Dear Mr. Herrmann:
The following action was taken by the Southold Town Board of Trustees at their Regular
Meeting held on Wed., December 12, 2007:
WHEREAS, En-Consultants, Inc. on behalf of EDMUND NASH applied to the South old
Town Trustees for an Amendment to Wetland Permit #6730 under the provisions of
Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of
Southold, application dated December 10, 2007, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator recommended that the proposed application be
found Inconsistent with the LWRP, and,
WHEREAS, the Board of Trustees has furthered Policy 6 of the Local Waterfront
Revitalization Program to the greatest extent practical through the imposition of the
following Best Management Practice requirements: the planting of Spartina Alterniflora
(12" o.c), and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
South old Town Code, and,

WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that for the mitigating factors and based upon the Best Management
Practice requirement imposed above, the Board of Trustees deems the action to be
Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5
of the Southold Town Code, and,
BE IT FURTHER,
RESOLVED, that the Southold Town Board of Trustees APPROVE the Amendment to
Wetland Permit #6730 to reflect the changes in the design specifications of the
previously approved low-sill bulkhead, as depicted on the plan prepared by En-
Consultants, Inc. last dated October 2,2007.
This is not a determination from any other agency.

Dear Mr. Penski:
In response to your letter dated 19 September 2007 and pursuant to our subsequent electronic
correspondence, please find attached (4) copies of a project plan last dated 2 October 2007, which has
been revised as follows:
1. The top elevation of the low-sill bulkhead is proposed 12 rather than 2 inches below AHW
2. The proposed tierods and deadmen landward of the low-sill bulkhead have been eliminated in
favor of batter piles on its seaward side
3, The proposed backfill and plantings landward of the existing bulkhead have been eliminated
4. The proposed volume of backfill has been reduced from 15 to 8 cubic yards
5. The spacing of the proposed S. alterniflora plantings has been changed from 18 to 12 inches D.C.
6. The total linear footage of the proposed low-sill bulkhead has been increased from 105 to
approximately 109 linear feet in order to account for the (2) ::!:2-foot returns/tie-in sections that are
necessary on the north and south ends of the project to contain the proposed fill and 1M plantings;
these were depicted but not accounted for on the previously submitted plans
.7. The proposed lengths of the vinyl sheathing and pilings have been reduced by two feet
8. The project notes have been revised as necessary to reflect the above noted changes
Should you require any further changes or additional information before the Department's permit can be
issued, please let me know. By copy of this letter and revised plans, I am similarly notifying the U.S.
Army Corps of Engineers of these changes.

TERMS AND CONDITIONS
The Permittee, Edmund Nash. residing at 1750 Deep Hole Dr.. Mattituck. NY as part of the
consideration for the issuance of the Permit does understand and prescribe to the following:
1. That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
2. That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations in
the location ofthe work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
8. The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Department of Real Properties Office as a notice
covenant and deed restriction to the deed of the subject parcel. Such evidence shall be
provided within ninety (90) calendar days of issuance of this permit.
9. That the said Board will be notified by the Permittee of the completion of the work
authorized.
10. That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.

The Board of Town Trustees took the following action during its regular meeting held on

Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town
Code, the Wetland Ordinance of the Town of Southold, application dated August 24,
2007, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator recommended that the proposed application be
found Inconsistent with the LWRP, and,
WHEREAS, the Board of Trustees has furthered Policies 4.1 and 11 of the Local
Waterfront Revitalization Program to the greatest extent practical through the imposition
of the following Best Management Practice requirements: the planting of Spartina
alterniflora, Spartina patens, and Baccharis halimiflolia, and,
WHEREAS, the application further creates a habitat area and does not in fact increase
the hardening of the shoreline, and,

WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on September 19, 2007, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,

SCTM#1000-115-12-24
EDMUND NASH requests a Wetland Permit to construct (within 18" of existing bulkhead)
approx. 105 linear ft. oflow-sill vinyl bulkhead and backfill with approx. IS cy. clean sand to be
trucked in from an approved upland source. Backfill area between new and existing bulkhead to
be planted with Spartina Altemiflora (18" on center) and backfill area landward of existing
bulkhead to be planted with Spartina Patens (18" on center) and Baccharis Halimifolia (6' on
center). Located: 1750 Deep Hole Dr., Mattituck. SCTM#115-12-24
DEEP HOLE CREEK IS A NEW YORK STATE DEPARTMENT OF
ENVIRONMENTAL CONSERVATION CRITICAL ENVIRONMENTAL AREA.
A FUNCTIONAL BULKHEAD IS CURRENTLY IN PLACE. THE APPLICANT HAS
NOT DEMONSTRATED A NEED FOR THE LOW SILL BULKHEAD. THE
CONSTRUCTION OF A LOW SILL BULKHEAD IN THE PROPOSED AREA WILL
FURTHER HARDEN THE SHORELINE AND HABITAT DESCTRUCTION.
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review ofthe
Town of Southold Town Code and the Local Waterfront Revitalization Program (L WRP) Policy
Standards. Based upon the information provided on the L WRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation
that the proposed action is INCONSISTENT with the denoted following Policy Standards
and therefore is INCONSISTENT with the LWRP.
Policv Standards
4.1 Minimize losses of human life and structures from flooding and erosion hazards.

D. Use hard structural erosion protection measures for control of erosion only where:
1. A voidance of the hazard is not appropriate because a structur
functionally dependent on a location on or in coastal waters; locate
an area of extensive public investment; or reinforces the role of Mari
Centers or Areas for Concentrated Development.
2. Vegetative approaches to controlling erosion are not effective.
3. Enhancement of natural protective features would not prove practic:
providing erosion protection.
4. Construction of a hard structure is the onlv practical design consider<
and is essential to protecting the principal use.
5. The proposed hard structural erosion protection measures are:
a. limited to the minimum scale necessary
b. based on sound engineering practices
6. Practical vegetative methods have been included in the project design
implementation.
7. Adequate mitigation is provided and maintained to ensure that there i
adverse impact to adjacent property or to natural coastal processes
natural resources and, if undertaken by a private property owner, .
not incur significant direct or indirect public costs.
The applicant has not demonstrated the need or the purpose of the proposed low sill
bulkhead in the proposed location. Currently there is a functional bulkhead and a stab I
shoreline landward of the area in which the low sill bulk head bulkhead is proposed. A
sill bulkhead would further harden the shoreline and result in habitat destruction.
Habitat destruction is defined as the loss of fish or wildlife use through direct physical
alteration, disturbance, or pollution of a designated area or through the indirect effects of tl
actions on a designated area. Habitat destruction may be indicated by changes in vegetatiOl
substrate, or hydrology, or by increases in runoff, erosion, sedimentation or pollutants

Promote sustainable use of living marine resources in Long Island SOl
the Peconic Estuary and Town waters.
"Habitat protection and restoration must include an active program of protecting existing
wetlands and preventing further loss of wetlands (and other habitat) to inappropriate bu1kheal
or other shoreline hardening structures".
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in prepafJ
its written determination regarding the consistency of the proposed action.
