Dey Property Location: 1000 Paradise Point Road, Southold CTM 81-3-24.2 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. PROPERTY FACTS/DESCRIPTION: The applicants' 102,259.62 square ft. parcel is located in the R-80 Residential Zone District with 550 feet along Paradise Point Road, is improved with an existing single-family dwelling and an existing two story accessory building with second-floor apartment. BASIS OF APPLICATION: This is a request for Variances under Section 280-121, based on the Building Inspector's amended May 22, 2007 Notice of Disapproval, concerning proposed alterations and additions to the existing nonconforming building (garage with apartment above, as an accessory to the main building) for the reasons that the proposed construction is not permitted to be enlarged, altered, extended, reconstructed or restored or placed on a different portion of a lot ...occupied by such use on the effective date of this chapter, nor shall any external evidence of such use be increased by any means whatsoever. The building was renovated in 1965 under a permit to alter and add to an existing garage with apartment above, the current plans indicate reconstruction of windows and doors, with decorative dormer addition at 9 feet, and upper deck and storage structure at 15 feet, from side property line. Also, the interior living area will increase with conversion of garage to recreation space in addition to the apartment above garage (also see Building Permit #2867-z and C.O. #Z2429 dated May 31, 1966 for a private one-family dwelling and garage building; also Preexisting Certificate of Occupancy#Z-32499 dated 7/31/07). SUFFOLK COUNTY ADMINISTRATIVE CODE: This application has been referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning reply dated July 25, 2007. states that the application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on August 2, 2007, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: Page 2—August 16,2007 • ZB File No. 6056 —Douglas and Jane M. CTM No. 81-3-24.2 AREA VARIANCE RELIEF REQUESTED: The applicant wishes to update and reconstruct the interior of the second-floor apartment of this accessory garage. At the hearing, testimony was submitted which indicated that the structure was actually built and used in its present use before zoning. The use of the garage with second-floor apartment was affirmed by the Building Inspector as existing before 1957 (contrary to the most recent Notice of Disapproval amended May 22, 2007), and the owner's contractor testified that the garage was heated when asked during the hearing by the Board. The Building Inspector agreed to reissue the Notice of Disapproval, and the Board accepted the amended August 8, 2007 Notice of Disapproval indicating renovations were made in 1965 rather than erection of a building. The nature of the appeal is to update the windows and the siding of the accessory building, as well as the installation of a grand circular stairway on the exterior of the structure to mirror the stairs recently completed on the exterior of the principal building (dwelling). Together with these alterations is the renovation of the three-bays of this four-car garage on the first story of this accessory building, to a recreation room for his family, with the fourth bay of the garage remaining (facing Paradise Point Road) for use by a tenant to occupy the second-floor garage apartment, as shown on Site, Floor and Elevation Plans prepared by Samuels and Steelman dated 1/26/07. The total renovation includes the reconstruction of windows and doors, with a nonfunctional decorative dormer addition with a nine (9') ft. setback and an upper deck and storage structure at 15 feet from the side property. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The Board felt that the application as applied for would not cause a detriment to the immediate neighborhood, on this 2.3-acre parcel because the work will be on the interior of the building and without any outside structural changes. 2. The benefit sought by the applicants cannot be achieved by some method, feasible for the applicants to pursue, other than an area variance, 3. The variance granted herein is substantial. The garage apartment is nonconforming as to setback, and in compliance as to the nonconforming apartment accessory use. The applicant did not request an increase of the habitable floor area of the apartment. The requested relief involves only a portion of the first floor of the building (to be converted from three garage bays to recreation space with one garage bay remaining), which is a renovation the and maximum relief the Board would grant. 4. The difficulty is not self-created. 5. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicants to enjoy the benefit of a recreation room in an accessory building, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Member Weisman, and Page 3—August 16,2007 • ZB File No.6056 —Douglas and Jane M. CTM No. 81-3-24.2 duly carried, to GRANT the variance as applied for, as shown on the survey prepared by Joseph A. Ingegno, Land Surveyor dated April 25, 2007 and Site, Floor and Elevation Plans (Pages 1-4) prepared by Samuels and Steelman dated January 26, 2007. Any deviation from the variance given such as extensions, or demolitions which are not shown on the applicant's diagrams or survey site maps, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Since that time, the property has changed hands and the building permit resulting from the ZBA finding has been twice renewed (it is currently open). My client, Mark Miller, intends to go ahead, and his general contractor, Eugene Burger, has begun to investigate the existing structure more closely. In doing so, he has raised doubt about the structural viability of the existing masonry foundation: it probably needs to be replaced with a new spread footing and foundation. This has led to my client proposing the possibility of adding a full basement under the existing wood framed structure. Attached you will find a drawing showing this proposal. I met yesterday with Chief Building Inspector, Mike Verity, on this subject, and whether the Building Department could authorize that amendment to the existing permit. He suggested that I write you directly and pose this question: Would the ZBA consider the installation of a full foundation in this instance a "similar design that is de minimus in nature". For your information, the space will be used only for mechanical systems, thereby allowing us to increase the size of the existing garage, and for incidental storage. Lot created per Planning Board resolution dated 4/12/2005 (see attached) • Page 1 of 3 - Dey Appeal Apatio• • • BACKGROUND Applicant seeks variances to (a) add a decorative dormer to the northern roof of the existing detached building which contains a detached garage and second floor apartment, and (b) add a semi-circular outside stairway with second floor deck to the east side of that building in order to enhance the cohesion with the dwelling. Both additions are within the 20' northern side yard but do not result in a diminishment of the existing 8' side yard. The 3-bay garage will be discontinued and converted into a non-habitable recreation room with bathroom. The notations on the Southold Town Property Card appear to reflect that the 4.25 acre lot 24, in or around May of 1958, was improved by "Boat House. Large Dock. Marine Railway. Bath House. Garage with Large Apartment and Main House." On September 21, 1965, Building Permit # 2867-Z was issued to "build an addition and make alterations on an existing garage & apt building;" and Certificate of Occupancy ("C/O") # Z-2421, dated May 31, 1966, for a "Private one family dwelling & Garage building" covers that work.' C/O # Z-2750 dated July 13, 1967 covers renovations to a "Private one family dwelling." C/O # Z-3851 dated June 29, 1970 is for a "Private bath house (Accessory Building)." Copies of Southold Town Property Card, Building Permit # 2867-Z and the aforementioned C/Os are submitted herewith. Until May of 2002, the property was owned by the Stott family. Ownership was I�1 transferred to Paradise Point Holding Corporation by deed dated May 24, 2002. rv\ � By resolution dated April 12, 2005, the Southold Planning Board granted final approval of a lot line change in connection with lot 24 and the adjoining 1.398 acre lot 25 to the south. The lot line change created two lots of conforming size: the subject lot (n/k/a lot 24.2) is 2.347 acres and the adjoining lot (n/k/a lot 25.1) is 3.107 acres. By deed dated March 28, 2005, title to the subject parcel (lot 24.2) was transferred to Douglas A. Dey and Jane M. Dey. On May 24, 2005, Building Permit # 31160-Z was issued to demolish and construct a new dwelling on the premises. The construction of the new dwelling continues. Since 1958, the detached garage contained the second floor apartment with a living room, kitchen, 3 bedrooms and 2 baths. The second floor apartment was in continuous use as an apartment. There has been no discontinuance of the non-conforming use pursuant to Code §280-121G. The Notice of Disapproval dated April 13, 2007 and amended May 22, 2007 states the following: The proposed construction is not permitted. Plans indicate reconstruction of windows & doors, with decorative dormer addition at 9' and upper deck & storage at 15' from side property line. In addition, the interior living area will increase, including conversion of garage to recreation space. The Notice of Disapproval is based on Applicant's proposed renovation of the detached garage to bring it up to the current NYS Building Code and to make the structure harmonious with the new dwelling. The square footage of the apartment is unchanged. The basic foot print of the building remains the same. The following modifications are proposed: 1. A semi-circular outside stairway with second floor deck attached to the east side of the building. A small portion of this addition is within 15' of the side yard line. The configuration of that stairway/deck mimics the stairway/deck on the western side of the garage attached to the house. This is non-habitable space. 