Dear Mr. Yu:
The Board of Town Trustees took the following action during its regular meeting held on
Wed., September 19, 2007 regarding the above matter:
WHEREAS, CHENG KAI YU applied to the Southold Town Trustees for permits under
the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance, and
Chapter 111 of the Southold Town Code, Coastal Erosion Hazard Areas, applications
dated July 13, 2007, and,
WHEREAS, said applications were referred to the Southold Town Conservation
Advisory Council and to the Local Waterfront Revitalization Program Coordinator for
their findings and recommendations, and,
WHEREAS, the LWRP Coordinator recommended that the proposed applications be
found Inconsistent with the LWRP, and specifically Inconsistent with the following
coastal policies: Policy 4.1 -Minimize losses of human life and structures from flooding
and erosion hazards, Policy 6- Protect and restore the quality and function of the Town
of Southold ecosystem, and Policy 6.3 - Protect and restore tidal and freshwater
wetlands, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on September 19, 2007, at which time all interested persons were given an
opportunity to be heard, and,

WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structures, as applied for, do not comply with the standards set forth in
Chapter 275 of the Southold Town Code, and Chapter 111 of the Southold Town Code,
and,
WHEREAS, the Board has determined that the structures, as applied for, will have a
detrimental effect upon the health, safety and general welfare of the people of the town,
and,
WHEREAS, there are existing violations of the Town Code currently being prosecuted
on the property, which relate to certain of the structures applied for herein, and,
NOW THEREFORE BE IT,
RESOLVED, for the foregoing reasons, and based upon the application's failure to meet
the standards contained in Chapters 111 and 275 of the Town Code, that the Board of
Trustees deems the proposed projects to be Inconsistent with the Local Waterfront
Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, based
on the scope and location of the proposed structures, their proximity on or nearby the
existing natural protective features, the materials proposed to be used on the project,
the proposed methods of construction, and the overall impact of the proposed project on
the existing natural protective features, and,
BE IT FUTHER,
RESOLVED, that the Board of Trustees DISAPPROVES WITHOUT PREJUDICE the
applications of CHENG KAI YU to construct a second-floor addition to the existing
dwelling, alteration of first floor, and new second-story deck; construct 35' stone
retaining wall; restoration of stone walk/steps over bluff; and fill and replace vegetation
around top of bluff, and as depicted on the survey prepared by John T. Metzger last
dated July 3,2007 and site plan prepared by Architecnologies last dated July 3,2007.
This is not a determination from any other agency.

September 11, 2007, the following recommendation was made:

Although a backyard with a steep, brush-covered hillside would intimidate many homeowners, Dr. Nancy
Snyderman is enthusiastic about the prospects for her backyard slope, which covers an entire acre.
Snyderman explains that she wants to add stone stairs to the incline to make the area functional and
accessible for her children. Additionally, Snyderman wants to add a small wooden bridge to the landscape
to span an existing gully. Landscape designer Fred Sims is charged with implementing the project, which he
estimates would require about three or four weekends for the average homeowner to complete.
Sims says that a professional installation of the entire plan would cost roughly $4,000, while the do-it-
yourselfer can expect to spend about $1 ,400 in materials. On a difficulty scale of 1 to 5, with 5 being the
most difficult, Sims rates the project a "4", explaining that the labor-intensive chore of hauling heavy rocks
up an incline makes this project particularly challenging.
Step One: Laying out the Stairs
Sims gets started by digging out the spaces for the individual stairs after determining the total number of
stairs needed. (This number is calculated by first placing a long piece of lumber across the slope's highest
point, leveling it, then measuring from the board down to the base of the slope.) Since a six-inch rise is an
ideal stair height, Sims uses this measurement as a guideline for creating the spaces for the steps. He
levels the top of each stone bed, allowing 16 inches from front to back; this measurement is marked with
stakes along one side of the stair path.
To ensure that the stairs have a natural look, Sims uses river-washed stone, which is native to the area. He
explains that it's important to use a material with pieces of different shapes and sizes for a natural
appearance; obviously, brick wouldn't be a good choice for creating this type of effect. Since the stones
used here have a flat top and defined corners-as well as varying shapes and sizes; they offer stability as
well as a natural, woodland look.
Since this site features a natural drainage trench that runs down the slope, Sims takes advantage of the
ditch by filling it with rocks to create a dry creek bed. Then he constructs a small wooden bridge that spans
the gully at a relatively low point on the slope. (The larger bridge will be built over the trench at another
point.) Sims further enhances the landscape by building stone retaining walls and pathways that criss-cross
over the hillside.

