Enclosed please find the Wetland Permit and Coastal Erosion Permit for your
clients, Angelo & Josephine Padovan, as approved by the Board of Trustees at
their Regular Meeting held on October 18, 2006.
As discussed, the approved plans for the stairs do not match the recently
reconstructed stairs, and the new retaining wall remains unpermitted at this time.
Therefore, in order to avoid further action by this Board, an Amendment to these
permits must be applied for within 60 days from the date of this letter.

TERMS AND CONDITIONS
The Permittee, Angelo & Josephine Padovano residing at 101-20 67th Dr.. Forest Hills. NY, as
part of the consideration for the issuance of the Permit does understand and prescribe to the following:
1. That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of South old.
2. That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That iffuture operations of the Town of South old require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
8. The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Department of Real Properties Office as a notice
covenant and deed restriction to the deed of the subject parcel. Such evidence shall be
provided within ninety (90) calendar days of issuance of this permit.
9. That the said Board will be notified by the Permittee of the completion of the work
authorized.
10. That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.

Dear Ms. Moore:
The Board of Town Trustees took the following action during its regular meeting held on
Wed., October 18, 2006 regarding the above matter:
WHEREAS, Patricia C. Moore, Esq. on behalf of ANGELO & JOSEPHINE PADAVAN
applied to the Southold Town Trustees for a permit under the provisions of Chapter 275
of the Southold Town Code, the Wetland Ordinance of the Town of Southold,
application dated April 26, 2006, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application be
found Consistent with the Local Waterfront Revitalization Program policy standards,
and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on October 18, 2006, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,

WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees have found the application to be Consistent
with the Local Waterfront Revitalization Program, and,
RESOLVED, that the Board of Trustees approve the application of ANGELO &
JOSEPHINE PADOVAN to repair the existing shed and stairs with the following
conditions: the shed does not have any plumbing; any electricity will come from the
existing, adjoining dwelling; the shed is never to be inhabited; and a drywell is installed
to catch the run-off from the existing paved driveway for the adjoining dwelling; and as
depicted on the plans prepared by Angel B. Chorno dated September 4, 2007, and
survey prepared by Howard W. Young dated April 7, 2006.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

At the meeting of the Southold Town Conservation Advisory Council held Wed., May 10,
2006, the following recommendation was made:
Moved by Jack McGreevy, seconded by Peter Young, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL WITH
CONDITONS of the Wetland Permit & Coastal Erosion Permit applications of ANGELO
& JOSEPHINE PADOVAN to repair the existing shed.
Located: Soundview Ave., Southold. SCTM#135-1-23 & 24.1
The CAC recommends Approval of the application with the Condition the repair is
inkind/inplace only, no treated lumber is used, and no plumbing. The inkind/inplace is
limited to the existing footprint of the shed only and does not include the deck.

Dear Mr. King,
This Board has attended trustee hearings for the period of May 05, 2005 to November 17,
2005 to oppose Mr. Padavan's total disregard for the environment, when he sought to build
on the Beach, wetland coastal erosion hazard area and inconsistent with the L WRP . The
Board of Trustees rightly rejected his application (Trustees Decision enclosed). Now he is
back trying to have us believe that his 10 X 14 old tool shed somehow has transformed into
a Beach House that needs electric, plumbing and a Deck. If this application is not rejected,
his next application will be that he has an existing "little house".
The majority of owners of the North Fork Beach Condominiums heartily request that the
Board of Trustees rejects this disingenuous application.

Dear Ms. Moore:
The Board of Trustees took the following action during its regular meeting held on Wed.,
November 16, 2005 regarding the above matter:
WHEREAS, Patricia C. Moore as agent for ANGELO PADAVAN applied to the
Southold Town Trustees for a permit under the provisions of the Wetland Ordinance
under Chapter 97 of the Town Wetland Code and Chapter 37 of the Town Code of the
Town of Southold, application dated December 22,2004 and
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council for their findings and recommendations, and,
WHEREAS, the Southold Town Conservation Advisory Council recommended
DISAPPROVAL of this proposed application, and,
WHEREAS, several Public Hearings were held by the Town Trustees with respect to
said application at which time all interested persons were given an opportunity to be
heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,

WHEREAS, the action is found to be INCONSISTENT with the Town of Southold Local
Waterfront Revitalization Program, and
WHEREAS, the existing permitted structure is a 10' x 14' shed, and the proposed house
is 708 square feet which is greater than 25% of the existing structure, and,
WHEREAS, In accordance with Chapter 37, Coastal Erosion Hazard Areas, Major
Additions are defined as greater than 25%, and are not allowed in the Coastal Erosion
Hazard Area, and,
WHEREAS, the existing structure is a storage shed, and not a habitable structure,
with no sanitary system, electric, insulation, or plumbing, and,
WHEREAS, the proposed house is located on the beach, as defined in Chapter 37, and
all development is prohibited on the beaches, and,
WHEREAS, the proposed house is INCONSISTENT with the following LWRP policy
standards: 3.1,4.1, 4.2,5.1,5.3,6.1, and 8.3. and is therefore inconsistent with the
Town of South old's Local Waterfront Revitalization Plan, and,
NOW THEREFORE BE IT
RESOLVED, that the Board of Trustees DENY WITHOUT PREJUDICE, under Chapter
37, the application of ANGELO PADAVAN to construct a single-family dwelling,
sanitary system, gravel driveway, and bulkhead, and,
BE IT FURTHER RESOLVED that this determination should not be considered a
determination made for any other Department or Agency, which may also have an
application pending for the same or similar project.

My client wishes to repair and/or, in place, replace the
existing wood structure. Since the Board denied a permit to
construct a single family dwelling on this parcel, the recreational

Denial of this permit would result in a regulatory condemnation of

A. INSTRUCTIONS (Padovan 1000-135-01-23 & 24.1)
I. All applicants for permits* including Town of Southold agencies, shall
complete this CCAF for proposed actions that are subject to the Town of
Southold Waterfront Consistency Review Law. This assessment is intended to
supplement other information used by a Town of Southold agency in making a
determination of consistency. *Except minor exempt actions including
Building Permits and other ministerial permits not located within the
Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form
should review the exempt minor action list, policies and explanations of
each policy contained in the Town of Southold Local Waterfront
Revitalization Program. A proposed action will be evaluated as to its
significant beneficial and adverse effects upon the coastal area (which
includes all of South old Town).

proposed action may affect the achievement of the L WRP policy standards and
conditions contained in the consistency review law. Thus, the action should
be analyzed in more detail and, if necessary, modified prior to making a
