Dear Mr. Stankewicz:
At the written request of Gerard Stankewicz date received September 13, 2007 requesting final site plan
inspection, Planning Department staff performed a site visit on September 17, 2007. In reference to the
above, the Planning Board held a work session on September 17,2007 to discuss the submitted letter,
approved site plan and resolution, and the June 20, 2007 letter approving changes to the approved site plan.
In addition, the Planning Board approves the survey dated September 4,2007 prepared and certified by
Nathan Taft Corwin III, L.S. showing the site plan changes as approved by the Planning Board in a letter
dated June 20, 2007.
This is to inform you that the site plan requirements have been satisfied and include the following items:
. All handicap parking stalls, access aisles and signage must comply with New York State Code
and ADA requirements.
. All outdoor lighting shall be shielded so that the light source is not visible from adjacent
properties and roadways. Lighting fixtures shall focus and direct the light in such a manner as to
contain the light and glare within property boundaries. All lighting must meet town code
reqrurements.
· As per landscape survivability, the applicant agrees to replace any of the landscaping which dies
within three (3) years of planting.
· As per Town Code ~280-127, "any change in use or intensity of use which will affect the
characteristics of the site in terms of parking, loading, access, drainage, open space or utilities
will require site plan approval".
· As per the final resolution dated November 16, 2006 and the Declaration of Covenants &
Restrictions made December 5, 2006, the applicant continues to agree to the future cross
easement with the property to the east.

· All signs shall meet Southold Town Zoning Codes and shall be subject to approval of the
Southold Town Building Inspector.

FINDINGS, DELIBERATIONS AND DETERMINATION
MEETING HELD SEPTEMBER 14, 2006

SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this
application and determines that this review falls under the Type " category of the State's List of Actions,
without an adverse effect on the environment if the project is implemented as planned.
PROPERTY FACTS/DESCRIPTION: The applicant's 1.1645 acre parcel is improved with two (2) existing one
story buildings, as shown on the plan prepared by S.L. Maresca Associates, Consulting Engineers, dated 2-
24-03, updated 3-29-03 with landscaping details.
BASIS OF APPLICATION: Notice of Disapproval issued by the Building Inspector on January 27,2006 for the
reason that the proposed accessory building construction would be in violation of a condition related to the
Building Inspector's March 15, 1990 Notice of Disapproval issued for this property, and a Variance
determination with Conditions under ZBA Appeal No. 3931, regarding a request for a minimum of 30,000
square feet of land area per use under Zoning Code Section 100-102. Zone District: B General Business.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on August 31, 2006, at which time
written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of
the property, and other evidence, the Zoning Board finds the following facts to be true and relevant:
AREA VARIANCE RELIEF REQUESTED: On May 30,1990, the Board of Appeals granted a variance (Appeal
No. 3931) to allow a second business use in the B Zone on a property less than 60,000 square feet, with the
condition that building #2, used as an electrical contractor business and located in the rear yard of said parcel,
would not exceed the 35 x 50 feet as shown on a survey dated Dee 22, 2987 by R. Van Tuyl, The
owner/applicant proposes to build a 42 x 16 x 60 foot Morton Building to serve as an accessory warehouse for
the storage of vehicles and supplies related to the operation of the two principal businesses on the subject
premises, which the Building Inspector states would be a violation of a condition accepted and issued under
Appeal No. 3931.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal
inspections, the Board makes the following findings:

1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a
detriment to nearby properties. The application has received site plan approval from the Pianning Board and
approval from the Architectural Review Committee. The businesses to the west (a car wash) and the east
(Tyler Electric) are heavily screened from views of the subject property by mature evergreens and hedgerow.
The proposed accessory storage building (#3) is sited far back from Route 25 and screened by the existing
principal building to the north (#1). The site plan dated 2/24106 shows a row of evergreens along the south
edge of the proposed accessory structure to further screen it from views from Route 25. The existing two
businesses on the subject property, North Fork Custom AudioNideo, and GJS Electric, (building #1 and
building #2 respectively on the site plan submitted and dated 2/24106) are similar to other business uses in the
area.
2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to
pursue, other than the relief requested. The Building Inspector states that an accessory structure cannot be
built in connection with a use related to the second business on the subject premises without a variance from
the Board of Appeals. The proposed accessory warehouse does not constitute an expansion of either of the
two existing business.
3. The variance granted herein is substantial. The third proposed accessory structure to be used as a
warehouse is 2,250 square feet, each of the existing principal buildings (#1 and #2) measure 1,785 square
feet each. However, the additional proposed accessory structure does not exceed the allowable iot converge
on the subject property.
4. The alleged difficulty has been self-created because the owner/applicant chose to build an accessory
storage structure that will be used for storage for both of the two businesses on the subject premises in
violation of a condition set forth in ZBA Appeal No. 3931 dated May 30,1990.
5. No evidence has been submitted to suggest that the proposed additions will have an adverse impact on
physical or environmental conditions in the neighborhood. Potential ground water runoff toward Route 25 on
this north/south sloping property will be controlled by proper drainage and infrastructure as shown on the site
plan dated 2/24106.
6. Grant of the requested variance is the minimum action necessary and adequate to enable the applicant to
enjoy the benefit of a new accessory building to a second business on the subject property, while preserving
and protecting the character of the neighborhood and the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the baiancing test under
New York Town Law 267-B, motion was offered by Member Weisman, seconded by Chairwoman Oliva, and
duly carried, to
GRANT the variance as applied for, as shown on Drainage and Site Plan dated February 24, 2006 by
S. L. Maresca Associates, Consulting Engineers, and elevation diagram prepared by Allied Design
Architectural & Engineering Group, P.C. subject to the following condition:
That the proposed accessory structure be used only for warehouse storage and not for the expansion
of either of the two existing principal business uses on the subject premises.
Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams
or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This
action does not authorize or condone any current or future use, setback or other feature of the subject property that may
violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action.
The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not