Step Two: Building the Stairs
To get the building process underway, Sims creates a mortar mixture from six parts sand, two parts cement
and one part lime. Then the rocks are thoroughly cleaned with a brush and water to help them adhere to the
mortar.
Next, the stones are hauled up the hill and laid in the pre-dug spaces to determine which sizes will fit best in
each stair bed. (Since this task is the most challenging part of the project, it may be a good idea to hire a
professional to handle the labor.) Sims suggests first laying the stones out on the ground below--before they
are carried up the slope-so that the various combinations of rocks that will fit together well in the dug-out
areas will already be in groups.
Once all rocks have been grouped together and hauled up the hill, water is added to the mortar mix to
create a workable consistency (not too soupy). Then, a three-inch-thick layer is laid on each stair bed and a
trowel is used to create a slightly choppy surface that will "grip" the rocks and help hold them in place.
Finally, the pre-grouped rocks are filled into the dug-out areas, laid carefully on the layer of mortar. (The
spaces in between are packed with dirt to make the steps look as if they've been part of the hillside for
years.)
While the stairs are selling in the mortar, Sims moves on to the planting plan. To plant the slope with a
woodland look that will complement the natural, rugged appearance of the stone stairs, Sims explains that
it's best to choose varieties that grow naturally in the area (along with a few that look as though they might).

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review
of the Town of South old Town Code and the Local Waterfront Revitalization Program
(LWRP) Policy Standards. Based upon the information provided on the LWRP
Consistency Assessment Form submitted to this department, as well as the records
available to me, it is my recommendation that the proposed action is INCONSISTENT
with the denoted following Policy Standards and therefore is INCONSISTENT with
the LWRP.
4. I Minimize losses of human life and structures from flooding and erosion
hazards.
The following management measures to mlmmlZe losses of human life and
structures from flooding and erosion hazards are suggested:
A. Minimize potential loss and damage by locating development and
structures away from flooding and erosion hazards.
. .
1. Avoid development other than water-dependent uses in coastal
hazard areas. Locate new development which is not water-
dependent as far away from coastal hazard areas as practical.
b. A void hazards by siting structures to maximize the
distance from Coastal Erosion Hazard Areas.
3. Move existing development and structures as far away from
flooding and erosion hazards as practical. Maintaining existing
development and structures in hazard areas may be warranted for:
a. structures which functionally require a location on the
coast or in coastal waters.
b. water-dependent uses which cannot avoid exposure to
hazards.
c. sites in areas with extensive public investment, public
infrastructure, or major public facilities.
c. sites where relocation of an existing structure is not
practical.
D. Use hard structural erosion protection measures for control of
erosion only where:
2. Vegetative approaches to controlling erosion are not effective.
3. Enhancement of natural protective features would not prove
practical in providing erosion protection.
4. Construction of a hard structure is the only practical design
consideration and is essential to protecting the principal use.
5. The proposed hard structural erosion protection measures are:
a. limited to the minimum scale necessary
b. based on sound eneineerine practices
6. Practical vegetative methods have been included in the project
design and implementation.
7. Adequate mitigation is provided and maintained to ensure that
there is no adverse impact to adjacent property or to natural
coastal processes and natural resources and, if undertaken by a
private property owner, does not incur significant direct or
indirect public costs.
Note: that the bluff is activelv erodine with the more severe
erosion occurrine adiacent to the lawn area adiacent to the top
of bluff. The effectiveness of the 35' stone wall to stabilize the
bluff throul!h protection of the toe of the bluff is Questionable
as l!ullies have developed from the top of bluff. IT IS
STRONGLY RECCOMMEDED THAT AN ENGINEER
REVIEW THE PLANS PRIOR TO TRUSTEE REVIEW.

The followin!! best mana!!ement practices are recommended.
1. It is stron!!lv recommended that a non-disturbed ve!!etated
buffer be established landward of the top of bluff to the
landward limit of the Coastal Erosion Hazard Line (15+') to
control storm water, minimize erosion and help stabilize the
bluff.
2. Require hay bales durin!! construction landward of the Coastal
Erosion Hazard Area.
3. Require !!utters. leaders and drvwells landward of the existin!!
structure and additions to contain roof runoff.
Policy 6. Protect and restore the quality and function of the Town of Southold
ecosystem.
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town
Board of Trustees laws and regulations for all Andros Patent and other
lands under their jurisdiction
1. Comply with Trustee regulations and recommendations as set forth
in Trustee permit conditions.
The distance to the proposed trellis from the top of bluff is 28
feet; the distance to the proposed second Ooor addition from
the top of bluff is 44 feet; a minimum setback distance of 100
feet from the wetland line is required pursuant to Chapter 275-
3.Findin!!s; purpose; iurisdiction; setbacks. Please require that
the applicant amend the application to meet the above policy to
the !!reatest extent practical.

1. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of South old Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. * Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of South old Town).

Dear Board of Town Trustees:
The undersigned is applying for an above referenced Permit and would like to provide
some background for your consideration as follows:
A. Addition/remodeling house because a new roof is urgently needed:
1. The house is about 1600 ft' of one story.
2. The addition is to add a 2nd story of same living space straight up on top of
the 1 sl story, having 2 new bathrooms.
3. The remodeling is moving 3 bedrooms to 2nd floor from 1 sl floor; Open
existing one bedroom to enlarge the entryway and open the other 2
existing bedrooms to form a living room.
4. Contractor and architect had examined the foundation and agreed that it is
doable. P. A PecK :UV R12AR. of 2.IVD FLOOR
B. A 35' stone retaining wall at toe of the west-end bluff, fronting with giant
local rocks:
1. A Permit of rock-revetment of200'+2x20' returns was issued by
NYSDEC in 1987.
2. Rambo constructed revetment of 160'+2x 20' returns and left. Years later,
both eastern and western property had bulkheads constructed wli its
respective boundary.
3. There was an open gap of35' wlo retaining wall in front of my western
bluff. NYS DEC and the Southold Town were notified of the
incompletion.
4. I am the owner since 2005, planted 100 pitch pine seedlings on bluff and
all disappeared wli months, planted 18000 beach sea grasses and none
survived (other cause: heavy rain in 10105). The erosion problem was
excessive. The house needed lateral support ofthe bluff and the bluff
needed the lateral support of a stabilized toe.

