Dear Board Members,
As you may know, this Firm represents the owners of the property referenced above,
who benefit from a Board of Trustees Wetlands Permit to reconstruct the existing
bulkhead thereon, issued October 17, 2007. In the interim, the property owners wish to
amend the permit to include the installation of a flagstone patio (including dry-stack
rock retaining walls, stone stairs and a raised gravel-lined fire pit) within the
northeastern section of the property, landward of the bulkhead. Consequently, we wish
to amend the existing and "in - force" wetlands permit to include these items. Please
find enclosed:
(1) Revised Project Description (original and two [2] copies);
(2) Proposed Project Plans, prepared by SUFFOLK ENVIRONMENTAL
CONSULTING, INC., dated April 28, 2008, indicating all project
specifications (three [3] prints); and
(3) Check made payable to the Town of Southold to cover the requisite
application fee.
Kindly review and issue the requested permit modification at your earliest opportunity.
Should you have any questions concerning this matter, please feel free to contact this
office at any time. Thank you as always for your attention and consideration.
Sincerely,
Matt D. Ivans

SCTM #: lOOO - 071 - 01 - 042
PROJECT NARRATIVE:
Applicant proposes to reconstruct the existing timber bulkhead along the northern section of subject
parcel, construct a flagstone patio (including dry-stack rock retaining wall, access steps and firepit),
establish a 10' wide Non-Turf Buffer landward of the bulkhead, and re-vegetate seaward of the

consists of timber sheathing (3" x 10" X 14') secured by a timber follower (4" x 6") along the
landward bulkhead face, two (2) sets oftimber walers (6" x 6") along the seaward bulkhead face
and timber pilings (12" - 14" <1>) reinforcing all.
The applicant proposes to remove the existing timber pilings and two (2) sets of walers and
install vinyl sheathing (i.e., C-Loc) directly to the seaward face of the existing timber bulkhead,
secure same with two (2) sets of timber walers (6" x 6") and timber pilings (12" - 14" <1>). In
addition, the applicant proposes to reinforce the overall structure by connecting the proposed
pilings, top walers and vinyl sheathing with helical screws extending landward. These will be

flagstone set into a layer of gravel. The landward side of the patio will be contained by two (2)
dry-stack rock retaining walls measuring 40' long I x 2' thick I & 31' long I x 2' thick I,
respectively, and bisected by a small set of stone stairs. Incorporated into the northeastern
portion of the proposed patio will be a raised gravel-lined fire pit measuring 3.0' wide I x 2.0'
deep I.
I
RE-VEGETATION: After project completion, the applicant proposes to re-vegetate an area
extending two feet (2.0') seaward from the proposed vinyl sheathing with Salt Water Cordgrass
(Spartina alterniflora). These specimens will be installed at quart size, 1.0' off center. This
scheme will utilize approximately 300 plants I.

Re:

Dear Ms. Standish,
As you may recall, the above referenced permit was modified administratively to
include the replacement of the five [5] dolphin piles securing the existing floating dock
assembly. The Trustees, along with the NYSDEC requested that the number and size of
the piles be reduced.
Further analysis of the project by the applicant's contractor, Costello Marine,
revealed that the floating assembly and piles DO NOT have to be removed in order to
re-sheath the existing bulkhead. Therefore, we wish to amend the existing approval to
state that the existing piles and floating assembly will remain. To that end, please find
the following enclosed herewith:
(1) Revised Bulkhead Reconstruction Plans prepared by this Firm and last dated
9/11/2007 (four [4] copies);
(2) Revised Project Description indicating exactly what is proposed (four [4] copies).
By way of this correspondence, kindly amend the existing approval and forward

Applicant proposes to reconstruct the existing timber bulkhead along the northern section
of subject parcel, and install a 10' width Non-Turf Buffer landward of said bulkhead.
The existing timber bulkhead measures 150' :!: and consists of timber sheathing
(3"xlO"xI4') secured by a timber follower (4"x6") along the landward bulkhead face,
two [2] sets of timber walers (6"x6") along the seaward bulkhead face and timber pilings
(12"-14" 0) reinforcing all.
The applicant proposes to remove the existing timber pilings and two sets of walers and
install vinyl sheathing (i.e. C-Loc) directly to the seaward face of the existing timber
bulkhead, secure same with two [2] sets of timber walers (6"x6") and timber pilings (12"-
14" 0). In addition, the applicant proposes to reinforce the overall structure by
connecting the proposed pilings, top walers and vinyl sheathing with helical screws
extending landward. These will be screwed to torque specs that typically result in a 10'-
15' length. Please note that the removal of existing components and installation of the
proposed components will occur in 8' sections to retain structural integrity. The
proposed bulkhead will be finished with a 2"xlO" timber top cap and a 2"xI2" timber
follower.
Please note that the seaward portions of the existing fixed dock assembly (wood dock,
and wood ramp) will be removed and stored on site during reconstruction. After
reconstruction, these components will be reinstalled. Please note that the floating dock
and five [5] dolphin piles securing same will remain during the proposed bulkhead
resheating.
All materials to be non-treated material(s) (i.e. Fir, Oak, Cedar, etc.. .). All hardware will
be hot-dipped galvanized.
Proposed Re..vegetation
After reconstruction is complete, the applicant proposes to re-vegetate an area extending
two [2] ft seaward from the proposed vinyl sheathing with Spartina alterniflora, or Salt
Water Cordgrass.
These specimens will be installed at quart size, I' off center.
Ierne will utilize approximately 300 plants.

Dear Ms. Standish,
As per our phone conversation, please consider this correspondence our request to
administratively amend the above referenced permit to include the installation of new
pilings to secure the existing floating dock assembly when it is reinstalled after
construction of the bulkhead. This work will be done in accordance with the plans
submitted to your office on April 24, 2007, and will consist specifically of the following:
1) Five [5] new piles will be installed in the same location as the existing piles to
secure the floating dock. These piles will be 12" diameter and 14':1: long;
2) Two [2] new piles will be installed in the same location as the existing piles to
secure the fixed wood dock. These piles will be 4" x 4" and 12':1: long.
Kindly schedule this matter for administrative approval at the next available
meeting of the Southold Town Trustees. If you have any questions, please don't hesitate
to contact me. Thank you for your added attention and courtesy in this matter.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (L WRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation
that the proposed action is CONSISTENT with the Policy Standards and therefore is
CONSISTENT with the LWRP prQvided that the following best management practice is
applied pursuant to ~ 275-11. Construction and operation standards.
(2) Erosion control. Installation of an erosion control structure is necessary during any

~ Yes 0 No 0 Not Applicable
Subiect proposal is consistent with the policy in that the sitina and utilization of the improved erosion -
control facilities (i.e. reconstructed bulkheadinaJ will maintain the character at the surroundina
neiahborhood. which currentlv consists of many similarly improved lots with similar accessory structures (I.e.
existina bulkheadina to the northeast and southwest alona Goose Creek!. In addition, subiect parcel will
be in harmony with this .....beneficial use of a coastal location..... in that subiect waterfront lot will be
enhanced and improved by the uparadina of the existina bulkhead in order to control erosion olano the
situate shoreline. The instant proposal will also". ..minimize the adverse effects of development.. in that
resheathina, rather than reconstruction, will drasticallY reduce the siltation caused by the proiect. This will
protect the Town owned clam beds situated near the subiect parcel. and will not add to the naviaational
issues associated with Goose Creek. Accordinaly, we feel that the instant proposal complies with Policy 1.
