by the Coastal Erosion Hazard Area (CEHA) law where structures may not be
replaced, rehabilitated or reconstructed without a permit n.

Board of Trustees
Dear Mr. Terry:
Attached please fmd an L WRP Consistency Assessment Form, which is being submitted in
association with an application to the Board of Trustees for a Town Wetlands Permit to remove
and replace an existing timber bulkhead with a vinyl bulkhead,
I have indicated that all policies are "Not Applicable," because pursuant to Town Code 9268-
5(A) and the corresponding definitions of "action" and "minor action" by 9268-3, the submission
of a L WRP Consistency Assessment Form is not required for this application, as the proposed
work entails the replacement of an "existing bulkhead on the applicant's property in the same
location with a silt curtain employed during construction."
Respeqtfully yours,