2. An ornamental dormer is added to the roof on the northern side of the building. Again, According to the application, the 14' addition to the garage reduced the side yard to 10' from the northern property line. The current survey, however, reflects the 8' side yard setback. Page 2 of 3 - Dey Appeal Apatio• • • this is to increase the visual compatibility with the dwelling. This purely decorative dormer is non-habitable space. 3. Because there garage space is attached to the new dwelling, the three-bay garage in the accessory building will be discontinued and replaced with a recreational room, which is permissible under the Code. The first floor toilet room will be removed and a new bathroom will be located within what had be the three-bay garage. Code-compliant windows and doors will replace the windows and doors currently in the structure. The recreation room and bathroom are not to be used by the tenants of the second floor apartment. While it might be described as "living space," neither the recreation room nor the bathroom is habitable space. 4. The first floor entrance to the apartment will be relocated to the west facade of the building and a short hallway will be created. Presently, the second floor apartment can only be reached through a door and stairway on the eastern side of the building. There is no direct access between the apartment and the one-bay garage. The proposed renovation will provide direct access to the hallway from the west facade of the building and from the one-bay garage. The hallway and closet are non-habitable space. 5. The configuration of the rooms on the second floor will be changed without increasing \3./. the overall square footage and/or the number of bedrooms. There is no increase in the use of " ��<\ the second floor apartment. ip \9 AREA VARIANCE ANALYSIS 1. An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment to nearby properties, if granted, because: (a) The second floor apartment will not be expanded. (b) Excess area dedicated to garage space will be eliminated and replaced with a recreation area and bathroom. (c) The exterior appearance will be dramatically enhanced making it visually compatible with the main dwelling. (d) The semi-circular addition is on the east side of the building and will not be visible from the road. (e) The existing side yard setback will be maintained. 2. The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance, because: (a) The 8' side yard will be maintained. (b) The eastern addition of the stairs and deck will mirror the western side of the dwelling and will provide an alternative entryway to the second floor apartment. (c) As a cosmetic addition, the north dormer is without practical use. (d) The relocation of the primary entry to the western face of the building will provide convenient and direct access to the driveway and the one-bay garage. Emergency access to the apartment is significantly improved by the relocation of the entrance. (e) The additions to the structure are all non-habitable. 3. The amount of relief requested is not substantial because: (a) The western addition are intended to make the structures on the property cohesive in appearance. The most northerly side of that addition is 15' from the property line and is 7' south of the northern facade of the structure. (b) The 8' northern side yard set back remains unchanged. 4. The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: (a) The proposed exterior changes to the already existing structure are cosmetic in nature and increase the conformity of the accessory building with the new dwelling. (b) The expansion to the east does not decrease the existing northern side yard setback and will not be visible from the road. Since that time, the property has changed hands and the building permit resulting from the ZBA finding has been twice renewed (it is currently open). My client, Mark Miller, intends to go ahead, and his general contractor, Eugene Burger, has begun to investigate the existing structure more closely. In doing so, he has raised doubt about the structural viability of the existing masonry foundation: it probably needs to be replaced with a new spread footing and foundation. This has led to my client proposing the possibility of adding a full basement under the existing wood framed structure. Attached you will find a drawing showing this proposal. I met yesterday with Chief Building Inspector, Mike Verity, on this subject, and whether the Building Department could authorize that amendment to the existing permit. He suggested that I write you directly and pose this question: Would the ZBA consider the installation of a full foundation in this instance a "similar design that is de minimus in nature". For your information, the space will be used only for mechanical systems, thereby allowing us to increase the size of the existing garage, and for incidental storage.