increase the degree of nonconformity.

Dear Mr. Stankewicz:
The Planning Board, at their work session on Monday, June 4, 2007, reviewed your request, dated June 1,
2007 (attached), and approves the following changes to the approved site plan:
. Rearranging the proposed handicap parking space to allow for handicap access to the existing 51' x
35' building (building # 2). All handicap parking stalls and access aisles must comply with New York
State Code and ADA requirements.
. The installation of a concrete wall to the north of the proposed 42' x 60' building. The proposed
wall will not require additional bumpers for parking.
. The shift in the proposed Belgium block lined stone driveway to the east to allow for better access
to the rear portion of the site. The Planning Board approves this shift in the driveway provided
that:
o The size (square feet) of the driveway will remain the same.
o The vegetative border between the subject parcel and the parcel to the east will be
maintained.
o The area to the west of the proposed driveway will be maintained with grass.
. Moving the dumpster from the proposed location (near building # 1) to the northern portion of the
site where it will not be visible from the road. The Planning Board approves the relocation of the
dumpster and reserves the right for further comment at the time of fInal site plan inspection to
ensure the dumpster is adequately screened.
. Extend the proposed Belgium block curbing and add a small stacking wall extending from the
proposed gravel driveway north of existing building # 1.
. Raise the top cover of 2 drywells (DWl & DW8) approximately 6 inches. The Planning Board and
Town Engineer approves the raising of these covers and the installation of a 6" trench drain north
of the concrete apron provided that written approval from NYSDOT is obtained prior to
construction and all water is adequately maintained on site. Written approval from NYSDOT
should be submitted to this office for the file.

All construction must comply with Town Code. This letter will serve as permission from the Planning
Board for these proposed changes.
Once all site work is complete please submit a request in writing for a final site inspection for site plan
satisfaction. As referenced in your letter, please submit three (3) copies of the as-built site plan along with
your request.
This letter does not condone any other site plan changes and or approvals from other agencies if required.

Dear Sirs,
Attached is a copy of the site plan with the following changes requested:
A. Handicap Space: Enlarging it slightly and sliding it south so that it enables
access to the door. It would attach to the existing apron so that the
accessibility to tlte door is enabled. As it is presently shown, there would be
gravel between the handicap space and the doorway, which would defeat the
purpose.
B. A concrete retaining wall has been added just nortlt of the new Morton
building, with rebar and gussets, to lessen the steepness of the grade and
direct the water runoff more directly to the drain. The parking has not been
compromised, as there is still more tltan 22 feet between tlte front and rear
parking spaces. The wall extends above tlte parking area approximately
twelve inches, is away from the building six feet, and there is no possibility
of a vehicle being able to come in contact with the building. In conjunction
with this, since tlte walls elevates over grade level approximately 8 inches, it
was suggested to us that the wall act as the curb stop in the parking areas,
and that the curb stops for the automobiles would not be necessary.
C. We would like to shift over the Belgian block border to the east as drawn in,
as tlte way it is proposed now, would lead into the pre-existing fence where
tltere is no opening. The amount of grass would remain the same, as the
width oftlte driveway would remain tlte same. It is just to shift tlte
connection between tlte lower and the upper parking areas to tlte east.
D. We would like to raise tlte top cover of two drywells - DW7 and DW8
approximately 6 inches. This is because the way the drywells are now set to
grade, coordinating witlt the state codes with the entrance, tlte grade does not
allow for trucks with a trailer to enter. The grade is basically tlte same, and if
there is a concern regarding the lower drywell taking on more water, all of
the drywells are connected to each other and will be taking on tlte same
amount of water. We are also checking witlt the state to see if we can add a
6" trench drain at the entrance, where the concrete apron ends, tying it in
with the existing drywells there, to enhance the approved drainage plan.

