REASONS FOR AREA VARIANCE:
1. An undesirable change will NOT be produced in the character of the neighborhood or a det-
riment to nearby properties, if granted BECAUSE:
Although the neighborhood has not been fully developed (there are only 7 houses on thel3
lots in the immediate area) it is not unreasonable to think that the neighborhood will con-
tinue to be made up of a number of larger more expensive homes on the one-acre lots, as
has been the case in this development and in other developments of this sort in the area, and
that the presence of swimming pools and tennis courts can be expected and accepted by the
members of the neighborhood.
2. The benefit sought by the applicant CANNOT be achieved by some method, feasible for
the applicant to pursue, other than an area variance BECAUSE:
The size and configuration of the property, together with its comer location, make it impos-
sible to place a standard-size tennis court and surrounding fence on the property without the
benefit of an area variance.
3. The amount of relief requested is not substantial BECAUSE:
The side- and rear-yard setbacks requested are only 5'less than the regulatory requirement.
Although the coverage increases, it should be noted that the proposed construction is not of
a building, but rather a ground-level installation which, of itself, would have no significant
visual impact. The fence at the requested height is standard for this use and can be made of
a low-visibility material.
4. The variance will NOT have an adverse effect or impact on the physical or environmental
conditions in the neighborhood or district BECAUSE:
The variance, if granted, will result in the installation of a standard tennis court, of which
there are many in certain areas of the Town. The methods of the construction and use of a
tennis court would not be expected to have an adverse effect upon the physical or environ-
mental conditions in the neighborhood.
5. Has the alleged difficulty been self-created?
( ) Yes
( X) No
6. This is the minimum that is necessary and adequate, and at the same time will preserve and
protect the character of the neighborhood and the health, safety and welfare ofthe commu-
nity.
