Dear Ms. Star:
I am in receipt of your correspondence dated March 16, 2017. In the normal
beach front situation I would agree with your assessment. However, my
neighbor to the east and our property are uniquely situated.
Several years ago, my neighbors to the east (Gilchrist) reduced the length of
their groin at the request of the DEC, which caused a loss of beach to the
extent they have no beach at high tide.
The beach in front of our house has been consistently maintained since I can
remember (40 years) because of the length of the groin, until our neighbors
to the east (Gilchrist) reduced the length of thier groin. This immediately
caused our neighbor to experience a total loss of beach at high tide. If we
reduce the groin as you propose, we will lose our beach at high tide.
Southold Town will lose public beach to the west at high tide as well.

Dear Ms. Star:
I am in receipt of your correspondence dated July 13, 2017. If the only
reason for the decrease in my neighbor's groin was because it was
deteriorated and non functioning, then why do you seek a reduction in the
length of our groin, which is functioning and not deteriorating.
I have witnessed first hand the reduction in my neighbor's beach at high tide
since their groin was reduced in length. Also, I have witnessed the reduction
in the east side of our beach at high tide since our neighor's groin was
reduced.
I do not like the visual effect that the groin has, but it maintains our beach
and the Town Beach. Please grant my application, or deny it so I can go
through the appeal process.
I respectfully ask you to grant my application.

Meeting held on Wednesday, July 23, 2008:
RESOLVED, that the Southold Town Board of Trustees APPROVE the Amendment to
Permit #6682 to allow for the installation of 6'x3' steps, and as depicted on the revised
site plan prepared by En-Consultants, last dated August 6, 2007, and received on July
16, 2008.
Any other activity within 100' of the wetland boundary requires a permit from this office.
This is not a determination from any other agency.

TERMS AND CONDITIONS
The Permittee William C. Goggins. residing at 1780 Jackson Street. New Suffolk. New York,
as part of the consideration for the issuance of the Permit does understand and prescribe to the
following:
1. That the said Board of Trustees and the Town of South old are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
2. That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That if future operations of the Town of South old require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
8. The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Department of Real Properties Office as a notice
covenant and deed restriction to the deed of the subject parcel. Such evidence shall be
provided within ninety (90) calendar days of issuance of this permit.
9. That the said Board will be notified by the Permittee of the completion of the work
authorized.
10. That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.

Dear Mr. Goggins:
The Board of Town Trustees took the following action during its regular meeting held on
Tuesday, July 24, 2007 regarding the above matter:
WHEREAS, WILLIAM C. GOGGINS applied to the Southold Town Trustees for a permit
under the provisions of Chapter 275 of the Southold Town Code, the Wetland
Ordinance of the Town of Southold, application dated April 26, 2007, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, in accordance with Chapter 268, said application was found to be Exempt
from the Local Waterfront Revitalization Program policy standards, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on July 24,2007, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,

WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of WILLIAM C.
GOGGINS to replace the existing timber groin with new 45' low-profile vinyl groin
starting at 2' from the top of the existing bulkhead, replace existing timber bulkhead with
+/-73' vinyl bulkhead, construct 4' x 3' steps, and install a 10' x 60' long pervious buffer
landward of the bulkhead, and as depicted on the plans prepared by EN-Consultants,
Inc., last revised August 6,2007 and received September 13, 2007.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

The Department of State received your Federal Consistency Assessment Form and consistency
certification and supporting information regarding the above matter.
Pursuant to 15 CFR Part 930.58, the following necessary data and information is required to
enable the Department of State to adequately assess and undertake its review of the coastal zone
effects of this proposed activity;
Please provide a copy of the deed with a metes and bounds description to support a survey map
to document the applicant's ownership of the lands on which the proposed bulkhead would be
reconstructed. It is also necessary to identify the owners of the underwater lands abutting your
clients property. This information is necessary to assess the consistency of the proposed
activity with State Coastal Policies #2, #19, and #20, and to ensure that the existing bulkhead
and/or proposed replacement does not conflict with other water-dependent uses, public access
or recreation of coastal resources or lIses.
Policy #14 ofthc State's Coastal Management Program addresses the construction or
reconstruction of an erosion protection structure. Within the explanation of this policy, thc use
of erosion protection structures such as groins, or the use of impermeable docks which block thc
littorallransport of scdiment to adjaccnt shorelands can increase the scverity and adverse effects
of natural processes. The construction or reconstruction of crosion protection structures shall be

undertaken so there will be no measurable increase in erosion or flooding at the site of such
activities or development, or at other locations.

