Box 2003 Bridgehampton, NY 11932-2003 RE: BOYAR/MCNElLY 250 GOOSE CREEK LANE, SOUTHOLD SCTM#71-1-42 Dear Mr. Ivans: The following action was taken by the South old Town Board of Trustees at their Regular Meeting held on Wed., May 21,2008: WHEREAS, Suffolk Environmental Consulting, Inc. on behalf of BOYAR/MCNElLY applied to the Southold Town Trustees for an Amendment to Wetland Permit #6556 under the provisions of Chapter 275 of the South old Town Code, the Wetland Ordinance of the Town of Southold, application dated May 2, 2008, and, WHEREAS, said application was referred to the South old Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application be found Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the South old Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, . 2 . NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees have found the application to be Consistent with the Local Waterfront Revitalization Program, and, BE IT FURTHER RESOLVED, that the South old Town Board of Trustees APPROVE the Amendment to Wetland Permit #6556 to reconstruct the existing timber bulkhead along the northern section of subject parcel, construct a flagstone patio (including dry-stack rock retaining wall, access steps and fire-pit), establish a 10' wide non-turf buffer landward of the bulkhead, and re-vegetate seaward of the reconstructed bulkhead, with the condition a drywell is installed on the north side of dwelling to contain run-off, and as depicted on the plans prepared by Suffolk Environmental Consulting Inc. dated April 28, 2008 and Briarcliff Landscaping last dated May 28, 2008. Box 1179 Southold, NY 11971 Re: Situate: SCTM #: McNEILY/BOYAR Wetlands Permit 250 Goose Creek Lane; Town of Southold, New York 1000 - 071 - 01 - 042 Dear Board Members, As you may know, this Firm represents the owners of the property referenced above, who benefit from a Board of Trustees Wetlands Permit to reconstruct the existing bulkhead thereon, issued October 17, 2007. In the interim, the property owners wish to amend the permit to include the installation of a flagstone patio (including dry-stack rock retaining walls, stone stairs and a raised gravel-lined fire pit) within the northeastern section of the property, landward of the bulkhead. Consequently, we wish to amend the existing and "in - force" wetlands permit to include these items. Please find enclosed: (1) Revised Project Description (original and two [2] copies); (2) Proposed Project Plans, prepared by SUFFOLK ENVIRONMENTAL CONSULTING, INC., dated April 28, 2008, indicating all project specifications (three [3] prints); and (3) Check made payable to the Town of Southold to cover the requisite application fee. REVISED PROJECT DESCRIPTION for the McNEILY / BOYAR Property Situate: 250 Goose Creek Lane; Town of South old, New York SCTM #: lOOO - 071 - 01 - 042 PROJECT NARRATIVE: Applicant proposes to reconstruct the existing timber bulkhead along the northern section of subject parcel, construct a flagstone patio (including dry-stack rock retaining wall, access steps and firepit), establish a 10' wide Non-Turf Buffer landward of the bulkhead, and re-vegetate seaward of the reconstructed bulkhead. BULKHEAD RECONSTRUCTION: The eXlstmg timber bulkhead measures 150'I and consists of timber sheathing (3" x 10" X 14') secured by a timber follower (4" x 6") along the landward bulkhead face, two (2) sets oftimber walers (6" x 6") along the seaward bulkhead face and timber pilings (12" - 14" <1>) reinforcing all. The applicant proposes to remove the existing timber pilings and two (2) sets of walers and install vinyl sheathing (i.e., C-Loc) directly to the seaward face of the existing timber bulkhead, secure same with two (2) sets of timber walers (6" x 6") and timber pilings (12" - 14" <1>). In addition, the applicant proposes to reinforce the overall structure by connecting the proposed pilings, top walers and vinyl sheathing with helical screws extending landward. These will be screwed to torque specs that components and installation of the proposed components will occur in 8' sections to retain structural integrity. The proposed bulkhead will be finished with a 2" x 10" timber top cap and a 2" x 12" timber follower. Please note that the seaward portions of the existing fixed dock assembly (timber dock, and wood ramp) will be removed and stored on site during reconstruction. After reconstruction, these components will .be reinstalled. Please note that the floating dock and five (5) dolphin piles securing same will remain during the proposed bulkhead resheathing. All materials to be non-treated material(s) (i.e., Fir, Oak, Cedar, etc...). All hardware will be hot- dipped galvanized. FLAGSTONE PATIO: Applicant proposes to construct a pervious patio within the northeastern corner of the property measuring 15.0' deep I x 65.0' wide I comprised of flagstone set into a layer of gravel. The landward side of the patio will be contained by two (2) dry-stack rock retaining walls measuring 40' long I x 2' thick I & 31' long I x 2' thick I, respectively, and bisected by a small set of stone stairs. Incorporated into the northeastern portion of the proposed patio will be a raised gravel-lined fire pit measuring 3.0' wide I x 2.0' deep I. I RE-VEGETATION: After project completion, the applicant proposes to re-vegetate an area extending two feet (2.0') seaward from the proposed vinyl sheathing with Salt Water Cordgrass (Spartina alterniflora). That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved, to provide evidence to anyone concerned that authorization was originally obtained, 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That iffuture operations of the Town of South old require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation, the said Permittee will be required, upon due notice, to remove or alter this work project herein stated without expenses to the Town of Southold. 8. The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Department of Real Properties Office as a notice covenant and deed restriction to the deed of the subject parcel. Such evidence shall be provided within ninety (90) calendar days of issuance of this permit. 9, That the said Board will be notified by the Permittee of the completion of the work authorized. 10. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit, which may be subject to revoke upon failure to obtain same. . . James F. WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees have found the application to be Consistent with the Local Waterfront Revitalization Program, and, RESOLVED, that the Board of Trustees approve the application of BOYAR/MCNElLY to reconstruct the existing 150' timber bulkhead along the northern section and install a 10' wide non-turf buffer landward of the bulkhead; remove the existing timber pilings and two sets of walers and install vinyl sheathing directly to the seaward face of the existing timber bulkhead and secure with two (2) sets of timber walers and timber pilings; reinforce overall structure by connecting the pilings, top walers and vinyl sheathing with helical screws extending landward. Seaward portions of the existing fixed dock assembly will be removed and stored on site during reconstruction and re- installed and floating dock will remain during the bulkhead resheathing. Re-vegetate area extending 2' seaward of vinyl bulkhead with Spartina Alterniflora or Salt Water Cordgrass, and as depicted on the plans prepared by Suffolk Environmental Consulting, Inc. last dated September 11, 2007. Permit to construct and complete project will expire two years from the date the permit is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Inspections are required at a fee of $50.00 per inspection. (See attached schedule.) The Trustees, along with the NYSDEC requested that the number and size of the piles be reduced. The existing timber bulkhead measures 150' :!: and consists of timber sheathing (3"xlO"xI4') secured by a timber follower (4"x6") along the landward bulkhead face, two [2] sets of timber walers (6"x6") along the seaward bulkhead face and timber pilings (12"-14" 0) reinforcing all. The applicant proposes to remove the existing timber pilings and two sets of walers and install vinyl sheathing (i.e. C-Loc) directly to the seaward face of the existing timber bulkhead, secure same with two [2] sets of timber walers (6"x6") and timber pilings (12"- 14" 0). In addition, the applicant proposes to reinforce the overall structure by connecting the proposed pilings, top walers and vinyl sheathing with helical screws extending landward.
