husband and wife
party of the first part, and
BETH HERMAN, residing at 215 East 68th Street, New York, NY 10021
party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable consideration
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying
and being
on Indian Neck, near Peconic, in the Town of Southold, County of Suffolk and State of New York, being the
southerly one-half of Lot No. 13 on a certain map entitled, "Map of Indian Neck Park, C?orge W. Smith, Owner, made by
Franklin A. Overton, M.E., Surveyor, 1912" apd filed in the Office of the Clerk of the county of Suffolk on the Play 27, 1913
as and by Map No. SSl, and being bounded with reference to said map as follows:
BEGINNING at a monument on the westerly side of "Private Road" distant 650.00 feet southeasterly from the corner
formed by the intersection of the westerly side of "Private Road" and the southerly sidz of Indian Neck Road, said point of
beginning also being at the division line between Lot 13 and Lot 11, as shown on said a"orementioned map;
RUNNING THENCE along the westerly side of "Private Road", South 10 deg. 23 mir--. 00 sec. Bast, 50.00 feet to a
monument;
RUNNING THENCE along the division line between Lot 13 and Lot 15, South 19 deg. 37 min. 00 sec. West, 138.89 feet
to a monument; ~
RUNNING THENCE along the land of a subdivision entitled, "Arrowhead Cove°, North 07 deg. 02 min. 28 sec. West,
50.09 feet to a monument;
RUNNING THENCE along the division line between Lot 13 and Lot 11, North 19 dee, 37 min. 00 sec. East, 135.91 feet
to a monument on the westerly side of "Private Road" and the point or place of BEGINNING.
TOGETHER WITH a right of way over the Private Road above mentioned to Indian Neck and to Peconic Bay.
7Y)GETHER WITH such use of the beach and other privileges as set forth in Deed from George W. Smith and wife, to
Doris L. Schneider, dated July 2S, 1925 and recorded in Suffolk County Clerk's Office on July 29, 1925 in Liber 1138 of
deeds at page 592, and subject to all of the restrictions and conditions set forth in said deed.
BEING AND INTENDED to be the same premises conveyed to Grantors herein
by deed gated 3/2/88 and recorded 3/11/88 in the Office of the Suffolk County
Clerk at Liber 10560 page 128.
TOGETHER with aH right, title and interest, if any, of the party of the first part of, in and to any streets and
roads abutting the above-described premises to the center lines thereof; TOGETHER with the appurtenances
and all [he estate and rights of the party of the first par[ in and to said premises; TO HAVE AND TO HOLD
the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of
the second part forever.
AND the party of the first part covenants that [he party of the first part has not done or suffered anything whereby
the said premises have been iltcumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a tmst fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment-of the cost of the improvement before using any part of the total of the same for any other
purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year first above
written.
