In reference to the above, the Planning Board held a work session on September 17, 2007 to discuss the submitted letter, approved site plan and resolution, and the June 20, 2007 letter approving changes to the approved site plan. In addition, the Planning Board approves the survey dated September 4, 2007 prepared and cettified by Nathan Taft Corwin III, LS. showing the site plan changes as approved bythe Planning Board in a letter dated June 20, 2007. This is to inform you that the site plan requirements have been satisfied and include the following items: · Al1 handicap parking stalls, access aisles and signage must comply with New York State Code and ADA requirements. · All outdoor lighting shall be shielded so that the light source is not visible from adjacent properties and roadways. Lighting fixtures shah focus and direct the light in such a manner as to contain the light and glare within property boundaries. All lighting must meet town code requirements. · As per landscape survivability, the applicant agrees to replace any of the landscaping which dies within three (3) years of planting. · As per Town Code 3280-127, "any change in use or intensity of use which will affect the characteristics of the site in terms of parking, loading, access, drainage, open space or utilities will require site plan approval". · AS per the final resolution dated November 16, 2006 and the Dechration of Covenants & Restrictions made December 5, 2006, the applicant continues to agree to the future cross easement with the propenyto the east. Box 617 Cutchogue, NY 11935 Re: Proposed Site Plan for North Fork Custom AudioNideo Located at 6619 Main Road, Mattituck SCTM#1000-125-1-19.7 Zoning District: B Dear Mr. Fitzgerald: The following resolution was adopted at a meeting of the Southold Town Planning Board on Monday, October 4, 2004: The final public hearing was closed. WHEREAS, the applicant proposed an amended site plan for alteration of an existing building of 1,785 sq. ft. on a 1.16 acre parcel in the B Zone located; and WHEREAS, FHV, LLC is the owner of the property known as 6619 Main Road located on the n/s/o New York State Route 25, approximately 4,755' e/o Aldrich Lane, in Mattituck, SCTM#1000-125-1-19.7; and WHEREAS, on May 24, 2004, a formal site plan application was submitted for approval; and WHEREAS, on June 15, 2004, the Southold Town Planning Board, acting under the State Environmental Quality Review Act (6 NYCRR), Part 617.6, makes a determination that the proposed action is a Type II and not subject to r~view; and WHEREAS, on June 24, 2004, the Mattituck Fire District found adequate fire protection for this site plan and the Planning Board has accepted this recommendation; and WHEREAS, on August 3, 2004, the Architectural Review Committee reviewed the architef:tural drawings and associated site plan materials and determined they were satisfactory; and · North Fork Custom AudioNideo - PaRe Two - 1.0/5/04 WHEREAS, on September 10, 2004, the New York State Department of Transportation issued the Case Number 04-163P for the Work Permit Application; and WHEREAS, on September 17, 2004, the Southold Town Engineer reviewed and approved the proposed drainage and the Planning Board has accepted the recommendation; and WHEREAS, on October 4, 2004, the Southold Town Building Inspector reviewed and certified the site plan; and WHEREAS, the Southold Town Planning Board, pursuant to Chapter 58, Notice of Public Hearing, has received affidavits that the applicant has complied with the notification provisions; and WHEREAS, the following items are incorporated and included in the site plan: 1. Very truly yours, Chairperson AFFIDAVIT OF JOSEPH SHIPMAN I purchased the premises, 6619 Main Road, Mattituck, NY 11952, in 1983 SCTM: 1000 - 125 - 1 - 19.7. I built the from building in 1984. I ran my business, Shamrock Tree Expert Co., out of that building for eight or nine years. Shamrock is in the business of tree maintenance. Shamrock is a service business. The Shamrock equipment and office was located at the premises. When Shamrock moved to another location, I leased the building to an awning company and then a package and mailing company, and finally to a small equipment sales and repair company, Northeastern Lawn and Garden Equipment, which leased the premises from me until early 2004 when I sold the premises to FHV LLC d/b/a Featherhill Village. Northeastern Lawn and Garden Equipment had an office at the premises and used the premises to store it's rental equipment and also sold on the retail market equipment to the public. The back building was constructed in 1990. It was originally leased to S&L Irrigation for storage and warehousing of irrigation supplies. It was then leased to Hallock Produce as a storage and shipping point for produce. Hallock Produce wholesaled vegetable product to restaurants and warehoused the product at the premises. Finally, the back building was leased by the equipment company, Northeastern, that was already leasing the front building.