E. Lastly, where the dumpster is shown on the lower level, we would like to
move that to an upper area where it will not be visible from the road. That
area where it was proposed to be, we would like to extend, as shown on the
plan, the Belgian block, and add a little landscaping. This would be in the
form of a small stacking wall. We believe it will coordinate with the existing
landscape and grade better, and be more pleasing aesthetically.
If there are any questions or problems with the above, I would be happy to explain
allm more detail, and would appreciate any suggestions in regards to the above.
All items would be shown on the final survey submitted to the town when applying
for the final C of O. Thank you.

WHEREAS, this amended site plan is for the proposed new construction of a 2,520 square foot 1
story building for warehouse/storage which includes a site plan change in parking to 26 required
spaces, 29 provided on 1.1645 acres in the General Business Zone located on the n/s/o New York
State Road 25, approximately 250' w/o Laurel Trail known as 6619 Main Road in Mattituck. SCTM #:

WHEREAS, FHV, LLC is the owner of the property located on the n/s/o New York State Road 25,
approximately 250' w/o Laurel Trail known as 6619 Main Road in Mattituck; and
WHEREAS, on April 9, 1984, the Southold Town Planning Board granted site plan approval for a 35'
x 50' building for a tree service building; and
----WHER~n March 9, 1987, the SoutOOkl--Town PI::mning BomdiJfBfltcd an amended site plan
approval for "a 35' x 50' storage building accessory to the existing building"; and
WHEREAS, on December 9,1991, the Southold Town Planning Board granted an amended site plan
approval for a change in use from Shamrock Tree Company to Acrylic Duck Marine Canvas; and
WHEREAS, on October 4,2004 the Southold Town Planning Board granted conditional final approval
for the alteration of an existing 1,785 sq. ft. building on the site plans prepared and certified by John
C. Ehlers, Surveyor, dated June 13,2004 and last revised September 21,2004 subject to final
approval from the New York State Department of Transportation; and

WHEREAS, on December 14, 2004, the Southold Town Planning Board granted final approval for an
amended site plan for the alteration of an existing 1,785 sq. ft. building on the site plan prepared and
certified by John C. Ehlers, Surveyor, dated June 13, 2004 and last revised September 21,2004; and
WHEREAS, on March 29, 2006, the agent, William S. Kelly working for the applicant, North Fork
Custom Audio & Video, submitted an amended site plan application for approval; and
WHEREAS, on May 4, 2006, the Architectural Review Committee reviewed the architectural drawings
and associated site plan materials and approved the project as submitted; and
WHEREAS, on May 30, 2006, the Building Department amended the Notice of Disapproval to
address the previously issued ZBA decision appeal #3931 which stated "...a second business that
will not exceed 35 X 50 ft.. ."; and
WHEREAS, on May 31,2006, the Southold Town Engineer reviewed the proposed site plan and
requested further information; and
WHEREAS, on June 14, 2006, the Mattituck Fire District responded that no additional water supply is
required and that all drives and roads meet Town requirements; and
WHEREAS, on June 21,2006, the Suffolk County Department of Planning responded after review
and determined this matter is for "local determination as there appears to be no significant county-
wide or inter-community impact(s)" and the Planning Board accepts this pursuant to 239L & M
General Municipal Law; and
/ WHEREAS, on June 22, 2006, New York State Department of Transportation responded that the
previously issued Highway Work Permit #10-04-0509 expired on June 1, 2005 and a permit extension
would be required; and
/ WHEREAS, on July 7, 2006, the agent was forwarded a copy of the New York State Department of
Transportation letter dated June 22, 2006; and
WHEREAS, on September 12, 2006, the Southold Town Planning Board, acting under the State
Environmental Quality Review Act (6 NYCRR), Part 617.5 c, makes a determination that the
proposed action is a Type II and not subject to review; and
WHEREAS, on September 14,2006, the Southold Town Zoning Board of Appeals granted an area
"ariance relief as applied for and described under Appeal #5919 to build "042 x 16 x 60 ft. Morton
building to serve as an accessory warehouse for the storaQe of vehicles and supplies related to the
operation of the two principal businesses" and with the following condition:
1. That the proposed accessory structure be used only for warehouse storage and not for the
expansion of either of the two existing principal business uses on the subject premises; and

