York, bounded north by Main Road, east by Mattituck Park Prop. Subdivision

By investigation and public hearing the Board ~inds the
following facts pertinent to the decision. This application is
for two (2) single face billboards, located on the southeast side
Main Road and 'Old Main Road~' Laurel, New York, on land of Huising,
a residential area. The billboards are twelve feet by twenty-five
feet (12' x 25'), each, totaling 600 square feet of advertising
area. The maximum size sign permitted anywhere in the Town of
Southold is six feet, six inches, by twelve feet six inches (6'6"
x 12'6"). The billboards are primarily usedfDr National Advertised
Products. This sign site is adjacent to Mattituck Park Properties
Subdivision~ a residential subdivision. The area directly across
the street is a highly concentrated residential area. Route 25 is
one of the heavily travelled main arterties leading into the Town
of Southo%d. A cornell~ university ~St. ud3 .Su. rve/f /~ublished in 1967
indicates 82% of the~ visitors ,to Southold' .Tow~n ~were attracted by
the ~hysical character and rural atmosphere of the Town. In
Apri,1, 195.7, Th, e~ Z~oning Ordinance' prohibited` off Prgmtse, s advertising.
In our opinion ten years is mo~e than sufficientt/me to permit the
liquidatio, n of a non-conforming us~e; nor is the Board bound, by
contracts made by the applicant. Ten years experien~ce~the Board of
Appea'ls indic'ates the majority of residents appearing ~'re ,the Board
and the 'Civic Association consist 'off premis ,~s. billboards to be a
vi~f~tion of the letter and spi'ri.'t of the Ordinance. Benefit to
the public is deemed of greater importance than detriment to the
applicant. Investment of the applicant is slight compared to the
detrimental effect of the billboard signs on surrounding property
values and encouragement of the residential use of property.. Route
25 is a two lane highway, heavily travelled, and in our opinion
large signs distract motorist and increase the traffic hazard.
In cnnsidering the above the Board determines that the use
will prevent the orderly and reasonable use of adjacent properties,
or of properties in adjacent use district; that the safety, the health,
the welfare, the comfort, or the order of the Town will be adversely
affected by the proposed used and its location; the use will not be
in harmony with and promote the general purpose and intent of the
Ordinance; that the character and probable development of uses in
the district will be adversely affected; and that~e conservation of
property values will be adversely affected.
Therefore, it was RESOLVED Suffolk Outdoor Advertising Co., Inc.,
Riverhead, New York, be DENIED permission to retain two (2) single
face billboards on the property of Huising, located on the southeast
side Main Road and Old Main Road, Laurel, New York. Said signs shall
be removed from the premises by October 11, 1967.
