The meeting began at 7:22 p.m. with four LPC members present. Adoption of Meeting Minutes: ?? Adoption of LPC meeting minutes – HOLD due to time constraints Applications: EXECUTIVE SESSION. Melissa Spiro’s confidential staff report dated 10/15/07 distributed to LPC members and reviewed.This is a small farm. Landowner wants to reserve 40,000 sq feet for existing residential structure. Code requres 80,000 sq feet per house. Lot can be one acre but the additional one acre required by Code is considered unbuildable land and is not eligible for PDR payment. Development right easement can be 7 acres, as offered, but Town can only pay for 6 buildable acres due to 80,000 sq ft requirement. MOTION made by Lillian Ball, seconded by John Sepenoski, to authorize Melissa Spiro to present a purchase offer to Ficner landowners for a development rights easement on agricultural land. The Committee’s offer is based on an aerial sketched plan showing a Reserve Area of approximately one (1) acre located around the existing residental structure. The acquisition area is to be approximately seven (7) acres but only six (6) acres is considered building acreage to be acquired using CPF funds. Additional restriction within the easement will include limiting ag structures within the easement to an area of approximately three (3) acres on the northerly side of the lot. The purpose of this acquisition located within the A-C zoning district is for farmland and scenic protection. Motion carried: 4/1 (Ray Huntington) Chris Baiz absent from vote. ?? Melissa’s staff report dated 10/16/07 distributed and reviewed. Tim Caufield had met with landowners as well as Melissa and Melanie during a site visit on October 15, 2007. Lillian and Ray also viewed the property for possible purchase of development rights easement. Site is an active farm with small farmstand on CR 48. MOTION made by Eric Keil, seconded by John Sepenoski, to direct Melissa Spiro to authorize an appraisal of the Carucci property. A Reserve Area of 1.5 acres would be located around the existing residential structure and a .5± acre area would be reserved around the existing farmstand along CR 48. No further residential dwellings would be allowed to be built on the property including reserve areas and ag structures would be limited to south side of property behind existing house and greenhouses within the easement area. LPC would like to see building envelope for Lots #1 (more toward “triangle” part of lot) and #7 (away from “center” of property, more to south) relocated and curving road changed to a more linear roadway. ?? Project for a conservation subdivision was first presented by landowner to LPC in 2005 and LPC did not proceed with an appraisal as members were not in favor of layout of the conservation subdivision. Landowner then applied to Planning Board for a standard subdivision which is now in final stages of Planning Board review. Petition to preserve property presented to Town Board at 10/9/07 Town Board work session. On October 9, 2007, landowner submitted an application to LPC for fee title acquisition to both lots. MOTION made by Lillian Ball, seconded by Monica Harbes, to direct Melissa Spiro to commission an appraisal for fee title acquisition to both parcels for open space preservation purposes. Melissa Spiro met twice with landowner since last LPC meeting and explained to landowner LPC’s position regarding the affect of purchase offer previously offered to landowner if he wished to change original concept plan by creating a reserved area for future residential development. Landowner gave Melissa a counter-offer with elimination of potential building area. MOTION made by Eric Keil to present two distinct purchase offers to Demchak landowners: 1) to increase offer if no residential lot reserved providing appraisal supports increase; and 2) decrease original purchase offer is landowners wants a reserved area for future residential developmetn in southeast corner of parcel. Melissa brought up fact that property on pending grant application to State without any reserve area. No vote. AMENDED MOTION made by Eric Keil, seconded by Monica Harbes, to increase offer if landowners agree to no residential lot being reserved as originally presented on application and providing appraisal supports increase. Members agreed to hold presentation of any offer with building reserve area for now while Melissa finds out timeframe for grant award. Landowner has offered 19.18 acres of the 26.482 acres parcel for preservation purposes. Planning Board reviewed application at their work session on October 15, 2007, and Planning staff will be sending letter to landowner with their opinions/recommendations. LPC agrees with Planning Board comment re: re-locating lot proposed at southerly end of property. No further action to be taken by LPC at this time. ?? Lots of approximately 1 acre each would be stacked in flag formation. MOTION made by Eric Keil, seconded by Chris Baiz, to direct Melissa Spiro to commission an appraisal on Zip Peconic Wells LLC Property allowing for 2% ag structures to be located at southerly end of parcel adjacent to the location of two proposed lots to be created. Purpose of acquistion of this development rights easement would be for farmland & scenic view protection. Motion carried: 5/0 Lillian Ball absent from vote. EXECUTIVE SESSION. County is having an appraisal done on easterly triangle portion of parcel that is adjacent to other County parklands and County will buy this section for appraised value. Village will retain sewage pipe section. Discussions with County/Village/Town Board is that Town will purchase remaining land west of sewage pipe section at a price to make up the proposed $3.4 million amount that was acceptable to Village. ?? Melissa received telephone call and set up an appointment with landower who was interested in preseration options. Landowner cancelled appointment saying that her real estate broker, Dave Kapell, would be contacting Melissa. Mr. Kapell contacted Randy Parsons of The Nature Conservancy, who then contact Melissa by e-mail. Randy’s e-mail was read to LPC members which stated that TNC is willing to work with Town towards preservation of this property in the Pipes Cove target area. LPC recommended that wetland acreage be verified as the existing vacant land appears to be mostly wetlands and unbuildable. Further review of the buildable vs. unbuildable areas of property necessary. ?? COOKE PROPERTY SCTM #: 1000-106-6-1 Zoned: MII Location: 5505 Mill Road, Mattituck CPF: No Total Acreage: 4.11 acres (GIS 4.12 acres) Subdividable: Yes Inquiry from DEC. The Department of Environmental Conservation (DEC) received an inquiry in regard to potential DEC purchase of this parcel located along Mattituck Inlet. DEC passed along inquiry to Town.
