SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this
application and determines that this review falls under the Type II category of the State's List of Actions,
without further steps under SEQRA.
PROPERTY FACTS/DESCRIPTION: The applicant's 93,663 square foot parcel is improved with a single-
family dwelling as shown on survey prepared by Joseph A. Ingegno dated February 18, 2002, updated July
25, 2006.
BASIS OF APPLICATION: Request for a Variance under Section 280-14 concerning a request to amend
Building Permit No. 32082-z concerning a new dwelling, under construction, with conversion of the third-floor
attic area to a finished floor area, determined to be a third story under the Building Inspector's April 2, 2007
Notice of Disapproval.
SUFFOLK COUNTY ADMINISTRATIVE CODE: This application has been referred as required under the
Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning
reply dated March 14, 2007 states that the application is considered a matter for iocal determination as there
appears to be no significant county-wide or inter-community impact.
LWRP: TOWN CODE CHAPTER 95 (268) LWRP DETERMINATION: This application is exempt from the
Local Waterfront Revitalization Program Code standards because the Zoning Code relief herein concerns a
limited area within the existing roof lines (777 sq. ft. attic area) of this new dwelling under construction (see
pending inspections under Building Permit 30762-Z), which does not physically disturb or affect the land areas
of this parcel.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on May 31, 2007, at which time written
and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the
property, and other evidence, the Zoning Board finds the following facts to be true and relevant:
AREA VARIANCE RELIEF REQUESTED: The applicant wishes to convert, insulate and sheetrock a 777
square foot section of the existing attic above the existing second-fioor livable floor area for use as storage
and the owner's craft room.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal
inspections, the Board makes the following findings:

1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to
nearby properties. The variance requested would allow the conversion of a 2%-story house to allow storage use and a
craft room of a 77'7 square foot area above the second floor of this new dwelling. This alteration involves installing an
internal ceiling and finishing an attic (insulation and sheetrock).
2. The benefit sought by the appiicant, conversion of a 771square foot storage space to a habitable space to be used
for storage and crafts, cannot be achieved by any method feasible for the applicant to pursue other than an area
variance.
3. The variance granted herein is not substantial. It involves no change to the exterior of the house. No plumbing will
be added, other than required for a sprinkler system.
4. The difficulty has been self-created. It is the result of the applicant's decision to convert attic space to finished
(habitable) space pursuant to the insurance requirement that the entire house be fitted with a sprinkler system.
5. No evidence has been submitted to suggest that a variance in this residential community will have an
adverse impact on the physical or environmental conditions in the neighborhood.
6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy
the benefit of use of this 777 square foot area above the second floor, while preserving and protecting the
character of the neighborhooa and the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under
New York Town Law 267-B, motion was offered by Member Simon, seconded by Member Oliva, and duly
carried, to
GRANT the variance as applied for, as shown on the August 15, 2004 Attic Plan A5, revised March
11, 2007 by Charles A. Napoli, Architect, subject to the following Conditions:
1. Sprinkler system as proposed by applicant and discussed at the public hearing on May 31,2007.
2. This variance is limited to a 777 square foot area of the existing attic for conversion.

That these ZBA conditions be written into the Building Inspector's Certificate of Occupancy, when issued.
Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams
ar survey site maps, are not authorized under this application when involving nonconfarmities under the zoning code. This
action does not authorize or condone any current or future use, setback or other feature of the subject property that may
violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action.
The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not
increase the degree of nonconformity.

INSTRUCTIONS
a, This appliealion MUST be completely filled in by typewriter or in ink and submitted to the Building fuspector with 3
sets of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location oflot and of buildings on premises, relationship to adjoining premises or public streets or
areas, and waterways.
c. The work covered by this application may Ilot be commenced before issuance of Building Penuit.
d. Upon approval of this application, the Building fuspector will issue a Building Penuit to the applicant. Such a penuit
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building penuit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zouing amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the penuit for an
addition six months. Thereafter, a new penuit shall be required.