WHEREAS, on September 20, 2006, the Suffolk County Water Authority responded after review that
there is an existing water main and one (1) inch service serving the above captioned property from
Main Road; and
WHEREAS, on October 23,2006, the Southold Town Building Inspector reviewed and certified the
site plan for a "Accessory Warehouse Storage" use; and
WHEREAS, on October 25, 2006, the Southold Town Engineer reviewed the revised site plan
materials and replied that all items have been addressed in a satisfactory manner; and
WHEREAS, the Southold Town Planning Board, pursuant to Chapter 58, Notice of Public Hearing,
has received affidavits that the applicant has complied with the notification provisions; and
WHEREAS, the following items shall be required:
1. The applicant agrees to be bound by all of the requirements in the Declaration of Covenants &
Restrictions for a cross access easement agreement date received November 13, 2006
pending review and approval from the Town Attorney and the Southold Town Planning Board.
2. All outdoor lighting shall be shielded so that the light source is not visible from adjacent
properties and roadways. Lighting fixtures shall focus and direct the light in such a manner as
to contain the light and glare within property boundaries. The lighting must meet town code
requirements.
.4. All signs shall meet Southold Town Zoning Codes and shall be subject to approval of the
Southold Town Building Inspector.
4. As per the landscape survivability guarantee, the applicant agrees to replace any of the
landscaping which dies within three (3) years of planting; be it therefore
RESOLVED, that the Southold Town Planning Board has reviewed the proposed action under the
policies of the Town of South old Local Waterfront Revitalization Program and has determined that the
action is consistent with the Policy Standards in the July 31,2006 memo prepared by the LWRP
Coordinator; and be it further
RESOLVED, that pursuant to Southold Town Code 100-254 Part I, the applicant agrees to
incorporate all the requirements, comments, and recommendations of each reviewing agency as
ref.erenced~oo'le and as indicated on the site plan and corresponding 3tt3chmonts; and be itfurthcr
RESOLVED, that the Southold Town Planning Board grant approval on the site plan drawing 0-1 &
0-2 prepared and certified by Steven L. Maresca dated February 24, 2006 and last revised November
9,2006 and the construction plans G1 and S1-S6 prepared and certified by Ronald L. Sutton and
authorize the Chairperson to endorse the site plans with the following conditions:
1. Pending final approval of the Declaration of Covenants & Restrictions by the South old Town
Planning Board, the applicant agrees to file and record Declaration of Covenants &
Restrictions for a cross access agreement in the Office of the Suffolk County Clerk within sixty

(60) days of site plan approval. A copy of the filed Declaration of Covenants & Restrictions for
a cross access agreement must be submitted to the Southold Town Planning Department
within thirty (30) days of receipt. If the applicanUagenUowner fails to adhere to this
requirement within the prescribed time periods, this approval shall become null and void.
2. The site plan approval requires that all work proposed on the site plan shall be completed
within three (3) years from the date of this resolution.
3. If necessary, the applicanUagenUowner shall obtain certification from a design professional for
the existing septic system or approval from Suffolk County Department of Health Services for
the approved construction. This approval must be to the satisfaction of the Southold Town
Building Department. If the septic approval changes from the approved site plan, the Planning
Board reserves the right to the review of a new site plan application.
4. Prior to the request for the Certificate of Occupancy, the owner or authorized agent must
request, in writing, the said Building Inspector and the Planning Board to perform an on-site
inspection to find the site improvements are in conformity with the approved amended site
plan.
5. Prior to the request for an on-site inspection, the applicanUagenUowner must submit a copy of
all required approvals from any necessary agencies to the Southold Town Planning
Department.
6. The applicant agrees to obtain a valid New York State Department of Transportation Highway
Work Permit as required in their letter dated June 22, 2006 within sixty (60) days of site plan
approval. A copy of this approval and plan must be submitted to the Southold Town Planning
Department within thirty (30) days of receipt. All conditions of New York State Department of
Transportation Highway work permit #10-04-0509 must be completed. Any changes in the
approved permit must be submitted to this office for review. If such approval varies from this
approved site plan, the Planning Board reserves the right to review a new site plan.
7. If the as-built site improvements vary from the approved amended site plan, the Planning
Board reserves the right to request a certified as-built site plan detailing all the changes.
8. Any changes from the approved site plan shall require Planning Board approval, and any such
changes without Planning Board approval will be subject to referral to the Town Attorney's
Office for possible legal action.
The Planning Board will issue a final site plan approval in the form of a letter following a site
inspection and at the time the site improvements are found to be in conformance with the approved
site plan.
A copy of the approved amended site plan is enclosed for your records. As per the Town Code, one
copy each will be distributed to the Building Department, Town Engineer/Highway Department and
Zoning Board of Appeals.

d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such a permit

e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Thereafter, a new permit shall be required.
