MARILYN VOSS, residing at (No #) Main Road, Aquebogue, New York 11931; and
DANIEL'0'BRIEN, residing at 33 Aberdeen Road, Aberdeen, New Jersey 07747,
as point tenants with right of survivorship,
party of the second part,
WITNESSETH,that the party of the first part,in consideration of Ten Dollars and other valuable consideration
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever,
ALL. that certain plot, piece or parcel-of land, with the buildings and improvements thereon erected, situate,
lying and being in the on Lupton's Point in Mattituck, Townof Southold, County of
Suffolk and State of New York, and bounded and described as follows
COMMENCING at a point in the Northeasterly line of Marratooka Road 13.67
feet Southeasterly measured along the Northeasterly line of Marratooka Road from
the Southwesterly corner of land of Elmer Ruland said point of beginning being
the point of intersection of said Northeasterly line of Marratooka Road with the
Southwesterly line of a certain 20 foot private roadway; from said.. point of
beginningrunningalong said Southwesterly line of said 20 foot private roadway
South 71' 39' 20" East 250 feet to a concrete monument;
THENCE South 180 37' 30" West 142.71 feet through a concrete monument
to land formerly of Cedric H. Wickham;
THENCE along said land North 54' 40' 20" West 170.0 feet to said Northeasterly
line of Marratooka Road and;
THENCE running along said Northeasterly line of Marratooka Road North
24' 38' 30" West 127.21 feet to the point or place of BEGINNING.
TOGETHER with a right of way over the 20 foot wide private road to and
from the premises hereby conveyed by Marratooka Road and to and from Deep Hole
Creek at the end of said 20 foot private road where it adjoins Deep Hole Creek

BEING and intended to be the same premises conveyed to the party of the
first part; on 9/24/52, recorded 11/7/52 in Liber 3433, Page 220. RICHARD O'BRIEN

AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost ofthe improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
