(E.D.S.T.), Upon.application of Suffolk Outdoor Advertis~ing Compnay, Inc., Riverhead, New York, for a special exception in accordance with the Zoning Ordinancet .Article III, Sgction, 300, Subsection 10, Article IV, Section 408, Subsection (a), ~Article X, .Sec- tion 1002, for permission to retain two [2) billboards on the property of Witherspoon~ described as item nu.~ber eleven in the application. Location of Property: east side Main Road, Greenport, New York, bounded north by Champlin Place, east bY Austin-Wilson, south by Joegen~sin, west by Main Street. 2. VAP~IANCE. PeRM ZB4 ZONING BeAiRD OP APp~'IAL~ By investigation and public hearing the Board finds the following facts pertinent to the decision. This application ~s for two (2) single face billboards, located on,he east side Main Road, Greenport, New York, on land of Witherspoon. The billboards are twelve feet by twenty-five feet (12' x 25'), each, totaling 600 square feet of advertising area. T~e maximum size sign permitted anywhere in the Town of Southold is six feet, six inches by twelve feet, six inches, (6'6" x 12'6"). The billboards are primarily used for National Advertised Products. This sign site is located in a business district, however, it is at the entrace to the Village of Greenport and is surrounded by a highly residential area to the east and south. RoUte 25 is one of the heavily travelled main arteries leading into the Town of Southold. A Cornell University Study Survey, published in 1967 indicates 82% of the visitors t~.Southol~-Town were attracted by the physical character and rural atmosphere of the Town~ In April, 1957, the ~oning Ordinanceprohibited off premises adv~r~sing. Im our opinion ken years is more than sufficient time,to permit the liquidation of a non-conf°~ming use; nor is the-Board~bound by any eontracts made by the applieant. Ten-years experience of the Board of Appeals indieates the majority~of residents appearing before the Board of Appeals and~the Civie Association ¢onsideroff premises billboards to be a violation of the letter and spirit of the Ordinance. Benefit to the~PUblie is deemed of greater importance than detriment to the application. Investment of the applicant is slight compared to the detrimental effect of the billboard signs on surrounding property =alues and encouragement of the residential use of the property. Route 25 is a two lane highway, heavilly travelled, and in our opinion large signs distract motorist and increase the traffic hzard. In considering the above the Board determines that the use will prevent the orderly and reasonable use of adjacent properties, or the properties in adjacent use district; that the safety, the health, the welfare, the comfort, or the order of the Town will be adversely affected by the proposed use and its location; the use will not be in harmony with and promote the g~neral purpose and intent of the Ordinance; and that the character and probable development of uses in the district will be affected and that the conservation of property values will be adversely affected. Therefore, it was RESOLVED that Suffolk Outdoor Adverting Company, Inc., Riverhead, New York, be DEN~ED permission to retain two (2) single face billboards on the property of Witherspoon, located on the east side Main Road, Greenport, New York. Said signs shall be removed by October 11, 1967.