5, Rambo didn't want to complete the revetment after numerous contacts.
Out of self-help, I started to construct the 35' stone wall to close the open
gap. Both I and my wife studied Engineering in colleges. Our hobbies of
building things with cement made us very experienced.
6. Description: 35' long by 9' high by (8'to 1') wide;
The foundation is 8' wide of 4 stones laying on 2' deep of gravels;
The design is in pyramid shape of8' width at bottom to l' at top;
The structure height is 7' of big stone on top of 2' of small stones;
The length is 35' and it was cemented to giant rocks at both ends;
The back fill is from the toe of bluff;
The material used is < 50yd' and the ground involved is <500 ft2;
The height is 4' in summer and 6' in winter from the ground;
7. The Permit may include placing additional 5 to 7 giant local rocks in front
of the stone wall by machine entering from the northern end of Duck Pond
Road to enforce the purpose of the stone waiL
8. The 35' stone retaining wall serves all purposes of and complies with
Southold Town Codes under Wetland Act and Erosion Control
Management.
9. I had no knowledge that the NYSDEC Permit having an expired date. I
had no knowledge that Board of Trustees has jurisdiction over my
property. Building Department has no record of any retaining waiL
10. The open gap was less than 100' between two man-made bulkhead and
rock revetment. Accordingly, NYSDEC seems having no jurisdiction
over where 35' stone wall was built because its jurisdiction covers the area
between wetland and most seaward edge of man-made structure,
1. The house was built around 1960. The original owner was alone, childless
and left no document of any construction drawing. Building Department
has nothing as well.
2. There was a stone step-way on the bluff, being buried with soil and
vegetation. There was a potable wooden steps on bluff which
disappeared. The original stone step-way was functional but not safe,
3. I studied and started to restore the existing stone step-way by adding new
stones and pavements. I used cinder blocks as handrail on top of existing
foundation because wooden handrail requires deep excavation of bluff and
metal handrail would get rusted.
4. Description--- 2 sections of stone step-way + 2 platforms on bluff;
Entryplatformm 7' long x (6' to 4') wide;jumbo Belgium block and
cement;
1st section--- 46112' long x 4' wide; 43 steps; each step of 10" deep x 36"
wide x 8" high by cementing 2 layers of jumbo Belgium blocks; jumbo
block of lO"x8"x4"

Middle platform--- 5' long x 6112' wide x 3' high; jumbo Belgium block
surface framed by cinder blocks and filled with gravels; exterior height of
4" to 17" to 22" to 32" at corners from ground;
2nd section--- IS' long x 4' wide; 5 steps; each step of 4' long x 3' wide x
6" high of stones and cement;
Handrail--- 44" high by stacking up 5 cinder blocks with cement by
leaving open spaces for water drainage; cinder block filled with small
stones at bottom; 30" high from interior step and 36" high from exterior
ground;
The material used is < 50yd' and the ground involved is <500 fP;
Sides--- anchored with stones and stabilized by sea grasses;
5. The step way may include one or two or three gates being placed at entry,
at mid-section or at the end.
6. The impervious surface of the stone step-way prevents erosion of bluff
where it sits. Without expansion and substantial alteration, it may be
considered as an ordinary and usual maintenance.
7. 200 bristly locust seedlings, 200 bayberry seedlings, 6000 + 18000 beach
sea grasses were planted in 2006 and early 2007.
8. A step-way is necessary in order to access to beach/bluff. The restoration
of a step-way may be an ordinary and usual operation incidental to
harvesting fish/shellfish, an ordinary and usual operation relative to
conservation of soil, vegetation and wildlife landward of the wetland
boundary, an ordinary and usual operation relative to residential
horticulture landward of the wetland boundary. . . etc. Thus the restoration
should not be required of a permit under section 275-4 of Southold Town
Code.
9. There is no document of stairway over bluff of my neighbors at Building
Department upon search. There was no assessment value being increased
upon building a stairway on bluff (insignificant, I thought). Replacing an
old well, no permit was required. I had no knowledge that Board of
Trustees has jurisdiction over my property because I received no notice.
D. Fill top soil and replant with vegetations around the top edge ofthe bluff:
I. There are some wooden barriers around the top edge ofthe bluff.
2. The existing wooden barriers enhance the preservation of upper land soil
and vegetations.
3. To further enhance soil and vegetations around there in an area < 500 fP, it
is vital important to fill them with top soil of < 50 yd' and replant in area
with vegetations.
4. The purpose is to maximize stability of the lateral support of the house.
