DECLARATION OF COVENANTS AND RESTRICTIONS

JOHN PETROCELLI and JOAN PETROCELLI, his wife, residing at
250 Manor Road, Huntington, New York 11743, hereinafter
referred to as the "Declarants";

WHEREAS, the Declarants are the owners in fee
simple of a certain parcel of land situate on 2100 Paradise
. Point Road, Southold, in the Town of Southold, County of
Suffolk and State of New York, being the premises described
in a deed dated May 13, 1982, and recorded on May 20, 1982
in the Suffolk County Clerk"s Office at deed Liber 9185,
page 219, a metes and bounds description of which is shown
on Schedule A attached hereto and made a part hereof,
hereinafter referred to as the "premises",
WHEREAS, said Declarants intend to subdivide said
premibes in~0 lo~s tor resiaen~ial purposes and desire to
subject said premises to certain conditions, covenants and
restrictions.
WHEREAS, said Declarants are desirous of placing
certain restrictions upon said premises which shall be
binding upon all purchasers and mortgagees of individual

lots, their heirs, executors, administrators and assigns or
other successors in interest,
NOW, THEREFORE, Declarants declare that the
aforesaid premises is held and shall be conveyed subject to
the following covenants and restrictions which shall run
with the land in perpetuity.
1. No lot line shall be changed in any manner at
any future date unless authorized by the Town of Southold
Planning Board.
2. In the event any further application is filed
for further subdivision of any lot being created hereunder,
. said subdivision shall be deemed, for all purposes, a major
subdivision which shall comply with all the rules and
regulations applicable thereto at the time of the
application. All lots in such major subdivision shall
access Paradise Point Road from the existing driveway shown
on the minor subdivision map for John and Joan Petrocelli.
3. All stormwater runoff resulting from the
development and improvement of this subdivision or any of
its lots shall be r~tain9d on the site by adequate dr~inage
structures so that it will not flow into Shelter Island
Sound.
4. No grading shall be permitted within 50 feet
of the top edge of the bank except that which may be

necessary to control or remedy erosion or to prevent
stormwater from flowing over the edge of the bank.
5. The woodland nature of the premises are to be
preserved except where the removal of such trees and shrubs
are necessary for construction or maintenance of access
driveways to the lots.
6. These covenants and restrictions can be
modified o~ly at the request of the then owner of the
premises with the approval of a majority plus one of the
Planning Board of the Town of Southold after a public
hearing Adjoining property owners shall be entitled to
notice of such public hearing but their consent to such
modification shall not be required.
IN WITNESS WHEREOF, the Declarants have hereby
executed this Declaration of Covenants and Restrictions the
