The action was brought against A&D Masonry who did brick work for the residence being constructed by you at Pine Terrace and Willow Drive, East Marion in the County of Suffolk, State of New York. The defendant did the brick work for the entire house including a hearth and fireplace and construction of a chimney. His work was done in a negligent, improper, un-workman-like manner and as a result thereof the building department of the Town of Southhold failed to approve the fireplace and caused other substantial damage such as replacement of the termite sill plate and damage to the floors of the building. The matter was finally settled on November 3, 2005, and the action was discontinued. During the period that this action was pending, you were unable to complete the work involving the chimney and it was only after the case was settled that you proceeded to do so.