The Board of Town Trustees took the following action during its regular meeting held on
Wed., October 18, 2006 regarding the above matter:
WHEREAS, John Bertani Builder Inc as agent for LINDA SANFORD applied to the
Southold Town Trustees for a permit under the provisions of Chapter 275 of the
Southold Town Code, the Wetland Ordinance of the Town of Southold, application
dated September 25,2006, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the Board of Trustees has furthered Policy 6 of the Local Waterfront
Revitalization Program to the greatest extent possible through the imposition of the
following Best Management Practice requirements: the installation of drywells to contain
the roof run-off and pool backwash, the installation of a hay bale line during
construction, and the use of native and drought tolerant vegetation, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on October 18, 2006, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,

WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that for the mitigating factors and based upon the Best Management
Practice requirements imposed above, the Board of Trustees deems the action to be
Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5
of the Southold Town Code, and,
RESOLVED, that the Board of Trustees approve the application of LINDA SANFORD
for the existing new construction of a single-family dwelling, renovation of the existing garage,
new in-ground swimming pool, patios and new landscape plan with the condition that the pool
be located 50' landward of the top of bank, a dry well for the pool, native species be used in the
landscaping of the bluff, and all as depicted on the plans prepared by Keith E. Simpson,
Associates, Inc. dated 10/27/06 and planting plan dated August 1, 2006.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.

Conservation has determined that:
The portion of your property which Is located landward of a functional and substantial man-made
structure (a bulkhead) greater than 100' In length, constructed prior to 8/20/77 as shown on
Aerographics photograph #73-2049, is beyond the jurisdiction of Article 25 (Tidal Wetlands).
Therefore, in accordance with the current Tidal Wetlands Land Use Regulations (6NYCRR Part 661) no
permit is required under the Tidal Wetlands Act. Please be advised, however, that no construction,
sedimentation, or disturbance of any kind may take place seaward of the tidal wetlands jurisdictional
boundary, as indicated above, without a permit. It is your responsibility to ensure that all necessary
precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground
surface or vegetation within Tidal Wetlands jurisdiction which may result from your project. Such
precautions may include maintaining adequate work area between the tidal wetland jurisdictional
boundary and your project (i.e. a 15' to 20' wide construction area) or erecting a temporary fence, barrier,
or hay bale berm.

BASIS. OF APPLICATION: Building Department's August 20, 2002 Notice of
Di$ilpprovai, amended January 22, 2003, in applicant's proposal to demolish the existing

FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this applicalion on March 20,
2003, at which time written and oral evidence were presented. Based upon all
testitnony, documentation, personal inspection of the property, and other evidence, the
Zoning Board finds the following facts to be true and rei avant:
VARIANCE REQUESTS: Applicant proposas to construct a new dwelling, afler removal
of the existing dwelling with additions. The new dwalling is shown at an improved
angled, allowing for an increased overall setback from the bulkhead and rear lines,
utiliiingaportion of the existing nonconfonning yard for a new porch. The' closest
comer of the new porch will be 25 feat from the existing bulkhead and approximately 56

'~ONS FOR BOARD ActiON: on the basis of testimOny presented, materials
submitted'and perSonal inspections, the Board makes the following findings:
1. Grant Of the varian= requested will not produce an, undesirable change in the
character ,of the neighborhood or a detriment lb nearby properties. The proposed
reconslr1Jclion of the dwelling is within keeping of the neighborhood setbacks, which
houses have similar sioping and pijched roofS and traditional gables, open porch design.
2. The benefit sought by the applicant cannot be achieved by some method, feasible for
the applicant to pursue, other than variance requests.
3. The' requested area variance is substantial, however this is a reconstruction of an
existing nonconforming house, and applicant has agreed to move the house to increase
the rear yard setback and. decreasing the front setback, and removing the proposed
swimming. pool from the plan. The code requirement is 75 feet setback from the
bulkhead.
4. The difficulty is se~--created since properties are acquired with knowledge of
nonconfonnities and limitations of the existing building and property.
5. No evidence has been submitted lb suggest that the new dwelling will have an
adverse impact on physical or environmental conditions in the neighborhood. By letter
dated August 1,2002, the Board of Town Trustees granted approval with conditions at a
Regular Meeling held July 24, 2002 for construction of a new residence after
demolishing the existing residence.
6. Grant of the requested variances is the minimum action necessary and adequate to
enable the applicant lb enjoy the benefit of a dwelling, while preserving and protecting
the character of the neighborhood and the health, safety and we~are of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the
baiancing test under New York Town Law 267-B, motion was offered by Member
Goehringer, seconded by Chairwoman Tortora, and duly carried, to

Dear Mr. Dinizio,
Enclosed please find the application for Linda S. Sanford requesting a variance for a third floor finished
attic at her home under construction at 780 Private Road 17, Southold, NY 11971.
The original plans submitted to the building department for Mrs. Sanford showed a two and a half story
dwelling and a third floor finished attic which was to be insulated and sheet rocked. However, Mrs. /
Sanford's insurance company, Chubb Insurance, specified that she must have the entire house
sprinkled in order to secure coverage. When the third floor was sprinkled, she decided to use the 770
square foot room as storage and as a crafl room. There will be no outward change to the exterior
structure of the existing building from what was originally permitted.
In order to properly secure her certificate of occupancy she requests a variance from Artide III, Section
280-14.

