Dear Ladies and Gentlemen:
We are the attorneys for Richard Witt and Antoinette Beck-Witt and are writing
concerning the activities we have been advised are being conducted by or at the direction
of William and/or Janice Claudio on Gull Pond Lane, in a town right ofwaylhighway.
Despite the efforts ofthe Code Enforcement Officer these activities have continued. A
copy of the letter dated July 12,2007 from Code Enforcement is enclosed. Specifically,
there exist encroachments and impediments into such area consisting of blacktop, stone
blocks, sprinklers, a mailbox, and plantings. These activities unreasonably interfere with
the public's use thereof. Accordingly, we enclose a request pursuant to New York State
Town Law Section 268(2) to remedy this situation. Upon your failure to take appropriate
steps to so remedy, we have been instructed to take the necessary and appropriate steps
under such section to eliminate the problem. We trust that you will give this matter the
attention it deserves and proceed apace with a remedy.

Please be advised that a complaint has been received concerning an encroachment
into the Town Right of way. Stone blocks lining the driveway of your residence encroach
beyond your property boundary onto Town property.
Town Code section 280 -111 1.2 states;
L Encumbrances to public roads. [Added 8-8-2006 by LL No. 12-2006]
(2) No person shall place or cause to be placed obstructions of any kind, except
the lawful parking of registered vehicles, upon a public highway, roadway,
right-of-way or sidewalk that unreasonably interferes with the public's use of
the public highway, roadway, right-of-way or sidewalk.
Please take the steps necessary to remedy the condition immediately.

Dear Ladies and Gentlemen:
I am a resident taxpayer of the Town of Southold, owning and residing at 1710
Gull Pond Lane, Greenport, New York 11944. I write pursuant to New York Town Law
Section 268(2) to request that you take all necessary and appropriate steps to remedy the
violation of Town Code Section 280-1 I I (I)(2) occurring at Gull Pond Lane, Greenport,
New York, at its southerly terminus. At that location there have been installed blacktop,
belgium block, sprinklers, a mailbox, and landscaping, all of which interferes with my
use of the town highway/right of way, access to my property, and the longstanding use of
my neighbors. These installations have been made or caused to have been made by
William and/or Janice Claudio and have had the effect of usurping public property to
their exclusive use and benefit. Despite the efforts of the Code Enforcement Officer,
consisting of a letter, nothing has been done to rectifY the situation. Specifically, I
request that you institute an action for removal of the encroachments so that the area will
again be open and passable. Upon your failure to take such action within the time
provided in Town Law Section 268(2), such further steps as authorized therein will be
taken. I trust that you will take seriously your responsibility to all of the citizens of
