DECLARATION AND COVENANT
THIS DECLARATION made the /1 day of June, 1991, by
PATRICIA~BAILEY, residing at 2155 Skunk Lane, Cutchogue,
New York, Declarant.
WHEREAS, Declarant is the owner of certain real
property situate in the Town of Southold, Suffolk County, New
York, more particularly bounded and described as set forth in
Schedule A annexed hereto as provided by the Declarant, and
WHEREAS, for and in consideration of the granting of a
subdivision application entitled, "Minor Subdivision - Kay Dee
Estates" by resolution dated June 6, 1991, a copy of which is
attached hereto and made a part hereof, and as a condition of
granting said approval, the Town of Southold Planning Board has
required that the within Declaration be recorded in the Suffolk
County Clerk's Office, and
WHEREAS, Declarant has considered the foregoing and
determined that same will be in the best interest of the
Declarant and subsequent owners of said parcel,
NOW, THEREFORE, THIS DECLARANT WITNESSETH:
That Declarant, for the purpose of carrying out the
intentions above expressed does hereby make known, admits,
publishes, covenants and agrees that the said premises herein
described shall hereafter be subject to the following covenants
which shall run with the land and Shall be binding upon all
purchasers and holders of said premises, their heirs, executors,

ALL that certain plot, piece or parcel of land, with the
buildings and improvements thereon erected, situate, lying and
being in the TOWN OF SOUTHOLD, at Cutchogue, Suffolk County,
New York, bounded and described as follows:
BEGINNING at a concrete monument on the northerly line
of Leslie Road, at the southeasterly corner of the premises
herein described adjoining land of Z. Swiatocha on the east;
running thence along the southerly line of Leslie Road S. 51 deg.
16 min. 50 sec. W. 117.24 feet to a concrete monument and land of
Price;
running thence along land of Price two courses and
distances as follows:

legal representatives, distributees, successors, and assigns, to

1. That there is to be no further subdivision of any lot in
perpetuity.
2. There shall be no direct access unto Leslie Road for Lot 3.
Lot 3 is to have access onto the proposed road only.

3. These Covenants and Restrictions can be modified only at the
request of the then owner of the premises with the approval
of a majority plus one of the Planning Board of the Town of
Southold after a pUblic hearing. Adjoining property owners
shall be entitled to notice of such public hearing but their
consent to such modification shall not be required.