DEVELOPED COAST POLICY
Policy 1.
The submitted plan fosters a pattern of development that enhances
community character, preserves open space, makes sufficient use of
infrastructure, makes beneficial use of coastal location, and minimizes
adverse affects of development in the following manner: The application
seeks to allow existing construction on a location on which there was an
existing one family dwelling which was in disrepair and demolished. It also
seeks to renovate in existing garage which was in disrepair and install an in-
ground swimming pool with patio areas and landscape. This preserves the
community character of the Town of Southold and it preserves the other
open spaces while rehabilitating already developed areas. This application
makes beneficial use of the coastal locations and minimizes adverse effects
or development in that it is rehabilitating and reconstructing already existing
development which currently has some infrastructure in place.
Policy 2.
Policy is not applicable to present application as the demolished one
family structure and the exisiting garage were not historical and there are no
archeological resources involved in the property.
Policy 3.
The proposed application and building does not impact the visual
quality and protects any resources throughout the Town of Southold in that it
redevelops an already existing home and garage. While the applicant
believes that it is a major esthetic improvement over the previously existing
one family home and garage, this is totally a subjective determination and
there is neither a decrease nor increase in the visual quality and protection of
the scenic resources.

NATURAL COAST POLICIES
Policy 4.
The application applicability to minimizing the loss of life structures
and natural resources from flooding and erosion is not applicable to this
application as the application simply seeks to allow the existing construction
in an area where there was an already demolished one family dwelling and
renovate an existing garage while adding a swimming pool, patios and new
vegetation. It marginally increases the minimization of lose of life,
structures and natural resources from flooding and erosion through better
design and the addition of runoff retention devices.
Policy 5.
The application protects and improves water quality and supply in the
Town of Southold by the updating of the septic system and the enhancement
of drywells on the property in order to control runoff into the natural
resources.
Policy 6.
The application protects the quality and functions of the Town of
Southold ecosystem in that it provides runoff retention measures which
decrease point source pollution and allows natural habitats to better restore
themselves without these intrusions.
Policy 7.
The application will not protect and improve air quality in the Town
of Southold nor will it decrease or impair the air quality. The reconstruction
of a single family home, renovation to existing garage and addition of an in-
ground swimming pool, patios and new landscape will have no measurable
impacts on air quality.
Policy 8.
The application will have no effect on the environmental degradation in the
Town of Southold from solid waste and hazardous substances and wastes.

The reconstruction of the home has negligible or no effect on solid waste in
the Town of Southold and it is a redevelopment of a single one story home.
PUBLIC COAST POLICIES
Policy 9.
The application does not provide for public access to and recreation use of
coastal waters, public lands and public resources of the Town of Southold as
it is a redevelopment of a single family home, renovation of an existing
garage and addition of a swimming pool, patios and landscape.
WORKING COAST POLICIES
Policy 10.
The instant application is not applicable to maintaining or protecting
Southold's water dependent uses in promoting or citing of new water
dependent uses in suitable locations in that the present location is zoned
residential and the application seeks to rebuild a residential home on the
location.
Policy I I.
The project promotes sustainable living marine resources in the Long
Island Sound, the Peconic Estuary and town waters by providing for
improved dryweIl capturing of gutter leaders and roof runoff which presents
possible point source pollution which could negatively affect ecosystems
and habitats. The application exceeds the configuration of the previously
existing house as it provides better protection for roof runoff recapture.
Policy 12.
The application protects agricultural lands in the Town of Southold by
redeveloping an already developed parcel instead of developing "virgin,
natural undeveloped or agricultural lands".

Policy 13.
The application promotes appropriate use and development of energy
and mineral resources in that the new construction and redevelopment of this
single family house used significantly better energy efficient design and is
compliant with the local building codes which have been strengthened in this
regard over the codes in place at the time of the earlier construction.
