Present Were: Don Wilder, Chairman Jack McGreevy, Member Peter Young, Member Chris Kempner, Member Doug Hardy, Member Jacob Smith, Student Member Bob Ghosio, Trustee Lauren Standish, Secretary Absent Were: Joyce Grigonis, Member James Eckert, Member CALL TO ORDER Chairman Don Wilder called the meeting to order at 5:30 PM. CHAIRMAN'S ANNOUNCEMENTS Chairman Don Wilder asked the committee members whether or not they would be interested in researching and then meeting with the ad hoc groups. A majority of the council agreed and set a special meeting for Wed., October 3, 2007 at 5:30 PM at Down's Farm Preserve to discuss it further. REPORTS Member Jack McGreevy stated that Down's Creek is never mentioned as a dredging project. He is concerned it will shoal over and change. Jack will contact Bob Ghosio to discuss it further. APPROVAL OF MINUTES Moved by Jack McGreevy, seconded by Doug Hardy, to Approve the Minutes of August 15,2007. DISCUSSION AND RECOMMENDATION OF WETLAND PERMIT & COASTAL EROSION PERMIT APPLICATIONS Moved by Don Wilder, seconded by Chris Kempner, it was RESOLVED to SUPPORT the Wetland Permit application of CLAUS RADEMACHER to install 120 linear ft. of new stone revetment with two (2) 4' returns at the termini and a set of slate steps to access the beach. The proposed revetment will be backfilled with approx. 1041 cy. of clean sand and planted with Cape American Beach Grass plugs installed l' on center. Located: 950 Blue Marlin Dr., Southold. SCTM#57-1-31 Inspected by: Chris Kempner, Don Wilder The CAC Supports the application with the Condition of a 10' buffer along the east side and moving to a 20' buffer along the west. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Peter Young, it was RESOLVED to SUPPORT the application of PAUL LONG to reconstruct 60+/- linear ft. of existing functional timber bulkhead with vinyl sheathing and new timber and reconstruct the existing wood deck on bulkhead. Located: 3945 Camp Mineola Rd., Mattituck. SCTM#123-5-30 Inspected by: Jim Eckert, Peter Young, Jacob Smith The CAC Supports the application, however asks the Trustees to consider eliminating the use of CCA on all construction. Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Chris Kempner, it was RESOLVED to SUPPORT the Wetland Permit application of STEPHEN MATTEINI to construct a cantilevered platform 5' X 6' extending seaward from top of existing bulkhead; construct stairs to grade with rise of 9'-10"+/- and run of 14'; install handrails on two sides of platform and seaward side of stairs. Located: 1060 Willow Terrace Lane, Orient. SCTM#26-2-22 Inspected by: Don Wilder, Chris Kempner The CAC Supports the application with the Condition of an additional 10' non-turf buffer. Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Chris Kempner, it was RESOLVED to SUPPORT the Wetland Permit application of RUTH FALBEL SCHWARTZ to construct a 4'X 22' timber dock with steps to grade, a min. 3.5' above grade, 2.5' X 18' ramp and 6'X 20' floating dock. Located: 2350 Clearview Ave., Southold. SCTM#70-10-28.3 Inspected by: Don Wilder, Chris Kempner The CAC Supports the application with the Condition the dock doesn't extend any further seaward than the neighboring docks. The CAC requests a more definitive plan with regard to the trimming of the phragmites. In addition, the CAC recommends consideration to allow for public access below MHW. Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Jack McGreevy, it was RESOLVED to SUPPORT the Wetland Permit application of ROY & LINDA ARGENT to remove and raise roof, replace windows, repair or replace all rotten wood, repair or replace foundation, if needed, and for the existing bulkhead. Located: 6429 Indian Neck Lane, Peconic. SCTM#86-6-23 Inspected by: Jack McGreevy The CAC Supports the application with the Condition of inkindlinplace maintenance of the bulkhead. Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Chris Kempner, it was RESOLVED to SUPPORT the Wetland Permit application of PECONIC LAND TRUST INC. to reinforce 390' of eroding bank along marina and creek with filter cloth and 50-75 lb. stones, and add four (4) pilings along dock in marina area. Located: 10273 North Bayview Rd. Ext., Southold. SCTM#79-5-20.2 Inspected by: Don Wilder, Chris Kempner Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Chris Kempner, it was RESOLVED to NOT SUPPORT the Wetland Permit application of WILLIAM & CHRISTINE EISEN REICH to construct a two-story addition and greenhouse addition to the existing single-family dwelling, and re-configure the existing driveway. Located: 805 Bay Shore Rd., Greenport. SCTM#53-3-10 Inspected by: Don Wilder, Chris Kempner The CAC does Not Support the application and recommends the project is moved further landward, with no encroachment toward the water. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by Doug Hardy, it was RESOLVED to SUPPORT the Wetland Permit application and Coastal Erosion Permit application of CHENG KAI YU to construct a second-floor addition to the existing dwelling, alteration of first floor, and new second-story deck; and does NOT SUPPORT the application construct 35' stone retaining wall; restoration of stone walk/steps over bluff; and fill and replant vegetation around top of bluff. Located: 3300 Dignan's Rd., Cutchogue. SCTM#83-2-4.1 Inspected by: Jack McGreevy The CAC does Not Support this portion of the application because the piles of stone at the bottom of the bluff might obstruct public access. Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Chris Kempner, it was RESOLVED to SUPPORT the Wetland Permit application of CAROL MERCIER & PETER SCHRAMM for repairs to the existing 3'X 28' fixed timber dock, 3'X 12' seasonal ramp, and 6'X 10' floating dock, and replace piles with galvanized steel posts. Located: 600 Sunset Way, Southold. SCTM#91-1-10 Inspected by: Don Wilder, Chris Kempner The CAC Supports the application with the Condition the dock is replaced with open-grate decking. Vote of Council: Ayes: All Motion Carried GEORGE GUIMARAES for the existing deck and to remove the Japanese Knotweed, and repeat cuttings over the next three growing seasons. Located: Equestrian Ave., Fishers Island. SCTM#9-6-4 The CAC did not make an inspection, therefore no recommendation was made. Moved by Peter Young, seconded by Jack McGreevy, it was RESOLVED to SUPPORT the Wetland Permit application of JAMES KELLER & ELISSA SANTISI to construct approx. 54 linear ft. of vinyl bulkhead in place of existing, storm- damaged timber bulkhead; backfill with approx. 25 cy. clean sand to be trucked in from an upland source and planted with Cape American Beach Grass (1S" on center); construct 4'X 4' platform and 4'X 9' stairs to beach in place of existing platform and temporary steps; and remove temporary walkway over scoured area landward of bulkhead. Located: 2934 Park Ave., Mattituck. SCTM#123-S-17 Inspected by: Jim Eckert, Peter Young, Jacob Smith The CAC Support the application with the Condition the beachgrass extends to the top of the slope. Vote of Council: Ayes: All Motion Carried Moved by Peter Young, seconded by Don Wilder, it was RESOLVED to SUPPORT the Wetland Permit application of EDMUND NASH to construct (within 1S" of existing bulkhead) approx. 105 linear ft. of low-sill vinyl bulkhead and backfill with approx. 