FINDINGS, DELIBERATIONS AND DETERMINATION
MEETING OF AUGUST 16, 2007

SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this
application and determines that this review falls under the Type II category of the State's List of Actions,
without further steps under SEQRA,
PROPERTY FACTS/DESCRIPTION: The applicant's property size is only 78 feet wide by 132 feet deep
along the easterly side line. The dilapidated, unhabitable remnants of a former dwelling has been located on
at the site for a long time and shown on the December 18, 2006 survey prepared by Joseph A. Ingegno.
BASIS OF APPLICATION: Zoning Code Sections 280-63 and 280-64, based on the Building Inspector's June
4, 2007 amended Notice of Disapproval concerning proposed construction for use as a custom workshop in
this LI Light Industrial Zone District. The reasons stated for disapproving the building permit application are
that the new construction will be: (1) less than 100 feet from the right-of-way; (2) will have a single side yard t
less than 10 feet; (3) will have a total side yards at less than 40 feet for both setbacks, (4) the rear yard is
less than 70 feet.
SUFFOLK COUNTY ADMINISTRATIVE CODE: This application has been referred as required under the
Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning
reply dated July 25, 2007 states that the application is considered a matter for local determination as there
appears to be no significant county-wide or inter-community impact.
LWRP: This application is exempt under Chapter 268.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on _2006, at which time written and oral
evidence were presented, Based upon all testimony, documentation, personal inspection of the property, and
other evidence, the Zoning Board finds the following facts to be true and relevant:
AREA VARIANCE RELIEF REQUESTED: The applicant proposes a 40' by 78' contractor's office-warehouse
building with storage of custom carpentry materials and as a limited workshop clarified by the applicant during
the August 2, 2007 public hearing. The new building will include a 6' by 40' one-story open porch, a two-story
office area 40' by 21', and one-story warehouse floor area. This property is in the LI zone and contains a size
of 11,517.67 square feet. The May 31, 2007 site plan (Map S-2) shows the new building with a front open
porch proposed at 19 foot from the front lot line facing Sound Avenue instead of the required 100 feet, a rear
yard setback of 42.1 feet instead of 70 feet (measured from the closest corner), 10 feet on the west side yard

and total side yard setbacks of 37.9 feet. The bulk schedule requires total side yard setbacks at 40 feet (10
feet on one side, and a minimum of 30 feet on the other side).
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal
inspections, the Board makes the following findings:
1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a
detriment to nearby properties. This area has many mixed uses, Residential and Industrial, with a building that
is similarly situated. The applicant proposes to place the parking area behind the new business building, with
removal of the entire dilapidated structure on the site and other site planning with the Planning Board. The
applicants' planned improvements will be an asset to the area.
2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to
pursue, other than an area variance. The applicant's property size is only 78 feet wide by 132 feet deep along
the easterly side line, with a limited site area for parking, screening, and related site of only 11,517.67 feet in
an Light Industrial (L1) Zone for construction of a business, new parking area, new sanitary system and related
utilities. This lot is not large enough to meet the setback requirements to place a building, and the applicant is
forced to follow a variance procedure to request multiple setback variances from both side lines, from the right-
of-way (front yard), and from the rear lot line.
3. The variances requested are substantial, but the size of the property limits the use of this LI zoned land.
The owner has devised a plan which meets his business needs and which will meet other code requirements
as a permitted business use, and all improvements as planned will be an asset to the community.
4. The difficulty has not been self-created inasmuch as the Town Board in 1989 deemed this property LI Light
Industrial Zone District with setback requirements that would not be met on this lot of only 11,517 square feet
in size.
5. No evidence has been submitted to suggest that a variance from the Light Industrial Zone District
standards will have an adverse impact on the physical or environmental conditions in the neighborhood.
Changes were agreed by the applicant during the hearing to reduce the width of the easterly driveway by one
foot and to narrow the warehouse by two feet, and providing adequate screening for the nearby residence(s).
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under
New York Town Law 267-B, motion was offered by Member Oliva, seconded by Member Goehringer, and duly
carried, to
Grant the variances, with the following condition, and as shown on plans drawn by Mark Schwartz dated
May31,2007:
Reduction of the width of the easterly driveway by one foot, and reduction of the warehouse by two feet, to
provide adequate screening for the residence(s).
Any deviation from the variance given such as extensions, or demolitions which are not shown on the
applicant's diagrams or survey site maps, are not authorized under this application when involving
nonconformities under the zoning code. This action does not authorize or condone any current or future use,
setback or other feature of the subject property that may violate the Zoning Code, other than such uses,
setbacks and other features as are expressly addressed in this action.
The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that