Please provide a thorough analysis clearly discussing the necessity of the proposed groin, it's
repair, and the impact of the groin on neighboring properties and upon sediment transport.
Please pay particular attention to policy #14. lfthe proposed groin is determined to be
necessary and an evaluation of alternatives to the groin prove infeasible, please confirm that
every effort to protect nearshore sediment transport would be made. If the existing groin is
determined to be unnecessary, and the plan is modified only to replace the existing groin to
the ordinary high water line, such a project may be eligible for a general concurrence by the
Department.
Given the originally submitted information, your proposed activity does not appear to be
consistent with CMP Policy #14. Therefore, upon preliminary review, DOS intends to object to
your consistency certification. lfthe Department does not concur with the consistency
certification provided for this proposed activity, the consistency provisions of the federal
Coastal Zone Management Act prohibit federal agency authorization of the activity.
To avoid the Department's objection to your consistency certification, either modify the
proposal to reduce or remove the groin, or withdraw your consistency certification. The
Department recommend you do so within 30 days (before June 21,2007) or the Department may
object to your consistency certification immediately thereafter.

The Department of State received your modified plans on August 10, 2007, regarding the above referenced proposal.
The modified proposal involves replacement of the originally proposed 63' of timber groin with a vinyl groin of 45' in length
and the replacement of73' of the existing bulkhead in-place with vinyl as illustrated on the revised drawings dated 8/6/07.
The Department of State has determined that this proposed activity, which has heen modified to be consistent with the New
York Coastal Management Program, meets the Department's general consistency concurrence criteria. Therefore, further
review of the proposed activity by the Department of State, and Department's concurrence with an individual consistency
certification, are not required.

At the meeting of the Southold Town Conservation Advisory Council held Mon., June
11,2007, the following recommendation was made:
Moved by Don Wilder, seconded by Jack McGreevy, it was

replace the existing timber groin with new +/-63' low-profile vinyl groin, replace existing

Dear Mr. Goggins:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, September 22, 2004 regarding the above matter:
WHEREAS, WILLIAM GOGGINS applied to the Southold Town Trustees for a permit
under the provisions of Chapter 97 of the South old Town Code, the Wetland Ordinance
of the Town of Southold, application dated August 23,2004, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on September 22, 2004, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 97 of the
Southold Town Code,

WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
RESOLVED, that the Board of Trustees approve the application of WILLIAM C.
GOGGINS to add top soil to site for regrading purposes due to replacement of septic
system, install a 6' wide deck parallel to the bulkhead on the upland side of the
bulkhead and remove the turf under the deck, install a 6' wide deck parallel to the house
24' in length and remove the turf under the deck to provide for drainage, replace the
bulkhead in-kind, in place with the same elevation with vinyl, renovate the existing
dwelling and add gutters and drywells to contain roof runoff, replace existing +/-61.5'
jetty with a vinyl low profile jetty, with the condition the white picket fence on top of the
jetty is removed within 30 days from the date of this permit and boat racks must be
stored above. high water landward of the bulkhead, and plans submitted for the low
profile jetty before the work begins on the jetty, and all as depicted in the plan surveyed
by Stanley Isaksen, Jr. dated May 4, 1998 and the site plan submitted by Mr.Goggins
and received in the Trustee Office October 1, 2004.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)
This is not a determination from any other agency.

Dear Sir/Madam:
In connection with the above referenced matter, enclosed please find the

stability of the beach and our property.
We consent to the 10 foot non disturb buffer and the expansion of the deck
as applied for extending the width of the deck from 6 foot to 10 foot. Also,
we have no objection to increasing the height of the bulkhead by 1 foot.
However, we strongly object to decreasing the length of the groin. The
Decrease in the length of the groin will result in the loss of our beach and
extensive erosion of our property over time. Also, it will result in the loss of
the public beach to the west.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of South old Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the L WRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation
that the proposed action is exempt from review pursuant to Chapter 268-3, Exempt Minor
Actions, item B which states:
"Replacement, rehabilitation or reconstruction of a structure or facility, in kind, on the same
site, including upgrading buildings to meet building or fire codes, except for structures in areas
designated by the Coastal Erosion Hazard Area (CEHA) law where structures may not be
replaced, rehabilitated or reconstructed without a permit ".
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing
its written determination regarding the consistency of the proposed action.

A. INSTRUCTIONS
I. All applicants for permits. including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. · Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of South old Town).
3. If any question in Section C on this fonn is answered "yes" or "no", then the proposed action will
affect the achievement of the L WRP policy standards and conditions contained in the consistency
review law. Thus. each answer must be explained in detail. listing both supporting and non-