15 cy. clean sand to be trucked in from an approved upland source. Backfill area between new and existing bulkhead to be planted with Spartina Alterniflora (1S" on center) and backfill area landward of existing bulkhead to be planted with Spartina Patens (1S" on center) and Baccharis Halimifolia (6' on center). Vote of Council: Ayes: All Motion Carried DISCUSSION AND RECOMMENDATIONS OF APPLICATIONS TO AMEND PERMITS Moved by Chris Kempner, seconded by Don Wilder, it was RESOLVED to SUPPORT the application of MICHAEL KENIN to Amend Permit #4984 to install a 6'X 12' fixed dock on the seaward terminus of the existing catwalk. Located: 430 Lakeview Terrace, East Marion. SCTM#31-9-11 Inspected by: Don Wilder, Chris Kempner Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Chris Kempner, it was RESOLVED to SUPPORT the application of MICHAEL KENIN to Amend Permit #6127 to construct a 9'X 13' covered deck and steps on the northern side of the existing dwelling; 9'X 28' wood deck and steps with associated planter on the eastern side of the dwelling; 13'X 24' semi-circular stone patio on eastern side of dwelling; and 12'X 12' pergola with benches and associated planter on eastern side of the dwelling. Located: 420 Lakeview Terrace, East Marion. SCTM#31-9-11 Inspected by: Don Wilder, Chris Kempner The CAC Supports the application with the Condition the deck is pervious and drywells are installed to contain all run-off. Vote of Council: Ayes: All Motion Carried Moved by Peter Young, seconded by Don Wilder, it was RESOLVED to SUPPORT the application of CARLL & SUSAN AUSTIN to Amend Permit #6578 to authorize the construction of approx. 94 If. of vinyl bulkhead in place of existing timber bulkhead; in-place replacement of existing 10'X 12' wood deck and 4'X 7' steps; and backfill with approx. 20 cy. clean sand fill to be trucked in from an upland source and planted with Cape American Beach Grass (18" on center). Vote of Council: Ayes: All Motion Carried Moved by Peter Young, seconded by Don Wilder, it was RESOLVED to SUPPORT the application of DENNIS KORD to Amend Permit #6267 to extend the fixed ramp by 16' seaward, replace the 16' aluminum ramp with a 20' ramp, and replace the proposed staircase on the landward end of the ramp by an 8' extension of the fixed ramp. Located: 295 Maiden Lane, Mattituck. SCTM#140-1-7 Inspected by: Jim Eckert, Peter Young The CAC Supports the application with the Condition the project is staked and does not exceed 1/3 across the width of the creek. Vote of Council: Ayes: All Motion Carried Moved by Don Wilder, seconded by Chris Kempner, it was RESOLVED to SUPPORT the application of ANTHONY BELLlSIMO to Amend Permit #6526 to erect a drystone natural stone wall to bring land to grade; place bluestone in compacted stone dust with y," drainage joints; remove asphalt driveway and replace with circular drive in compacted stone and dust with gravel surface; install three (3) downspout drywells and landscape, and install stairway with railings. Located: 600 Koke Dr., Southold. SCTM#87-5-5 Inspected by: Don Wilder, Chris Kempner The CAC Supports the application with the following conditions: the patio is pervious; drywells are installed to contain run-off; all roof drains lead to drywells; and driveway should be completely pervious Vote of Council: Ayes: All Motion Carried FISHERS ISLAND UTILITY CO. to Amend Permit #6406 to allow two (2) tie-off poles for the newly constructed docking facility. Located: Private Rd. off the Gloaming, Fishers Island. SCTM#10-9-13 The CAC did not make an inspection, therefore no recommendation was made. Moved by Peter Young, seconded by Don Wilder, it was RESOLVED to SUPPORT the application of JOSEPH & GRACE FINORA to Amend Permit #6005 to replace the previously existing floating dock with a low-profile, open-grate catwalk and a 6'X 22' floating dock. Located: 45 & 135 East Legion Ave., Mattituck. SCTM#122-3-12&13 Inspected by: Peter Young, Jim Eckert The CAC Supports the application with the Condition the dock and vessel don't exceed 1/3 across the width of the creek. Vote of Council: Ayes: All Motion Carried CLEAVES POINT VILLAGE to Amend Permit #4224 to install two metal brackets on an existing floating dock in order to secure a docking platform for a wave runner. Located: 2820 Shipyard Lane, East Marion. SCTM#38-7-4.2,8 & 38-2-1,45 The CAC did not make an inspection, therefore no recommendation was made. The next meeting of the Conservation Advisory Council has been set for Wed., October 10,2007 at 5:30 PM.
