John Xikas steps block residents and visitors from walking the beach,most and foremost, these steps will act as a missile in a storm damaging homeowner's bulkheads and properties. We are asking the Town Trustees to visit this site and have these steps removed. Mr. Xikas has created a structure that will destroy other homeowner's property when the next storm or rough seas occur. We have attached photos of the steps for your review;please note these were taking at incoming tide NOT high tide. I have been asked to represent many homeowners that are very concerned about this issue. We are writing in protest of the proposed 50'-0" rock groin which is being proposed perpendicular to the bulkhead,adjacent to our property. We have owned our property since 1976,and have been witness to other similar groins being installed along the beach. The result is always the same,the beach on one side of the groin is preserved at the expense of the beach on the other side. While the erosion of the beach on one side of a groin is retarded,the erosion on the other side of a groin is accelerated. We have no objection to the building of the bulkhead along the beach as it is proposed,but the groin will result in a more rapid erosion of the beach behind our own house. There are better ways to decrease the effects of severe storms on this north-facing beach. The best one would be to place an underwater berm parallel to the beach,about 75 feet from the shoreline. Please take our protest under consideration before approving the above mentioned groin. Please inform us of any decision being made in this regard. It is also my understand- ing that work was begun on the project without a NYSDEC permit, and a violation was issued by that agency. The matter has been settled with NYSDEC. The work which was begun included the sinking of a number of new piles on the seaward side of the existing bulkhead, but work was halted before the new piles were secured. I have been engaged by the contractor, Tom Johnston,to obtain permits to allow the operations necessary to secure the new piles. Applications have been submitted to NYSDEC, USAGE, and NYSDOS. The Xikis file at the Trustee office was not available when I inquired about it. I do not have a copy of the permit which presumably was issued to Mr. Xikis and therefore I cannot de- termine if the work currently proposed would be covered by the Trustee permit, if one exists. The project description is as follows: Excavate a trench behind existing bulkhead to allow installation in the excavated area of one 10" d. x 8' deadman pile for each of the existing fender piles on the seaward side of the bulkhead. Behind the deadman piles, install horizontal laylogs 10" d. x 20' long extending the entire length of the bulkhead. Install tie rods '/4" x 12' through the laylogs and the dead- man piles extending to and through the bulkhead and through the individual existing fender piles. Copies of the Project Plan and the Section View(both dated 1/19/07) submitted to the named agencies are enclosed for your examination. SCTM#44-1-13 The proposed action has been reviewed to Chapter 95, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the following Policy Standards and therefore is INCONSISTENT with the LWRP 9.4 Assure public access to public trust lands and navigable waters. E. Provide access to, and reasonable recreational use of, navigable waters and public trust lands under water. 1. Provide for free and unobstructed public use of all navigable waters below the line of mean high water for navigation, recreation, and other public trust purposes, including the incidental rights of public anchoring. 2. Permit limited obstruction of public use, including navigation, in navigable waters: C. in order to gain reasonable access to navigable waters from riparian lands. 3. Obstruction of navigable waters and underwater lands is limited: 0 b. to the minimum necessary for access to navigable waters. The minimum is determined by evaluating the following factors: (i) the extent of the use's dependence on access to navigable waters, (ii) the range of tidal water level fluctuation, (iii) the size and nature of the body of water, (iv) the nature of public use of the adjacent waters, (v) the traditional means of access used by surrounding similar uses, (vi) whether or not alternative means to gain access are available. The proposed two 50'rock groins proposed to extend perpendicular to the proposed vinyl bulkhead will impede access to public trust lands (beach). The following best management policies are recommended to further the LWRP policies: 1. Prohibit the use of lumber treated with chromated copper arsenate (also known as "CCA"), commercial copper quat (CCQ), creosote, penta products or homemade wood preservatives in the reconstruction all structures. 2.
