Grebe, Jr. Property Location: South Side of Avenue B, Fishers Island CTM 6-2-14,15,16 & 17.1 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. PROPERTY FACTS/DESCRIPTION: The entire area within which the three parcels exist as single and separate parcels consists 2.12 acres, with frontage along Avenue B and Fox Avenue. The property is improved with existing buildings as shown on the 3/28/03 survey prepared by Richard H. Strouse, L.S., as updated 2/6/07 for the proposed change in boundary lines of the parcels. BASIS OF APPLICATION: Zoning Code Section 280-114, based on the Building Inspector's April 9, 2007 Notice of Disapproval concerning proposed re-arrangement of lot lines for three existing nonconforming lots. The rearrangement of lot lines will change the size of nonconforming lots. Land area shown as #14 with an existing dwelling will be increased in size; Lot 15 with an existing dwelling will be increased in size. Land area shown as 17.1 will be reduced in area to 69,428+/- square feet. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application has been referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning reply dated July 25, 2007 states that the application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on August 2, 2007, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicant is requesting variances for rearrangement of lot sizes, modified at the boundary lines with an adjoining parcel, without creating any new building sites. The lands are located in zones R40, R80, and partly in LB. Page 2 - Augusl 16, 2007 . ZB File No. 6043 - Alfred R. Grebe, Jr. CTM No. 6-2-14,15,16 & 17.1 . REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. No new building site is being created, and the owner is merely altering his boundary line with an adjoining owner. The applicant wishes to increase the square footage of two lots (#14 and #15) to make them less non-conforming, and to decrease the square footage of lot #17.1 to make it slightly more non conforming, without creating any other lot and reference to a former lot #16 will no longer exist. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The subject parcels are located in different residential zone districts (R-40, R-80) and the LB district zone to the south (17.1). 3. The variances granted herein are not substantial. The variance will allow Lots 15 and 14 to become more conforming by including a portion of adjacent land, and Lot 17.1 less conforming, without creating additional building lots. 4. The difficulty has been self-created. The nonconformity of the three parcels existed prior to the creation of the R-40, R-80 district lot size requirements. 5. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. Grant the variance stating that lot 14 would become less nonconforming from 10,000 square feet to 11,786 square feet of total lot size, and less nonconforming from 101 feet in width to 117 feet in width. The nonconforming depth of 74 feet will remain. Lot 15 becomes less nonconforming from 8,926 square feet to 11,029 square feet; width from 75 feet to 83 feet' and depth from 100 feet to 120 feet. Lot 16 will no longer exist because it was merged with the adjacent lots noted above; no new lot will be created. Lot 17.1 will change from its present nonconforming size of 71,025 square feet to 69,428 square feet. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of lot size modifications, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Oliva, seconded by Member Weisman, and duly carried, to Grant the variance, as applied for, according to the survey submitted by CME Associates Engineering, dated 3/08/07, revised by Richard H. Strouse, L.S. on 2/6/07. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving Page 3 - August 16, 2007 . This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. Re: Properties of Albert Richard Grebe, Jr. (SCTM Nos. 1000-6-2-17.1. 17.2 & 18) Dear Damon: Further to our telephone conversation this morning, I am writing to ask you to confirm the responses you gave me in 2003 to inquiries I made of you and Mike Verity concerning the referenced properties of Albert Richard Grebe, Jr., one of which (tax lot 17.1) is part of an application for a proposed lot line change now before the Planning Board and an application for a variance now before the Board of Appeals. Tax lot 17.1 has a lot area of71 ,075 square feet. According to the Assessors Office, tax lot 17.2 and tax lot 18 have lot areas of .50 acre and .56 acre, respectively (21,780 square feet and 24,394 square feet if those acreage figures are precise). Tax lot 18 is improved but tax lots 17.1 and 17.2 are vacant. I posed certain questions for you and Mike and you responded to me by telephone with the answers set forth next to my questions as follows: 1. In which Zone District(s) do the three parcels lie? You confirmed my opinion that tax lot 17.1 lies entirely within the R-80 Zone District while tax lots 17.2 and 18 lie partly within the R-80 Zone District and partly within the Limited Business District. 2. Given that title to all three parcels is held by the same owner of record, has anyone of the three parcels merged with one or both of the other parcels? You confirmed my opinion that the three parcels have retained their separate status, tax lot 18 because it is improved, tax lot 17.1 because it is greater than 40,000 square feet in lot area, and tax lot 17.2 because, even though it is vacant and less than 40,000 square feet in lot area, it has a different zone classification from tax lot 17.1 and parcels with different zone classifications cannot merge. If so, do you agree that tax lot 17.1 and tax lot 17.2 are in different zone districts even though a portion of the latter lot may lie in the same district as the former lot? You confirmed both points: otherwise separate parcels in different zone districts cannot merge and tax lot 17.1 and tax lot 17.2 would be considered to be in different zone districts notwithstanding that a portion of one may be in the same district as the other. 4. Do you agree that (as now constituted at least) these three parcels have not merged but have retained their separate status for the reasons set forth above? You agreed with my conclusion that no merger has taken place among the three parcels. 5. Assuming, as I believe, that tax lot 17.1 is entirely within the R-80 Zone District and that neither tax lot 17.2 nor tax lot 18 has merged with it, would the proposed conveyance of 1,647 square feetfrom tax lot 17.1 to tax lot 15 as shown on the lot line change map require a variance? Or would the fact that there would be an equal and corresponding reduction in the degree of nonconformity of tax lot 15 (an 8,926 square foot parcel in an R-40 Zone District) obviate the need for a variance for the conveyance of 1,647 square feetfrom tax lot 17.1? You advised me that a variance would in fact be required and issued a Notice of Disapproval when I applied for it earlier this year.