AREA VARIANCE REASONS:
(I) An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment
to nearby properties if granted, because:
The existing house is dilapidated and will be demolished. Rosen, the former owner tried to
operate a radio tower from the subject property and was denied the variance. The property
is zoned Light Industrial which permits the contractor's office and warehouse use. Siefert
Construction wishes to locate his office and warehouse with custom carpentry materials in the
building. The setbacks in the code anticipate a one acre parcel, the parcel is preexisting
nonconforming in size and can not meet the required setbacks. The front yard setback
conforms to the surrounding properties which are, on average 23.9 feet from the road (see
Drawing S-2). The front yard setback conforms to the variable setbacks which are less than
100 feet ofthe surrounding properties. In order to place the parking behind the building the
building is placed closer to the road, the parcel is along the Long Island Railroad, and the
shape of the parcel requires the front yard setbacks to be slightly on an angle (19' and 22.9
feet). The Lot Coverage is conforming (less than 30%)
Mark Schwartz has designed a beautiful building which retains the "residential character"
along the street. Placement of the parking in the rear also preserves the "residential"look of
the property.
(2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant
to pursue, other than an area variauce, because:
The Light Industrial zoning places setbacks applicable to a one acre parcel, this parcel is only
11,517 sq.ft. It is impossible to develop this property with the required setbacks because the
property is preexisting nonconforming in size.
However, the proposed plan conforms to the existing development ofthe commercial buildings
on Sound Avenue and the proposed design enhances the property which is presently a run
down preexisting nonconforming use (dwelling).
(3) The amount of relief requested is not substantial because:
As seen on the site plan (S-2) the setbacks of the adjacent properties are shown: the adjacent

two story residence is 12.5 feet from the street (east) and adjacent one story residence is 58.5
feet (west). In addition, a two story warehouse (east) is 3.5 feet from the street and Kolb
Mechanical's warehouse (west) is 12.5 feet from the street. This is a well developed area of
Mattituck which provides a good location for Contractors. Penny Lumber Yard is near by
and the area is zoned LI. Residential uses are not a permitted use in the zoning and will
eventually be replaced with similar commercial uses.
(4) The variance will NOT have an adverse effect or impact on the physical or environmental conditions
in the neighborhood or district because:
The property will be significantly improved. The proposed use is conforming in Light
Industrial Zoning. All activity is inside the building and will not interfere with the adjacent
nonconforming residences. The Long Island Railroad boarders the property along the south
property line.

In response to your memo dated July 5, 2007 the Planning Board has reviewed the site
plan (S-I & S-2) for this project, dated May 31, 2007, and offers the following
comments:
We are site planning this project under the Building Departments Notice of Disapproval
dated March 9, 2007 and amended June 4,2007 stating that site plan review is required
pursuant to Section 280-127.
This new site plan is for the proposed construction of 3,080 square foot building where
800 sq. ft. is a 2-story office and 2,280 sq. ft. is a custom cabinet workshop on an
11,517.67 sq. ft. parcel in the Light Industrial zone on the s/s/ of Sound Avenue,
approximately 520' west of Pacific Street known as 11780 Sound Avenue in Mattituck.
SCTM #: 1000-141-3-44.
The Planning Board received a site plan application on June 18, 2007 and accepted the
application at our work session on June 25, 2007, requesting additional site plan
information.
The Planning Board issued a letter dated July 5, 2007 to the agent requesting a revised
site plan showing the necessary site plan information. The Planning Board will begin the
referral process on this application once the necessary site plan changes have been made.
A copy of the July 5,2007 letter is attached.
The Planning Board is currently reviewing an incomplete site plan drawing dated May
31,2007. This plan shows the proposed 78' x 40' building with an approximate 10'
single side yard, 37.9 total side yard, 42.1' rear yard and 19' front yard setback. In
addition, the site plan indicates lot coverage at 29.2%.
The Planning Board recognizes this Light Industrial parcel is non-conforming and
requires relief from ZBA. The Planning Board supports this application, as proposed,
pending review ofthe proposed site plan by the Town Engineer, Suffolk County

Planning, Mattituck Fire District, LWRP, ARC, NYSDOT, SCDPW and Building
Department certification. In addition, the applicant must obtain approval from Suffolk
County Health Department for the proposed construction.
The preservation ofthe natural vegetation buffers to lessen the impact to the adjacent
residential properties is strongly recommended.
The parcel is wooded with significant trees it is recommended that the site plan be
designed to retain the trees to the greatest extent practical.
We hope these comments will be useful to the ZBA in its review of this appeal.
