In reference to the above, the Planning Board held a work session on September 17,2007 to discuss the submitted letter, approved site plan and resolution, and the June 20, 2007 letter approving changes to the approved site plan. In addition, the Planning Board approves the survey dated September 4,2007 prepared and certified by Nathan Taft Corwin III, L.S. showing the site plan changes as approved by the Planning Board in a letter dated June 20, 2007. This is to inform you that the site plan requirements have been satisfied and include the following items: . All handicap parking stalls, access aisles and signage must comply with New York State Code and ADA requirements. . Box 1179 Southold, NY 11971-0959 Office Location: Town Annex /First Floor, North Fork Bank 54375 Main Road (at Youngs Avenue) Southold, NY 11971 FINDINGS, DELIBERATIONS AND DETERMINATION MEETING HELD SEPTEMBER 14, 2006 ZB File No. 5919 - FHV, LLC Property Location: 6619 Route 25, Laurel CTM 125-1-19.7 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type " category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 1.1645 acre parcel is improved with two (2) existing one story buildings, as shown on the plan prepared by S.L. Maresca Associates, Consulting Engineers, dated 2- 24-03, updated 3-29-03 with landscaping details. BASIS OF APPLICATION: Notice of Disapproval issued by the Building Inspector on January 27,2006 for the reason that the proposed accessory building construction would be in violation of a condition related to the Building Inspector's March 15, 1990 Notice of Disapproval issued for this property, and a Variance determination with Conditions under ZBA Appeal No. 3931, regarding a request for a minimum of 30,000 square feet of land area per use under Zoning Code Section 100-102. Zone District: B General Business. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on August 31, 2006, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: On May 30,1990, the Board of Appeals granted a variance (Appeal No. 3931) to allow a second business use in the B Zone on a property less than 60,000 square feet, with the condition that building #2, used as an electrical contractor business and located in the rear yard of said parcel, would not exceed the 35 x 50 feet as shown on a survey dated Dee 22, 2987 by R. Van Tuyl, The owner/applicant proposes to build a 42 x 16 x 60 foot Morton Building to serve as an accessory warehouse for the storage of vehicles and supplies related to the operation of the two principal businesses on the subject premises, which the Building Inspector states would be a violation of a condition accepted and issued under Appeal No. 3931. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: . Page 2 - September 14, 2006 ZB File No. 5919 - FHV, LLC CTM No. 125-1-19.7 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The application has received site plan approval from the Pianning Board and approval from the Architectural Review Committee. The businesses to the west (a car wash) and the east (Tyler Electric) are heavily screened from views of the subject property by mature evergreens and hedgerow. The proposed accessory storage building (#3) is sited far back from Route 25 and screened by the existing principal building to the north (#1). The site plan dated 2/24106 shows a row of evergreens along the south edge of the proposed accessory structure to further screen it from views from Route 25. The existing two businesses on the subject property, North Fork Custom AudioNideo, and GJS Electric, (building #1 and building #2 respectively on the site plan submitted and dated 2/24106) are similar to other business uses in the area. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than the relief requested. The Building Inspector states that an accessory structure cannot be built in connection with a use related to the second business on the subject premises without a variance from the Board of Appeals. The proposed accessory warehouse does not constitute an expansion of either of the two existing business. 3. The variance granted herein is substantial. The third proposed accessory structure to be used as a warehouse is 2,250 square feet, each of the existing principal buildings (#1 and #2) measure 1,785 square feet each. However, the additional proposed accessory structure does not exceed the allowable iot converge on the subject property. 4. The alleged difficulty has been self-created because the owner/applicant chose to build an accessory storage structure that will be used for storage for both of the two businesses on the subject premises in violation of a condition set forth in ZBA Appeal No. 3931 dated May 30,1990. 5. No evidence has been submitted to suggest that the proposed additions will have an adverse impact on physical or environmental conditions in the neighborhood. Potential ground water runoff toward Route 25 on this north/south sloping property will be controlled by proper drainage and infrastructure as shown on the site plan dated 2/24106. 6. Grant of the requested variance is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new accessory building to a second business on the subject property, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the baiancing test under New York Town Law 267-B, motion was offered by Member Weisman, seconded by Chairwoman Oliva, and duly carried, to GRANT the variance as applied for, as shown on Drainage and Site Plan dated February 24, 2006 by S. L. Maresca Associates, Consulting Engineers, and elevation diagram prepared by Allied Design Architectural & Engineering Group, P.C. subject to the following condition: That the proposed accessory structure be used only for warehouse storage and not for the expansion of either of the two existing principal business uses on the subject premises. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. Handicap Space: Enlarging it slightly and sliding it south so that it enables access to the door. It would attach to the existing apron so that the accessibility to tlte door is enabled. As it is presently shown, there would be gravel between the handicap space and the doorway, which would defeat the purpose. B. A concrete retaining wall has been added just nortlt of the new Morton building, with rebar and gussets, to lessen the steepness of the grade and direct the water runoff more directly to the drain. The parking has not been compromised, as there is still more tltan 22 feet between tlte front and rear parking spaces. The wall extends above tlte parking area approximately twelve inches, is away from the building six feet, and there is no possibility of a vehicle being able to come in contact with the building. In conjunction with this, since tlte walls elevates over grade level approximately 8 inches, it was suggested to us that the wall act as the curb stop in the parking areas, and that the curb stops for the automobiles would not be necessary. C. We would like to shift over the Belgian block border to the east as drawn in, as tlte way it is proposed now, would lead into the pre-existing fence where tltere is no opening. The amount of grass would remain the same, as the width oftlte driveway would remain tlte same. It is just to shift tlte connection between tlte lower and the upper parking areas to tlte east. D. We would like to raise tlte top cover of two drywells - DW7 and DW8 approximately 6 inches. This is because the way the drywells are now set to grade, coordinating witlt the state codes with the entrance, tlte grade does not allow for trucks with a trailer to enter. The grade is basically tlte same, and if there is a concern regarding the lower drywell taking on more water, all of the drywells are connected to each other and will be taking on tlte same amount of water. We are also checking witlt the state to see if we can add a 6" trench drain at the entrance, where the concrete apron ends, tying it in with the existing drywells there, to enhance the approved drainage plan. " Page 2 E. Lastly, where the dumpster is shown on the lower level, we would like to move that to an upper area where it will not be visible from the road. That area where it was proposed to be, we would like to extend, as shown on the plan, the Belgian block, and add a little landscaping. This would be in the form of a small stacking wall. We believe it will coordinate with the existing landscape and grade better, and be more pleasing aesthetically. If there are any questions or problems with the above, I would be happy to explain allm more detail, and would appreciate any suggestions in regards to the above. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector issues a Certificate of Occupancy. f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an addition six months. Thereafter, a new permit shall be required.
